Stairs Lynn Stogner Ross Robert James Valerino Leon Brooks HERS ABSE Cynthia Holt - Miller Ben Dyal Mike Davis Jay Marder, Director of Planning and Development Bettie Sonnenberg, Land Development Coordinator Marion Anderson, Recording Secretary The meeting was called to order at 7:00 P.M. by Chairman Dennison. The first item on the Agenda was to hold a Public Hearing to consider a request for a Dimensional Variance for property located at 217 S. Park Avenue in an SC-3 Zoning District, for an 18' setback for gas islands. Owner: Gas Properties; representative: Martin Rak. Martin Rak, Delco Oil, Inc., Box 86, Deland, stated that he was present representing Gas Properties. He stated that plans are to install the gas islands where they were before. Plans were drawn to relocate the gas islands but due to the ingress and egress, the best possible place is to put the gas islands back where they were. New tanks will be installed. Mr. Stogner asked how many gas tanks would there be. Mr. Rak stated 2 MMDs with 5 -hoses each or one island with two fueling stations. Mr. Rak stated that the same building would be used, the area repaved and new gas tanks installed. He stated that landscaping and renovations plans will be submitted to the City. Mrs. Stairs moved to approve based on the previous use of the site and staff's recommendations (attached). Seconded by Mr. Brooks. All in favor. Motion carried. The next item was to hold a Public Hearing to consider a request for a Dimensional Variance for property located at 840 E: 2nd Street in an RMOI, Multiple - family Residential - Office - Institutional Zoning District, for the purpose of a front yard setback -30' required, 27.49' proposed; maximum building area - 4,500 s.f. proposed; minimum open space - 39% proposed; minimum living area - 50' required, 70' proposed for steeple. Owner: Southeastern Conference Association of S.D.A., Inc.; representative: Mars Hill S.D.A. Church. Aldean Graves, representing the Pastor of Mars Hill S.D.A. Church, 1747 Hazelton Ave.,, Deltona was present for representation. Mr. Marder stated that the ordinance provides for more than 70' for a steeple as long as its not used for human occupancy. He stated that 70' for the steeple is fine. Mr. Robert asked if the existing 1 -story frame building would be demolished and replaced with a two story building. Mr. Graves stated "yes ". Mr. Stogner asked if there would be anything on the steeple. Mr. Graves stated that a cross or something to that effect would be placed on the steeple. Cheryl Jessup, 803 E. 2nd Street, stated that she was concerned with the parking. Mr. Graves stated that the Church had acquired the adjoining property northeast of 800 E. 2nd St. for parking. He also stated that the Church has permission from Dr. Day to use his parking area. Mr. Brooks moved for approval. Seconded by Mrs. Stairs. All in favor. Motion carried. The next item on the Agenda was to hold a Public Hearing to consider a request for a Dimensional Variance for property located at 13th Street and Lake Avenue in a GC -2, General Commercial Zoning District, for the purpose of a sideyard setback of 10' - 25' required., 15 proposed. Owner/representative: Robert E. Keltner. Mrs. Sonnenberg explained that this request came about because of a proposed action by the City. She stated that the City would like to install a drainage easement on the west side of the property. The owner will agree to the drainage easement if the variance is granted. She stated that the owner would not go . MINUTES PLANNING AND ZONING COMMISSION MEETING OF AUGUST 18, 1994 PAGE 2 forth with the agreement unless he receives the 10' setback because he wants to be assured that he can rebuild on this property if something should happen to the existing building. Mr. Robert asked if this request is approved, would it be in compliance. Mr. Marder stated that the intent and purpose of this request is that the owner be granted a variance for the existing building footprint. Mr. Robert moved to approve that the existing footprint be the determinate for setback requirements to match the existing footprint of today on Lake Avenue or 15' which ever is less. Seconded by Mr. Valerino. All in favor. Nation carried. The next item on the Agenda was the consideration of the Site Plan for Mars Hill Seventh Day Adventist Church, located at 804 E. 2nd Street in a RMOF, Multiple - family Residential - Office - Institutional Zoning District. Owner: South- eastern Conference Association of S.D.A., Inc.; representative: Donovan Dean.. Mr. Robert asked if the existing lighted sign is to be saved and if it meets today's requirements . Mrs. Sonnenberg stated that she did not recall the square footage of that sign. She stated that the church could have up to 32 square feet for a sign. Aldean Graves of Deltona, stated that the sign is approximately 2x3x6. Mr. Stogner asked if the oak trees would be removed. Mr. Graves stated that all trees will remain except for one rain tree. Mrs. stairs moved to approve subject to the following conditions. Seconded by Mr. Brooks. All in favor. Motion carried. i a. If the total square footage of the building is 8,000 s . f . or more and less than a Type 1, fire resistive construction, it is required to have a fire sprinkler system. The plans appear to be contradictory in that the square footage is listed as 7,700 s . f . but the building dimensions are ?4' by 70 or 4,900 s. f . for each floor. If necessary, contact Richard Cohen, Fire Marshall, at 334 -5654. b. Whtt method is proposed for solid waste disposal? There is no type, to ation or service access noted for collection. c. Please mote that a St. Johns River Water Management Permit will be required. d. Note that 18 additional parking spaces are permitted by Dr. J. R. Day will permit an additional 54 seats making a total of 129. Is this what is proposed for the sanctuary? If it is not adequate, either a variance or an additional arrangements will be required. The next item for consideration was the request for a chain link fence within the front yard setback for Auto King, an auto repair shop located at 1208 Elm Avenue in a GC -2, General Commercial Zoning District. Owner: Claude E. Wallace; representative: Michael Rivera. Mike Rivera, 1843 S. Adams Avenue, Sanford,. stated that he has a problem with the theft of tires and batteries. He stated that his business has been broken into 3 times. The Police wanted him to put in a fence a long time ago. He stated that he did not know he needed permission to put up the fence until 5 or 6 months later when he received a letter from the City stating permits weren't pulled for installation of the fence and that he was in violation of City Codes. Mr. Rivera stated that the fence is 5 high and that the fence has solved his theft problems. Mr. Stogner asked the applicant if he was just putting a front to the fence because of the existing fences on both sides of the property. Mr. Rivera stated "yes". Mrs. Sonnenberg. stated that the fence is not allowed within a buffer zone. Mr. Rivera explained that he is renting the property. He stated that the owner of the property refused to pay, or even pay half, for the installation of the fence. The owner is not going to make any improvements to the property. Mr. Rivera stated that he was not sure as to what he could or could not do with the property. Mr. Stogner moved to table so that the applicant could provide more information. Seconded by Mr. Brooks. Mr. Brooks stated that he would prefer to table until the owner could appear before the Commission. If there is a requirement, it has to be stet. Mr. Robert stated that this would give the applicant more time for better drawings as to the right -of -wags. Mrs. Stairs in opposition. All others in favor. Motion carried. H I N=S PLANNING AND ZONING COMMISSION MEETING OF AUGUST 18, 1994 PAGE 3 on the Addendum to the Agenda was the consideration of the final plat for Lot 11, Northstar Business Park Phaae Two, located at Gal Central Park Drive in a RI -1, Restricted Industrial Zoning District. Owner: Economic Development Group Enterprise Inc.; representative: Thomas B. Ball III. Torn Ball, 683 Morning Dove Cir. r Lake Mary, stated that stated that he was asking for a replat of Lot 11 into three parcels. He stated that they have closed in escrow until the replat is completed. All three parcels are large enough to accommodate commercial use in the City. Mrs. ,Stairs moved for approval. Seconded by Mr. Robert. All in favor. Motion carried. Mrs. Stairs questioned the car lot on 17 -92 next to the Chinese restaurant as to how marry cars are allowed on the site. Mrs. Sonnenberg stated 7 and that she wound talk with Code Enforcement officer. Mrs. Sonnenberg informed the Commission that Mr. Dennison had given verbal approval for property owner to install a fence at the corner of 3rd Street and Dolly Avenue. Mr. Robert moved to approve the fence as shown in the diagram at 301 Dolly Avenue. Seconded by Mr. Brooks. All in favor. Motion carried. Mrs. Sonnenberg noted that Staff approved a drive -thru window for ABC Liquor, and that they have agreed to landscape and screen the dumpster area. Y oe Jennison, Chairman From the Director of Planning and Developmen August 11, 1994 TO: City of Sanford Planning and Zoning Commission SUBJECT: Recommendations for Meeting of August 18, 1994 KELTNER - Request for a dimensional variance to permit commercial use property Zoned GC -2, General Commercial located at the southwest corner of West 13th Street and Lake Avenue. 1. Site is Zoned GC -2, General Commercial and includes an existing block building. 2. Applicant requests a dimensional variance of 10 feet in order to permit a setback on Lake Avenue of 15 feet instead of 25 feet. 3. A portion of the property is to be purchased by the City for a stormwater management project. 4. Recommend that the request for a dimensional variance be approved based on public actions beyond the control of the property owner. MARTIN RAK - Request a dimensional variance for gasoline island setbacks for property located at the northeast corner of the intersection of Park Avenue and Third Street. 1. Site is Zoned SC -3, Special Commercial and includes a building that was previously utilized as a convenience store with gas pumps. Gasoline pumps are not presently located on the site. 2. Requested dimensional variance is to provide for a 17 foot gasoline island setback from the property line instead of the present requirement of 30 feet. 3. Recommend approval of the dimensional variance request to locate gasoline pump islands within 17 feet of the property line based on existing structure and similarity of the request with the previous use of site. Planning Recommendations - Page 1 MARS HILL S.D.A. CHURCH - Request a dimensional variance for side yard setback and maximum building height requirements for property Zoned RMO1, Multiple Family Residential, Office and Institutional located at the northeast corner of East Second Street and Locust Avenue. 1. Site is Zoned RMOI, Multiple Family Residential, Office and Institutional and includes a one -story church building with out - buildings. The existing church building appears to be an historical structure. 2. Applicant requests to construct a new church building with a 70 foot high steeple. Assuming the steeple is not intended for human occupancy, the proposed steeple height does not require a dimensional variance. 3. The applicant requests a setback on Locust Avenue of 27.49 feet instead of the required 30 feet. The existing building appears to be closer that 20 feet to the property line at this time. 4. Recommend approval of the requested variance to the building setback on Locust to provide for a 27.49 foot setback based on the desirability of lessening the present non - compliance.
