The first item on the Agenda was the consideration of the Adult
Entertainment Regulations and Related Revisions to the Land
Development Regulations.
Mrs. Sonnenberg stated that the City Commission has referred both
the Adult Entertainment Code and related revisions to the Land
Development Regulations to the Planning and Zoning Commission. She
stated that Schedule B, Permitted Uses from the Land Development
Regulations includes provisions to permit alcoholic beverage sales
at adult performance establishments. The alcoholic beverage sales
permitting procedures are the same as for other similar permits by
conditional use procedures with approval by the City Commission.
The difference is that such use would only be conditional in an
industrial zoning district, which the City does not permit
alcoholic beverage sales, in conjunction with an adult performance
establishment,
Mr. LeRoy moved to recommend approval to the City Commission.
Seconded by Mr. Brooks. All in favor. Motion carried.
The next item on the Agenda was to hold a Public Hearing to
consider a request for a Conditional Use application for property
located at 2543 S. French Avenue in a GC -2, General Commercial
Zoning District, for the sale of retail cars in a non - conforming
structure. Owner: Automotive 1 Parts Stores, Inc.;
representative; Luis Zambrana.
Luis Zambrana, 5508 Benchmark Lane, Sanford, stated that he would
like to open a used car lot at the corner of Bayard and 17 -92, the
site is located across from the China Ding Restaurant.
Mrs. Sonnenberg read into the record the City Planner's
recommendations (attached). Mr. Zambrana stated that he objects to
Recommendation "D" . He stated that there will be no repairs at all
and that he wants to use what is already there for sales. Mr.
Zambrana stated that in checking, he found out that other lots
along this area do not have a 10' landscape area. He requested
that he be allowed to block off French Avenue with landscaping and
have customers enter off Bayard Street. He requested a smaller
landscape strip, perhaps 5 feet. He stated that he had spoken with
the owner and the underground tanks are in good order and that they
would not be used. Mr. Brooks stated that the tanks have to be
safe for environmental reasons,

Mr. Vance Taylor was in the audience and stated that he was in
favor of the 5' landscape strip.
Mr. Davis asked if the pump island would be moved. Mr. Zambrana
stated that he would comply with the removal of the pump island and
all appurtenances.
Mr. Brooks moved for approval based on staff's recommendations to
include the restriction of access on French Ave. and define the
access on Bayard St. in eliminating a potentially dangerous traffic
configuration, to install a 5' landscape buffer strip on French and
Bayard, to remove the pump island and all appurtenances for
gasoline service and to provide environmental status of the
underground tanks, and that no repairs or servicing be done on
site. Mr. LeRoy seconded. All in favor. Motion carried.
The next item was to hold a Public Hearing to consider a request
for a Dimensional Variance for property located at 441 E. Airport
Blvd. in a ROI, Multiple - Family Residential - office- Institutional
Zoning District, for the reduction of parking spaces: 34 required,
24 present/ proposed. Owners /representatives: N.I and Carolyn
Richburg.
Victor Richburg, 1315 E. 24th St., Sanford, stated that his father
and mother owns this property and are in the process of developing
it for combination of an office building and an adult day care
center. Mr. Richburg stated that the request is justified because
the uses will not overlap. The day care center will use the
parking in the morning or late afternoons and the offices will use
the parking during regular business hours. He stated that the
reason for the variance is because the retention pond took up 6
parking spaces
Mr. Sonnenberg stated that there are actually 36 parking spaces
required because of staff members. Mr. Richburg stated that the
staff would come in at different times.
Mr. Brooks moved for approval of the reduction of parking spaces
from 36 to 24. Seconded by Mrs. Holt- Miller. All in favor.
Motion carried.
The next item was the consideration of the Site Plan for a detached
sign for Leer Truck Accessory Center, an automobile and truck
accessory sales and installation use, located at 3763 Orlando Drive
in a GC -2, General Commercial Zoning District. owner; Merrill
Lynch Pierce Fenner and Smith, Inc., Custodian; representative:
Garb Paduch. Tabled; 12/2/93.
Derrick Paduch, 321 Oleander way, Casselberry, stated that he had
discussed over the phone with Mrs. Sonnenberg staff's
recommendations and that he has no objections.
Mr. LeRoy asked if the sign would be 70 square feet double - faced.
Mr. Paduch stated that the sign would be 48 square feet.
Mr. LeRoy moved on approval subject to the maximum sign face being
limited to 50 square feet, 50 square feet of landscaping, and a 15
foot sideyard setback. Seconded by Mr. Brooks. All in favor.
Motion carried.
The next item for consideration was the Site Plan for a detached

Charles Hill, 2934 N. Forsyth Road, winter Park, was - present for
representation. Mrs. Sonnenberg stated that she had discussed
staff's recommendations with Mr. Hill and also that he is
requesting a reduction in the landscape buffer. Mr. Hill stated
that he needed extra space to park ears. Mr. Hill agreed that he
would upgrade the landscaping area in front of the automobiles and
would waive the sign.
Mr. Brooks moved on approval subject to the waiver of the 50 square
feet of landscaping around the base of the sign but requiring that
the buffer hedge be upgraded and the sign be limited to 25 feet in
height. Seconded by Ms. Holt - biller. All in favor. Motion
carried.
The next item for consideration was a request of a waiver of the
required landscape, per Schedule J,. for Teen Challenge located at
3706 Sanford Avenue in a RMOI, Multiple- Family Residential-Office-
Institutional Zoning District. owner: Teen Challenge of Florida;
representative: Jerry Nance. Tabled: 12/2/93.
Alan Bullock, 3706 S. Sanford Avenue, was present for
representation. He stated that they needed the waiver on the west
side because there is a line of mature trees there, planted close
together, which has a surface root If shrubs are planted,
one or the other will die. Mr. Bullock stated that they are
concerned with the plantings and having the shrubs die. He stated
that he was told by the nurseries that the shrubs would take
several gears to grow to a satisfactory height.
Mr. Bullock stated that they were to put up a shrub line on the
south side and that this had been.done. The cold weather killed
the shrubs. He stated that they would put in more shrubs but would
like to wait until the cold passes. He stated that the sprinkler
controls were stolen and that they needed to replace them before
installing any new plants. They would like to wait for the summer
months before they plant any shrubs.
Mrs. Sonnenberg stated that there is a row of pine trees
approximately 25' apart that are in fairly good shape. she stated
that there is a need for the replacement of the shrubs on the
southside and agrees that need for irrigation should come first.
Mr. Bullock feels the storage building would be completed by June
and requested that they be allowed to plant the shrubs then.
Mr. Brooks moved for approval for waiver of the shrubs on the
northside with the replacement of the shrubs on the southside in
June. Seconded by Mrs. Holt Diller. All in favor. Motion
carried.
The next item on the Agenda was the consideration of the Site Plan
for International Arrival Building, 1911 Airline Avenue, and a
reduction in the landscape criteria for off -- street parking and
vehicular circulation areas, per Schedule J, for property located
in a RI -1, Restricted Industrial Zoning District. Owners City of
Sanford /Sanford Airport Authority; representative: Stephen J.
Cooke, A.A.E.
Stephen Cooke, 2735 Mellonville Avenue, Sanford, stated that the
Airport was requesting approval of the building only and that staff
had concurred with this. Mr. LeRoy stated that he did not
understand just approving the building. Mrs. Sonnenberg stated
that there was no engineering for the roadway, and that the
engineering for the building was approved with the master plan.
Mr. Cooke stated that they were about 90% complete on the plans for
the roadway and that they should be done within a month. Mr. Cooke

stated that at the time of completion of the roadway, they will
come back and request approval.
Mr. Speer stated that staff feels the landscaping requirements must
be met and recommends that the landscaping exceed the requirements.
Mr. Cooke stated that they are continuing with the design and are
possibly looking toward pontoon islands in the parking lot and
possibly doing more landscaping than required. He stated that they
are working with staff on this. Mrs. Sonnenberg stated that the
landscaping plans could be finalized when the engineering plans are
submitted. Mr. Cooke asked that the reduction in the landscape
criteria for off - street parking and vehicular circulation areas be
deferred until the engineering plans are submitted.
Nance Taylor 2 419 Bay Ave., spoke in opposition to the request. He
stated that he objects to this building because there are no large
airlines to support this debt. He requested that someone explain
that the citizens of Sanford will not have to pay anything for this
airline service. He stated that someone with the City should take
a good, hard look at this. The noise pollution will ruin much of
the surrounding area. He asked how would the nearby residents
sleep with this much air traffic and asked if the citizens of
Sanford are safe. Mr. Taylor recommended that construction be
stopped to save millions of dollars, and recruit industrial
expansion to supply more jobs. He stated that if the Commission
has the right to say no and hold up construction of this, then this
should be done.
George Givens, 2002 Crystal View South, spoke in opposition to the
request. He stated that the new addition to the terminal would
cost $2 to 3 million. He stated that this represents a flagrant
lack of control of our assets. The current terminal is virtually
unused. The office for customs and the operation manager are not
being used. A few young ladies control the car rentals. other
than this, the terminal is not used. He asked what would the
expansion be used for. Current conditions don't warrant a
terminal. This is revenue. Virtually all heavy traffic has
ceased. Mr. Givens stated that he had heard that Cam -Aire is
leaving the Airport. If the Airport loses Com -Aire, everything is
gone. He asked what is the Airport proposing to do for revenue to
pay off this loan. They are not generating enough money. They are
hurting. Mr. Givens stated that this is a waste of money merely
because it is available.
Mr. Davis moved for approval and delayed action on the reduction of
the landscape criteria for off - street parking and vehicular
circulation areas until the submittal of the final engineering
plans. Seconded by Mr. LeRoy. All in favor. Motion carried.
The next item on the Agenda was the consideration of a request for
the reduction of the lake shore protection zone, per Schedule M,
for a single - family residence, Lot 124, Hidden Lakes Phase 3, Unit
5, located at 108 Blue spruce Ct. in a PD, Planned Development
Zoning District. owner /representative: Arthur J. Riegerts, Jr.
Arthur Riegerts, owner, stated that he would like to construct a
single family home, with a 25 setback from the 100 year watermark.
Mr. Riegerts submitted a rear lot grading diagram. He stated that
this is the last remaining vacant lot on Lake Ada in Hidden Lakes.
Mr. LeRoy moved on approval. Seconded by Ms. Holt - Miller. All in
favor. Motion carried.
On the Addendum to the Agenda was the consideration of the Site
Plan for a. detached sign for Truly Nolen, a commercial service,
located at 3422 Orlando Drive in a GC -2, General Commercial Zoning

Roger French, 107 Idyllwilde Dr., Sanford, stated that they would
like to erect a sign for Truly Nolen Pest Control with an
approximate 10 s (§tback. He stated that they have no problems with
landscaping for the sign. The planter will be approximately 11x12.
Mr. LeRoy moved on approval with 50 square feet of landscaping.
Seconded by Ms. Holt - Miller. All in favor. Motion carried.
Unanimously in favor of the minutes as circulated.

SUBJECT: Recommendations for Meeting of December 16, 1993
AA1 CAR AND TRUCK SALES, INC./LUIS ZAMBARANA - Request conditional use
approval to permit retail car sales and expansion /use of a nonconforming structure in
a GC -2, General Commercial Zone located at 2533 South French Avenue.
1. Site is Zoned GC -2, General Commercial and contains approximately 14,040
square feet. The site was a former gasoline service station with an existing
building. A fenced area is located on the easterly portion of the property.
The site is a corner location on U.S. Highway 17 & 92 and Bayard Street. The
most recent traffic count on the segment of the highway between Airport
Boulevard and 25th Street is 23,365 daily trips.
2. Uses adjacent to the site include single family residential to the east, retail
commercial and automobile repair to the north, and restaurants to the west and
south. A used automobile sales lot is located on the west side of U.S. Highway
17 & 92 in the general vicinity of site.
3. Based on the existence of similar uses already established in the immediate
vicinity of site, recommend that the request be approved with conditions. Because
of the comer location, high traffic volumes associated with U.S. Highway 17 & 92,
and unique character of nonconformities of the site, the following conditions are
recommended:
a. Restore and reconstruct the curb and comer of French Avenue and Bayard
Street to limit access to one northerly access on French Avenue and to
define the access on Bayard Street to eliminate a potentially dangerous
traffic configuration.
b. A ten foot landscape strip is required on French Avenue and a five foot
strip on Bayard Street. (Schedule J -2.3.A & B) This will help accomplish
condition a.
C. Remove the pump island and all appurtenances for gasoline servicing.
Provide status of the underground tanks — they must be approved as safe
by appropriate agencies or removed.

d. All repairs and /or servicing shall be located within a building or in an area
in the rear that is visually screened from surrounding areas. (Schedule E-
1.A.)
SUNSHINE ADULT DAY CARE - Request dimensional variance of parking requirement
to permit an adult day care facility for property zoned RMOI, Multiple Family Residential,
Office and Institutional located at 441 East Airport Boulevard.
Site is Zoned RMOI, Multiple Family Residential, Office and Institutional and is
basically vacant at the present time.
2. An undated site plan received on November 16, 1993 depicts the layout of parking
and proposed buildings for day care and offices. Requested variance is to reduce
the number of required parking spaces by 10 from 34 to 24. Explanation or
justification for the variance is not provided. The number of clients to be served
is not provided. Nor is the type of office provided. For example, if the office was
to be used by a doctor, the City requires additional parking beyond that requested
for the variance. Therefore, under no circumstances should the office space be
utilized for a doctor's office.
3. Based on the lack of justification and information for the variance, recommend
denial.
