CITY COMMISSION CHAMBERS MEMBERS PRESENT: Mike Davis Helen Stairs Ben Dyal Joe Dennison Tom Speer Leon Brooks John LeRoy Cathryn Welch MEMB ABSENT: Cynthia Holt- Miller OTHERS PRESENT: Jay Marder, Director of Planning and Development Bettie Sonnenberg, Land Development Coordinator Russ Gibson, Planning Technician Marion Anderson, Recording Secretary The meeting was called to order at 7:00 P.M. by Chairman Dennison. The first item on the Agenda was to hold a Public Hearing to consider a request to Rezone property located at the east side of Upsala Road, 1/2 mile north of C.R. 46A from SR -IAA, Single Family Dwelling Residential, to that of PD, Planned Development. owner: James & Debra Trizzino; representative: A. David Feinberg. Mr. John Reynolds, Engineering Design, 180 Ridge St., Ginter Springs, David Feinberg, and Dennis Bembo were present for the presentation. Mr. Reynolds stated that the developer is proposing to build moderately priced homes on this 5 acre site. Mr. Speer asked how many homes are proposing to be built. Mr. Reynolds said that it would be 28 units. Mr. Dennis Bembo, 324 Interlachan St., Winter Park, stated that the homes would be 1,200 to 1,400 square feet, single and two story, with one to two car garages. Mr. Dennison questioned the zero lot lines stating that the lots are small with a verb narrow road down the center. Mr. Bembo stated that the street would be standard size with curb and gutters. There will be 10 -foot setbacks between the houses. He stated that the developer is not locked into the zero lot line, but because the zero lot line was recommended by staff, it was submitted this way. Mr. Dennison asked if this project would be condominiums. Mr. Bembo stated that the 28 units. would be detached, single family homes with fee simple ownership and include a homeowner's association. Mr. Speer asked the price range of the homes. Mr. Bembo stated the homes would be between $70 and $90,000. Mr . Davis asked if there would be sanitary sewers, a grater system, fire hydrants, and the use of reclaimed water. Mr. Bembo stated "yes, and that the project would have sidewalks, curbs, and gutters ". Mr. Davis asked about the turn lanes on Upsala Road. Mr. Bembo stated that they will put in accel and decel lanes as required. Mr. Kevin Freer stated that he owns the piece of property adjacent to this request. He stated that he was concerned with the drainage as to which direction it would flow and questioned whether the oak trees at the back of this property would be effected. Mr. Dennison stated that a retention pond is shown to be on the north side of the property and that the Zoning ordinance would take care of trees. Mr. Reynolds explained that the inlets would catch the rainfall and would drain into the retention pond. Mr. Reynolds also explained that the trees within the buildable area and within MINUTES PLANNING AND ZONING COMMISSION MEETING OF JUNE 17, 1993 PAGE 2 the 24' of pavement would have to be removed. Trees on lots that do not fall within the buildable area would be saved. Mr. Bembo stated that any trees that could be saved would be saved. Mr. Freer stated that he has had his property surveyed several times and that there is a problem with the boundary lines. Mr. Reynolds stated that his client is currently having this property surveyed. Mr. Freer stated that there is a problem with section line also. He stated that the County has to designate where this section line is. Mr. Davis stated that if the property is smaller than what is presented, the developer would have to adjust the number of homes. Mr. Dennison stated that this was a survey problem and if this property turns out to be smaller than what was presented, the developer would have to adjust the number of homes. Alvin Lee, Jr. stated that he lives directly across the street from this project and that he is concerned with the density. He stated that it was too high for the surrounding neighborhood. He stated that every homeowner in the neighborhood has approximately 1 acre or more for each home. Mr. Lee stated that this would have an effect on his existence. He stated that the developer should be concerned for everyone in the area and keep the density as it is now. Mr. Lee also stated that the traffic will be affected. Mr. Speer made a motion to deny. Seconded by Mr. Dyal. Mr. Davis stated that the property is zoned now for 6 units per acre and asked why would it needed to be rezoned to PD. Mr. Marder stated that the land use designation is low density residential and in order to approach that density on this site it would be difficult to do with an SR-1 zoning classification which would provide for a 6,000 square foot lot. Mr. Davis asked what would happen if the developer wanted to put in apartments. Mr. Marder stated the present land use classification is for a detached, single family development. Mr. Davis asked what would be allowed if the existing zoning is kept. Mr. Marder stated that SRI -AA allows 10,000 square foot lots. He stated that the City annexed this property into the City and attached the equivalent county zoning classification. Mr. Brooks asked if Upsala Road was up for expansion. Mr. Marder stated "no", an increase of traffic was not anticipated. He stated that there was not a problem with traffic on any of the roads in the area. Mr. Dennison asked what happens when the Expressway goes through. Mr. Marder stated that Upsala Road would go under the Expressway. Mr. Speer stated that this Commission has not approved putting 28 homes on 5 acres of land anywhere in the City. The land is zoned for a particular purpose and asked why change it. Mr. Marder stated that today this is a typical development. Mr. Speer asked that this development be compared with the Sanford Avenue project and asked if this was the same. Mr. Marder stated "no, that development had requested variances to the property and was listed as affordable housing, as to this situation which appears to be a standard, traditional development. In favor of the motion was Mrs. welch, Mr. Speer, Mr. LeRoy, Mr. Davis, and Mr. Dennison. In opposition was Mr. Brooks, Mr. Dyal, and Mrs. Stairs. Motion carried. The next item on the Agenda was to hold a Public Hearing to consider a Conditional Use for property located at 2818 S. French Avenue in a GC -2, General commercial Zoning District, for a single family hours. owner: Estate of Sarah Krider; representative: David A. Stump. Bob Sander, 103 N. Elliott, Sanford, was present for representation and stated that he is the marketing director for Stenstrom- Stump. He stated that 20 is zoned SR--1, and 30' is zoned GC -2. He stated that they would like to build a single family home. Mr. Speer moved for approval. Seconded by Mrs. Stairs. All in favor. Motion carried. MINUTES PLANNING AND ZONING COMMISSION MEETING OF JUNE 17, 1993 PAGE 3 The next item on the Agenda was to hold a Public Hearing to consider a request for a Conditional Use for property located at the northeast quadrant of Oregon Avenue and Lowe Avenue in a AG, Agricultural Zoning District, for a soapbox derby racetrack /city park. owner: City of Sanford; representative: Mike Kirby. Mike Kirby, Director of Recreation and Parks and Director of the Soap Box Derby was present for representation. Mr. Leroy questioned the parking. Mr. Kirby stated that every bit of parking would be on -site, not on the street nor on anyone else's property. He stated that a permanent fence would be put up to keep people from wandering onto someone else's property. Mr. Kirby stated that the races Mould last only one day. Mr. LeRoy questioned the oil seepage from cars and asked how would this effect the wells. Mr. Davis stated that the wells are about 500 deep and would not be affected. Mr. Kirby stated that he had talked to the Utility Director and he did not have a problem with oil seepage. Mr. Davis asked if people would be out there everyday utilizing the picnic tables and volleyball courts. Mr. Kirby stated that it would be some time before these facilities would be put in. As funds become available these type facilities would be constructed. Mr. Kirby stated that there was no expense to the City for this park. Except for the races, the park would be closed until it is fully developed. Mr. Kirby stated that gates would be put in to discourage skateboarders and others. Allen Nettles, 2805 Oregon Avenue, stated that he was concerned with the traffic and with parking for this event. The only basis for estimating how many would attend this event is the past history and he f igurd it could amount to quite a bit of people. He stated that his grandfather owns the property contiguous to this wellfield and that he is concerned about people coming onto his property. Mr. Nettles stated that he had assurances from Mr. Kirby that a cyclone fence would be installed and that he would like for this to be a condition of the approval and also that all parkin g be contained on-site. He stated that he is concerned with the traffic and requested that there be a police officer present the day of the first race. Mr. Kirby stated that he did not have any problems with Mr. Nettles' requests. Mr. LeRoy moved on approval with the condition that a cyclone fence be constructed, that all parking is contained on -site, and that a police officer be present during the races. Seconded by Mr. Dyal. Mr. Speer opposed. Motion carried. The next item on the Agenda was the consideration of the Site Plan for the Oregon Avenue Park Soapbox; Derby Race Track, located at 1981 Lowe Avenue in an AG, Agricultural Zoning District. Owner: City of Sanford; representative: Mike Kirby. Mr. Davis stated that the site plan should show the fencing and the parking configuration. Mr. Speer asked if a sidewalk would be put in along Lowe Avenue. Mr. Marder stated that when the road is paved, the City would then put in sidewalks. Mr. LeRoy moved on approval with the condition that a fence be constructed and parking is contained on -site. Seconded, by Mr. Brooks. Mr. Dyal opposed. Motion carried. Mrs. Sonnenberg stated that Mrs. Welch, Ms. Holt - Miller, and Mr. Davis had been reappointed to the Board. She also noted that the Board members are requested to contact the Chairman or staff of any anticipated absences. Mr. Marder noted that the Commission would be receiving information regarding a change to the Land Development Regulations changing MINUTES PLANNING AND ZONING COMMISSION MEETING OF JUNE 17, 1993 PAGE 4 the request for a borrow pit from a conditional.use to a rezoning request so that all such requests would be reviewed by the City Commission. Mr. LeRoy commended Mrs. Stairs for a job well done as Acting Chairman for the past two meetings. Mrs. Stairs moved to approve the minutes as circulated. Mr. LeRoy seconded. All in favor. There being no further business, the meeting adjourned at 8:30 F.M. oe D qnnison, Chairman From the Director of Planning and Development/0� June 11, 1993 TO: City of Sanford Planning and Zoning Commission SUBJECT: Recommendations for Meeting of June 17, 1993 A. DAVID FEINBERG - Request to rezone from AR -1 AA, Single Family Residential to PD, Planned Development for property located on the east side of Upsala Road one half mile north of CR 46A. 1. Site is Zoned SR -1 AA, Single Family Residential, encompasses 4.9 acres and includes a small single family dwelling. 2. The City's Future Land Use Element of the Comprehensive Plan reflects a Low Density Residential designation for the property. Low Density Residential permits up to 6 dwelling units per acre. 3. The Pamala Oaks Master Plan proposes a total of 28 dwelling units on lots with a minimum 4,000 square feet. The gross density proposed is 5.69 dwelling units per acre. 4. Existing land uses in the immediate vicinity of site include a church and various single family dwellings located on tracts that appear to be larger than one acre per dwelling unit. Such uses are Zoned AG, Agriculture (city) and A- 1, Agricultural (county). 5. The Greeneway Expressway is proposed to be located immediately north of the site. The expressway will separate the site and surrounding area which is planned for residential land use with the area north of the expressway which is planned for commercial and industrial development. 6. Facilities and services such as road capacity, central water and central sewer are adequate and available. Drainage will need to comply with the City's established level of service. 7. Recommend that the request to rezone to PD, Planned Development be approved based on the information contained on the Pamala Oaks Master Plan, consistency of the proposed development with the Comprehensive Plan and the existing and anticipated character of the area. STENSTROM /STUMP CONSTRUCTION & DEVELOPMENT CORPORATION - Request conditional use approval to permit a single family dwelling on property Zoned GC -2, General Commercial. 1. Northerly portion of site is Zoned SR -1, Single Family Residential and the southerly portion of site is Zoned GC -2, General Commercial. Site includes approximately 7,600 square feet. 2. Sanford's Land Development Regulations requires conditional use approval to permit a single family dwelling in a GC -2, General Commercial Zone. 3. Existing land uses in vicinity of site include various single family dwellings Zoned SR -1. Also a sewage lift station and public tennis courts are located in vicinity of site. 4. The site is separated from developed portions of an established commercial area fronting U.S. Highway 17 & 92 by several hundred feet of undeveloped land that is heavily vegetated. 5. Recommend approval of the request to establish a single family dwelling in a GC -2, General Commercial Zone based on the existing single family residential character of the immediate area surrounding site. CITY OF SANFORD /MIKE KIRBY - Request conditional use approval to establish a noncommercial amusement facility (public park) for property Zoned AG, Agricultural located at the northeast corner of Hughey Street and Oregon Avenue. la. Site is Zoned AG, Agricultural, includes approximately 24 acres and is currently being utilized as a municipal wellfield for potable water supply. Various wells are located on the site which is otherwise vacant. An electrical power transmission line traverses the site in a north -south direction. 1 b. The City of Sanford proposes to utilize the site as a park with the major facility being a soap box derby track. 2. The Recreation and Open Space Element of the Comprehensive Plan anticipates that the City will eventually develop the Oregon Avenue wellfield site for use as a parks and recreation facility. 3. Adjacent land uses include vacant property Zoned AG, Agriculture (city) and A -1, Agricultural (county). Property Zoned PD to the east of site is approved for a single family residential subdivision. Other land in the area is designated for Medium Density Residential. 4. Recommend approval of the conditional use request to establish a noncommercial amusement facility based on the proposal's consistency with the Comprehensive Plan's Recreation and Open Space Element and general compatibility of such as use with anticipated development in the immediate area.
