The first item on the Agenda was to hold a Public Hearing to consider a Conditional Use for property located at 1320 S. Myrtle Avenue in an -, Multiple - Family Residential Zoning District for the purpose of a counseling center, church. Owner: Joseph Ponillo; representative: Rev. J, Fred Nilson. Rev. J. Fred Nilsen, 457 Elliott Avenue, stated that he has been on staff at Calvary Assembly and has been counseling ministry at least 1- years. He stated they have leased this home from Joe Ponillo. , on a temporary basis, for church use. A more permanent location is being looked into for church services. This facility will be an outreach for individual and marriage counseling. There will be no drug or alcoholic counseling. Rev. Nilsen stated that there is a dire need in the area for this type of counseling. Chairman Dennison asked what are the plans. Rev. Nilson stated that they plan a church where everyone could come on a temporary basis until a more permanent location is found. This facility will be a support group as well. Rev. Nilson stated that there is approximately 5 to 40 members and plans a full scale church. Mr. Keith asked if there are any plans of mating changes to the building or enlarging. Rev. Nilson started "no", that the church would be renting from the Ponzillos with no changes to the building ". Mr. Keith asked that when the church leaves the MINUTES PLANNING AND ZONING COMMISSION MEETING of JANUARY . 19 PAGE building, if it would revert back to a single family residence. Rev. Wilson stated "yes ". At present there is no one living in this house. He stated that the church would not occupy the house very long, approximately 6 months to a gear. Mrs. Stairs asked if they had investigated any other property in the area. Rev, Wilson stated that they have been looking around quite a bit. Mr. Brooks asked when will the church congregate. Rev Wilson stated that the would meet on Sundays and Wednesday with some counseling on other days. Mr. Dyal asked Staff to comment on its recommendation to deny. Mr. Marder stated that he had some of the same questions as were voiced. He will be standing by recommendation to deny due to the fact that this is a small site for a church. Mr. Joe Ponillo spoke in favor of the conditional use. He stated that he owns the property in question and also owns the house next door. He is a part of the church fellowship. He has discussed this use with neighbors and has found no dissention from any neighbors. Mr. Ponillo stated that this is a group of people who have come together with limited financial abilities as a group. This property allows the church to come together and at the same time to loop for some place more suitable. The budget aspect is insurmountable at this time. Mr, Keith moved on approval with no given time limit. Ms. Welch asked if the conditional use ran with the land. Mr. Marder stated that this is true, that there used to be some type of a time limit but this did not go into the new ordinance, Mr, Marder informed the Commission that it did have the ability to place reasonable restrictions on the use. Mrs. Welch asked if it would it be possible to limit the use to this group. Mr. Marder stated that there was no problem with this type of a condition. Ms. Ponillo reiterated that she and her husband would be renting to Open Door Ministries only. Mr. Speer asked if the conditional use runs with the land, and it is approved, and the church prospers and moves on, can the property go back to residential property. Mr. Marder stated that the land is still permitted for single or multiple family residential. It may not be appropriate to say that one person can do it and another person can't. Mr. Marder suggested to the Commission that it may be a good idea to mare it renewable at a time certain. Mr . Keith amended the motion that at the end of one year, the conditional use would need to be reneged. Seconded by Mr. LeRoy. Ms. Stairs opposed. Motion carried. The next item on the Agenda was to hold a Public Hearing to MINUTES PLANNING AND ZONING COMMISSION MEETING of JANUARY 2. 1992 PAGE J consider a conditional Use for property located at 730 Upsala Road in an AG, Agricultural Zoning District for the purpose of the use of the old white house on a temporary basis as an administrative building, Owner: Sanford Christian church, Inc.; representative: Ralph E. Dorn. Mr. Ralph E. Dorn, Sanford Christian Church, stated that they have been removed from the old property on Airport Blvd. because of the Expressway. Temporarily now they have two locations. The classroom and the sanctuary are in Zayre Plaza. He stated that they are requesting to use the old white ]name for the administrative ]wilding, for office purposes only. There will be two preachers with a part time secretary in this facility. There will not be any use full time or on weekends. This is a temporary office until the new sanctuary. is built on the same property. Mac] Lazenby is the civil engineer. Mr. Dorn stated that they expect to have plans designed for a new building within - weeps. They will get all permits and hopefully within three or four months will start building. New sanctuary will have a classroom and the possibility of new office space. John Lommersey, 541 Upsala Road, stated that he is totally in favor of the conditional use and is not in opposition to the temporary use. Bruce Preston, a member of the church, stated that they are requesting temporary use of this building for administrative offices only. Later, they plan on presenting the site plan and request for the correct zoning. Mr. Preston stated that there are approximately 160 members in attendance on Sunday mornings, Mrs. Stairs moved on approval of the conditional use. Seconded by Mr. Dyal. All in favor. Potion carried. The next item on the Agenda was the consideration of the site plan for a paring lot addition for Fairway Plaza, a shopping center use, located at 2690 Orlando Drive in a GC-2. General Commercial Zoning District. owner: Regency Square; representative: Fared ehf ar . Mr. Marder stated that the applicant did not submit his revised plan in time for appropriate review because there were so many corrections. There would not have been time to sufficiently review the revised plan. Mr, Marder su tabling this item until the 16th of January. Mr. Dyal roved to table. Seconded by Mr. LeRoy. All in favor. Seminole Blvd. ' in a SC-3 SC-3 Special Commercial District. Owner: Nanci yuronis; representative: Wesley Blount. Mr. Wes Blount, Blount Sykes and Associates, stated that he had met with Bill Simmons on the cross walk request. Mr. Blount stated that they had made all changes and corrections suggested by Mr, Simmons. Mrs. Stairs asked Who would be responsible for paying for the flashers. Mr. Sternberg stated that the Grand Romance will take care of cost of flashers. Mr. LeRoy asked if, regarding the small Romance, trucks would be parked in the no parking right -of -way when it became fully operational. Mr. Sternberg stated that there had been on -going work on the small Romance, the Police Department gave them 5 days to adhere to the parking regulations. Mr. Sternberg stated that the parking violations were temporary and are now being adhered to. Mr. Speer made motion to approve a resolution for right-of-way use of Seminole Blvd. and the far western portion of property over to their bulkhead by the Grand Romance Seconded by Mrs. welch. All in favor. Motion carried. Nancy yuronis stated that one other item that she wanted considered was the possibility of multiple liquor licenses at a single address. She stated that they do not have the current facilities on Seminole Blvd. to board and disembark. They would like to brine the small Romance over to the existing dock for loading and unloading. They offer food and drinks. City policies state there can only be one liquor license per a single address. They now have two vessels. Mr. Speer asked what is the problem with having two addresses for one building. Mr. Speer recommend approval of a resolution to Staff and City attorney that the Commission has objection to the building being divided into multiple addresses for business purposes. Seconded by Mrs. Stairs. Mr, Marder stated that it is really up to attorneys as to ]now it has to be handled procedurally. May need to have another conditional use. All in favor. Motion carried. Mrs, Stags asked if the sign for Mr. Black on 1st St. had been approved and stated that he has so many appliances on the porch. There being no further business, the meeting adjourned 8:00 P . M . Site is Zoned A G, Agricultural and appears to include two one- family dwellin and various out - buildings. Site includes approximately seven acres. Si age on the site indicates the intent to utilize the site for a church. 2. Land Uses adjacent to site include various one family dwellings and vacant land. 3. Recommend approval of request to utilize a dwelling for administrative offices related to the church based on existing character of the area a t the present time and intended use of site. REV. WILAO - Request conditional use permit to utilize a existing one - family dwellin for church and counseling center for property Zoned MR - 2, Multiple Family Residential located on the unrest side of Myrtle Avenue south of lest 13th Street. 1. Site is Zoned MR -2, Multiple Family Residential and includes a one - family dwelling. Site encompasses approximately 16,000 square feet or .38 acres. 2. Site is adjacent to existing R -2 Zoning which includes various one - family residences. Site is also adjacent to GC -2, General Commercial Zoning which includes a warehouse building and a one family dwelling. 3, Recommend denial of the request to establish a church and counseling center based on the existing one - family residential character of the street and the limited size of site in comparison to the land area necessary to establish a church.
