PLANNING AND ZONING COMMISSION
MEETING OF MAY 16, 1991

The first item on the Agenda was to hold a Public Hearing to
consider a request to Rezone from MR -2, Multiple Family
Residential, to that of RC -1, Restricted Commercial, property
located at 1212 West 6th Street.
Owner /representative: Leonard Williams.
Mr. Leonard Williams, 1212 W. 11th Street stated that he has had
this property for sale for some time (approximately 2 years) and
cannot get anyone to buy it unless it can be rezoned. The property
is located in front of Seminole Garden Apartments, and is hard to
sell. a real estate agent stated that a client said that if the
property was rezoned the client would buy it. The property behind
Mr. Williams' property is owned by the railroad.
Mr. Brooks asked if there are or were any industrial plants near
this piece of property and questioned whether one was Simplimatic
or not. Mr. Marder stated that he was correct and the property
that Simplimatic sits on is zoned industrial. Mr. Marder stated
that he would recommend denial of any commercial use in the area
because of adjacent residential use. Mr. Dennison asked what
Coastline did with their property. Mr. Marder stated that this was
mostly overgrown vacant land between the railroad tracks. Mr.
Williams stated that his piece of property is right behind the Auto
Train washer.

Ms. Stairs asked if Mr. Williams was requesting the rezoning
because of a possible buyer and if the real estate agent told him
what the buyer would be using the property for. Mr. Williams
stated "no, there is not a buyer at this moment. The property
won't sell as it is and this change is needed to sell."
Mr. LeRoy asked if the rezoning was approved would it be classified
as spot zoning. Mr. Marder stated that spot zoning would not be
used as a rationale to deny this rezoning. Mr. LeRoy asked what is
allowed under restricted commercial. Mrs. Sonnenberg stated retail
stores, small restaurants, buildings under 2400 square feet are
uses allowed. Small commercial uses, a store or an office, with no
auto use.
Rev. Bishop, Oviedo, stated that he has property and a church on
6th Street. He had wanted to know why Mr. Williams wanted the
property rezoned. Rev. Bishop understood that Mr. Williams wanted
the property rezoned so he can sell it; therefore he had no problem
with the rezoning request.
Mr. Brooks moved on approval. Seconded by Mr. Dyal. Mr. Keith
opposed. Motion carried.
The next item on the Agenda was to hold a Public Hearing to
consider a request for a Conditional Use for property located at
2507 S. Sanford Avenue in a GC -2, General Commercial Zoning
District for the purpose of an automobile and truck repair
business, (customizing), and change of use for a non - conforming
structure.
Owner /representative: Lakhan P. Singh.
Mr. Lakhan Singh, 233 S. Aberdeen, Sanford, stated that he would
like to customize automobiles by putting on spoilers, stripes, body
molding, and basic body work. Work would be done on the exterior
of the building, will be working in the back. The front will be
office used for office only. Vans would be the largest vehicles
serviced. Mr. Singh stated that he is buying the property. He
stated that he owns the service station adjacent to this property
and that the side of the service station will be used for traffic.
His hours of operation will be from 7 :00 to 7:00.
Ms. Stairs moved on approval subject to staff's recommendations
regarding improvements (all automotive repair and service shall
occur indoors or in the rear yard; the site shall be improved in a
manner that, to the maximum extent feasible, conforms to the City's
Land Development Regulations, especially with regards to landscape,
buffer and screening requirements) . Mrs. Sonnenberg related to the

Commission that if the use is approved, he will have to go through
site plan approval. Seconded by Mr. Brooks. Mr. LeRoy opposed.
Motion carried.
Mr. Marder handed out a computerized map of the City's land uses.
He noted that everyone is invited to come to the Historic Trust's
bar -be -cue at the Magnolia Mall on Friday.
Mr. Speer made a motion to approve the minutes as circulated.
Seconded by Mr. LeRoy. Motion carried.

SUBJECT: Planning Recommendations for Meeting of May 16, 1991
WILLIAMS - Request to rezone from MR -2, Multiple Family Residential to RC -1,
Restricted Commercial for property located on the south side of West Sixth Street east
of Olive Avenue.
1. Site is Zoned MR -2, Multiple Family Residential, contains approximately 20,650
square feet and is presently vacant
2. Adjacent land uses are Zoned MR -2 and include multiple family housing, railroad
tracks and a church.
3. A small store is located in an RC -1 Zone at the comer of Mangostine Avenue and
West 8th Street. This use is located approximately midpoint between First Street,
13th Street, Persimmons Avenue ar, , I French Avenue.
4. Recommend denial of the request for RC -1, Restricted Commercial Zoning based
on the existing residential character of the immediately adjacent area.
SINGH - Request conditional use approval to permit automobile and torch repair and
change of use for a nonconforming structure located on Sanford Avenue south of East
25th Street.
1. Site includes a continuous building front facing Sanford Avenue.
2. Site is adjacent to a gasoline service station at the comer of Sanford Avenue and
25th Street and a restuarant on the south side of the building.
3. Based on existing uses already established in the immediate area, recommend
approval of the request to permit automotive and truck repair and utilize a
nonconforming structure for said purpose subject to the following conditions and
stipulations:
a. All automotive repair and service shall occur indoors or in the rear yard.
b. The site shall be improved in a manner that, to the maximum extent
feasible, conforms to the City's Land Development Regulations, especially
with regards to landscape, buffer and screening requirements.
