PLANNING AND ZONING COMMISSION

The meeting was called to order at 7 :00 P.M. by Chairman Dennison.
The first item on the Agenda was a Public Hearing to consider the
request to rezone from MR -2 Multiple - family Residential District to
RC -1, Restricted Commercial District, property located at 2590
Sanford Avenue. Owner /representative: Virgil Gracey.
(Tabled September 6, 1990).
Mr. Brooks made a motion to remove from the table. Seconded by Mr.
Keith. All in favor. Motion carried.
Due to lack of representation, Mr. Keith moved to table. Seconded
by Ms. Stairs. All in favor. Motion carried.
The next item on the Agenda was a Public Hearing to consider the
request to rezone from AG, Agriculture District to GC -2, General
Commercial District, property located in the 1100 block of Lake
Mary Boulevard. Owner /representative: James C. Crews.
Mr. James C. Crews stated that he has had this property for over 20
years. There are 10 acres along Lake Mary Blvd. This property is
basically filled in and would like to sell cars. Cars could be put
on filled in land without a building. Mr. Crews stated that his
daughter and son would work with him.

Mr. Crews stated that RC -1 zoning would not suit his purpose. A
clean paved car lot could go in on the filled in area. This
property is basically stable, but was filled in with land clearing
material about 15 years ago. The filling was done in an L shape.
There is a muck lake in the back. No soil samples have been taken.
The entire area is hard on top.
Mr. Crews stated that there is a power sub - station on one side, a
Kindercare next door, and houses on Art Lane.
Ms. Stairs requested more information about what could be done on
filled land regarding restrictions, soil samples, and engineering
design. Mr. Simmons stated that there are a lot of possibilities,
but would need some engineering. Recreation uses are possible but
would not suit his purposes. There are piling and certain types of
foundations that could be used. Mr. Simmons stated that he has not
seen enough to be convinced that a car lot is the only use.
Chairman Dennison stated that Restricted Commercial would enhance
the property and that Mr. Crews needed to figure some way to have
a small building and to park cars. Mr. Crews stated that on the
back of the property there is an acre of high land. If he could
develop behind the high area, he could possibly put cars on the
back.
There was no one else present to speak in favor of or against the
requested rezoning.
Mr. Keith moved to deny the request for GC -2 zoning. Ms. Stairs
seconded. All in favor. Motion carried. Mr. Keith moved to
recommend approval of RC -1 zoning, Mr. Brooks seconded. All in
favor. Motion carried.
The next item on the Agenda was the consideration of a request for
an extension to the site plan approval for Quik Trip, a retail
sales and service use, convenience store with gasoline sales,
located at 1301 W. 25th Street in a GC -2 General Commercial
District. Owner: Braxton Jones; representative: Kay Shoemaker.
(Approved January 4, 1990).
Mr. Billy Brumley stated that he was representing Mr. Braxton
Jones, owner of property, and that he had received site plan
approval in January which has expired. Mr. Brumley stated that he
needed to have the site plan reinstated. There have been no
changes to the plan.
Mrs. Sonnenberg read into the records Staff's recommendations which
included a 6' high masonry wall and a kiosk for school children.

Mr. Brumley is to come back with a proposal for the kiosk.
Mr. Leroy moved to extend the site plan approval. Seconded by Mr.
Brooks. All in favor. Motion carried.
The next item on the Agenda was the consideration of the request
for site plan approval for a propane dispenser use with an
underground tank (sales of propane gas) for Drivers Oil, a retail
sales and service use, convenience store with gasoline sales,
located at 2543 French Avenue in a GC -2 General Commercial
District. Owner: Bob Gentry; representative: Jose Velasquez.
Jose Velasquez read Staff's recommendation into the record. He
stated that the depth of the tank would be approximately 6'
underground.
Mr. Brooks asked why so many uses? Mr. Velasquez stated that they
did not sell a lot of gas, the small store did not have much
traffic, and that they needed an extra income to stay in business.
Mr. Brooks moved on approval. Mr. Leroy seconded. All in favor.
Motion carried.
Mr. Simmons reported that it is anticipated that City Commission
will award a construction contract over Smith Canal to connect the
two sides of Central Park Drive through NorthStar Business Park and
Sanford Central Park from Upsala and W 1st. Street.
Mr. Simmons also stated that he had received a garbled request for
some motorcycle games at the southwest quadrant of Jewett Lane and
Kennel Road. Time was not available for a Conditional Use request
or even City Commission approval. There was strong appeal from the
Police Department in which the City Commission has concurred. An
advertisement went out throughout the State before the City
realized what was happening.
Mr. Brooks reported that on 1st Street at First Federal it is hard
to see when parked diagonally and backing out and asked if it was
the best that could be done and if more spaces could be provided.
Mr. Simmons stated that 30 degrees is the best for angular parking.
Mr. Leroy reported that at Food Plus containers and cardboard had
been left in the rear which had deteriorated.
Mr. Brooks moved on approval of the minutes. Mr. LeRoy seconded.
All in favor. Motion carried.

SUBJECT. Planning Recommendations for Meeting of September 20, 1990
7. GRACEY - Request to rezone from MR -2, Multiple Family Residential to RC -1, Restricted
Commercial for property located on the east side of Sanford Avenue north of East 26th
Street
1. Site is Zoned MR -2, Multiple Family Residential and includes and one - family
residence located on two lots.
2. Site is adjacent to existing RC -1 Zone which Includes residential and commercial
uses. Site is also adjacent to various one - family dwellings Zoned MR -1, Multiple
Family Residential.
3. Recommend approval of request to rezone to RC -1, Restricted Commercial
based on City policy to approve RC -1 Zoning in the immediate area and existing
RC -1 Zoning already established adjacent to site.
NOTE. This recommendation was submitted to the Planning and Zoning
Commission on September 6, 1990. The Planning and Zoning Commission
tabled the request.
2. CREWS - Request to rezone from AG, Agricultural to GC -2, General Commercial for
property located on the north side of Lake Mary Boulevard and west of Art Lane.
1. Site is Zoned AG, Agricultural and is basically vacant at the present time. The St.
Johns River Water Management District Wetlands Maps classify a majority of site
as wetland vegetation. The Federal Emergency Management Administration
(FEMA) maps show a majority of site within the 100 Year Flood Zone. Portions
of site appears to have been filled. Compliance with Schedule M,
Environmentally Sensitive Lands requirements in the LDR will determine the
development potential of site.
2. Adjacent uses include a day care center and a neighborhood shopping center
Zoned RC -1, Restricted Commercial, various single family dwellings and vacant
land Zoned AG, Agricultural plus a power substation Zoned AG.
3. Pursuant to recent annexation, site is presently underagoing a comprehensive plan
amendment from Conservation and Low Density Residential in the County plan
to Resource Protection and Neighborhood in the City. The Neighborhood plan
designation permits small -scale commercial uses oriented towards the
immediately surrounding area. The request for GC -2, General Commercial Zoning
is inconsistent with the proposed Neighborhood planning designation.
4. Recommend approval of RC -1, Restricted Commercial rather than GC -2, General
Commercial based on the City's established policy of permitting neighborhood -
oriented commercial activities rather than general and automobile- oriented
commercial business in the immediate area plus consistency of the RC -1,
Restricted Commercial Zone with proposed Comprehensive Plan designation.
Rezoning of this site is contingent upon adoption , of the City's Second
Comprehensive Plan Amendment of 1990.
