PLANNING AND ZONING COMMISSION

The meeting was called to order at 7:00 P.M. by Chairman Malone.
The first item on the agenda was to hold a Public Hearing to
consider the request to Rezone from AG Agriculture to RI -1,
Restricted Industrial that property located at South side of 5th
Street between Kennel Road and Meisch Road.
Owner/ representative: Howard E. Lay and Herbert Stenstrom, Trustee
Mr. Howard Lay, 195 Lakeside Drive, stated that they have been
located in the Sanford Airport for 20 years and would like to
expand because they need more room. Probably would employ about 75
people within this auto parts distribution company. Mr. Lay stated
that DER visits the site from time to time regarding solvents being
stored and possibly leaking into the ground.
Mr. Morris moved to approve the rezoning. Seconded by Mr. Keith.
All in favor. Motion carried.
The next item on the agenda was the consideration of the Final Plat
for Exxon 4 -0154 a 3 Lot Commercial Subdivision located at the N.E.
corner of the intersection of Orlando Drive and Lake Mary Boulevard
in a GC -2 zone. Owner: Exxon Company U.S.A. Rep: John J. Sexton.
Mr. Gene Duffy, Duffy & Harvey, Planning Consultants was present
for representation. Mr. Morris asked if the access easement for
Lot 2, off Lake Mary Blvd., will be a joint access for Lots 3 and
1 also. Mr. Duffy stated "yes, this is the intent ".

Mr. Keith move on approval of the Final Plat. Seconded by Mr.
Dyal. All in favor. Motion carried.
The next item on the agenda was the consideration the site plan for
the second phase of Lucky Auto Sales, a Used Automobile Sales lot
located at 417 E. 3rd Street in a GC -2 zone. Owner: Lucky
Investments, Inc.; Rep: Sadie M. Gazil.
Mr. Dyal moved to table consideration due to lack of
representation. Mr. Keith seconded. All in favor. Motion
carried.
The next item on the agenda was the consideration of the site plan
for a Detached Sign for Park Avenue Promenade, a Retail Sales and
Service Use located at 2465 -2471, Park Avenue in a GC -2 zone.
Owner /representative: Steve Hardin.
Mr. Dennison moved to table due to lack of representation.
Seconded by Mr. Keith. All in favor. Motion carried.
On the Addendum to the Agenda was the consideration of an extension
of the approval of the site /engineering plan for Commerce Plaza, an
office /warehouse use located at 1565 -1599 Airport Boulevard in a
RI -1 zone. Owner: Robert E. McKee; representative: Robert Von
Herbulis.
Mr. Bob VonHerbulis of McKee Development stated that the bank has
required 500 of this building to be leased before the loan is
approved. They would like to start construction within the next 60
to 90 days.
Mr. Morris asked if McKee had the required number of leases in
place now. Mr. VonHerbulis said "no ", but that they anticipate
leases to be in place within the next 60 days.
Mr. Dennison moved on approval for a 6- months extension. Seconded
by Mr. Brooks. All in favor. Motion carried.
Mr. Keith moved on approval of the minutes. Seconded by Mr.
Brooks. All in favor. Motion carried.

SUBJECT: Planning Recommendations for Meeting of January 18, 1990
CITY
LAY /STENSTROM - Request to rezone for AG, Agricultural to RI -1, Industrial for
property located on the south side of 5th Street between Kennel Road and Meisch
Road.
1. Site is Zoned AG, Agricultural and is basically vacant at the present time.
2. Area adjacent to site is generally vacant at the present time and is Zoned
RI -1, Industrial. Various one - family dwellings are located in vicinity of site
in area Zoned A -1, Agriculture in the unincorporated area.
3. The Future Land Use Concept map of the Future Land Use Element of the
Comprehensive Plan is presently in the process of being amended for the
area in question to a Regional Commerce land use designation. Such a
designation is consistent with the requested RI -1 Zone for the West State
Road 46 area. In general, the Comprehensive Plan anticipated facilities and
services in conjunction with nonresidential development in this area.
4. Recommend that request to rezone to RI -1, Restricted Industrial be
approved based on consistency with the Future Land Use Element and
similarity with zoning designations already established in the immediate area.
