PLANNING AND ZONING COMMISSION
MEETING OF JANUARY 4, 1990

The first item on the agenda was a Public Hearing to consider a
Conditional Use for property located at South of S.R. 46, East of
Upsala Road and North of Northstar Business Park Phase II lots
3,8,13,14 of Northstar Business Park Phase I and lot 19 of M. M.
Smith Subdivision for the purpose of indoor hazardous and non-
hazardous warehouse storage in a GC -2 zone. Owner: Northstar Bus.
Park Ltd., Thomas L. Oyler and Leo Trepanier and William S.
Stoller, Northstar 1 Ltd.; representative: William Stoller.
Mr. William Stoller, 3821 W. SR 46, representing Northstar Business
Park stated that they are developing the Business Park with 14
lots, with two different zoning classifications, RI -1 and GC -2.
The majority of the market will have some sales and warehousing.
Rather than come in with each individual conditional use, Mr.
Stoller wanted to get the approval for all of the area zoned GC -2
allowing for warehouses at one time.
Mr. Malone asked why they were not requesting a rezone from GC -2 to
RI -1?
Mr. Stoller said because with lots having frontage on a minor
collector road, there will be some retail and he would have to come
back for retail with RI -1.

Present to speak in opposition was Mr. Richard Hall, Winter Park.
He stated he owns property in the area and was opposed because it
would be a big buildup of hazardous waste . He felt they could have
picked a better place to put this park than where people live.
Mr. Stoller stated that any cleaning products are hazardous, any
type of paints, any metal, etc are hazardous in todays world. They
may never use the hazardous storage.
Chairman Malone stated that there were no specific plans at this
time.
Ms. Juna Jones was present to speak in opposition on behalf of her
mother.
Mr. Carlton, 2505 Georgia Avenue, asked what were the specifics
that might be stored there.
Chairman Malone stated that until Mr. Stoller comes up with a
business that wants to buy this property, he cannot answer you.
Mr. Stoller stated that one business, a Machine Contractor, deals
with freon, a hazardous material, which is found in your air
conditioners.
O.W. Hall, Winter Park, property owner in the area, stated that
hazardous materials could be nuclear energy. Developers are trying
to ruin 46. This use would ruin our property.
Mr. Morris stated that what Mr. Stoller was asking for was not that
unreasonable for the activity of this community. Mr. Morris
requested an administrative review of anything coming in. Mr.
Morris moved on approval subject to an administrative review and
appeal of businesses coming into the park. Seconded by Mr. Brooks.
Chairman Malone asked if this would apply to each and every lease.
Mr. Morris stated that if the lessee had any business that an
administrative review could not settle, then it would be referred
to P &Z for settlement. Mr. M lone asked if the zoning ordinance
differentiated between hazardous material and hazardous waste. Mr.
Marder stated that it differentiated in terms of the activity. Mr.
Malone asked if they could, in fact, add to the conditional use a
prohibition of the manufacturing of hazardous waste. Mr. Morris
stated that under restrictive industrial use they can't have it in
a GC -2. Mr. Morris stated that the motion was to protect the
community yet allow the developer to have more appeal for buyers.
Mr. Stoller stated that the lease would prohibit any type of
manufacturing for hazardous uses. Mr. Simmons stated that this

particular development is installing a sewer system which will be
the first sewer system in this area. Septic tanks pose the
greatest threat to wells. The sewer system is a significant
contribution to protecting groundwater in this area. All in favor.
Motion carried.
The next item on the agenda was a Public Hearing to consider a
Conditional Use for property located at South of C.R. 45A between
Georgia Avenue and Hartwell Avenue, at 1301 W. 25th Street, for the
purpose of automobile and truck service to allow the retail sales
of gasoline, lubricating oils, and minor automotive accessories, in
a RC -1, Restricted Commercial Zoning District.
Owner /Representative: Mr. Braxton Jones.
Braxton Jones, Ocala, stated that they would like to operate a
convenience store. There will be sales of oil, inside the store
only; no sale of kerosene, just straight gasoline.
Present to speak in opposition was Ms. Jane Porter, 2118 Park
Avenue. She stated that she owns property at 2507 Georgia Avenue.
She was concerned with the high residential density and gasoline
sales in this area. Also, she was concerned with traffic turning
off of Georgia Avenue into this station. If the use passed, she
wanted a block wall between property owners and store owners.
Also present to speak in opposition was Louis Carrero. He stated
that this was a school area with a bus stop within 10 -feet. He
objected to the store being this close to his house.
Mr. Dyal moved on approval. Seconded by Mr. Dennison.
During discussion, Mr. Morris stated that he agreed with the
request for the concrete wall along the rear of the building and
asked if the proponents would consider taking one half of the
entrance way off of Georgia Avenue and putting in kiosk for the
kids to waiting for the school bus. All in favor. Motion carried.
The next item on the agenda was the consideration of the
site/ engineering plans for Quik Trip, a convenience store with
gasoline sales located at 1301 W. 25th Street in a RC -1 zone.
Owner: Braxton Jones; representative: J. Michael Davis.
Mr. Mike Davis, Conklin, Porter & Homes was present for
representation. Mr. Jones stated that he would be agreeable to
putting in a kiosk and had no objection to a masonry wall with
vegetation on the front and on the back. Mike Davis stated that
entrances and exits will be off Hartwell and Georgia Avenues. Mr.
Morris stated the building will be very attractive in appearance;

it has shingle roof with a stucco front.
Mr. Dennison moved on approval with the block wall and a kiosk for
the children. Seconded by Mr. Dyal. All in favor. Motion
carried.
The next item on the agenda was the consideration of the site plan
for Northstar Business Park, Lot 13, a wholesale and warehouse use
located at 401 Central Park Drive in a GC -2 zone. Owner: NSTAR 1
Ltd.; representative: William Stoller.
Mr. Stoller states that the landscape plans did not get to Staff
until that afternoon. The first tenant will be a candy company.
Mr. Simmons stated the second fire hydrant location is not shown,
and the street lights being provided under the developers plat are
not shown.
Mr. Simmons stated that the cross access easement issue, would
require the first developer to install a driveway totally within
his property and, at the same time to donate the cross access
easement becoming effective only when the other property owner
donated the cross access easement at his property line. Mr.
Simmons stated that he is satisfied with what was proposed as to
the cross access easement issue. This particular roadway may over
time, become a through street.
Mr. Stoller stated that the water main for the second fire hydrant
had not been installed as of yet.
Mr. Stoller stated that there are 44 regular parking spaces and 2
handicap spaces.
Mr. Brooks moved on approval subject to staff's recommendations.
Seconded by Mr. Dyal. All in favor. Motion carried.
Mr. Morris stated that over the overpass on 46, there was a large
trailer parked on the road next to the auction property. He asked
if the sign on the trailer, regarding cruises, met the sign
ordinance.
Mr. Simmons stated the property is in the County until Monday
night.
Chairman Malone stated that Ms. Yates had tendered her resignation
from the Board and would be with the commission until a replacement
comes on board.

SUBJECT: Planning Recommendations for Meeting of January 4, 1990
JONES - Request for conditional use approval to permit gasoline sales in an RC-
1, Restricted Commercial Zone located on the south side of 25th Street between
Georgia and Hartwell Avenue.
1. Site fronts an arterial roadway and is basically vacant at the present time.
2. Site is adjacent to multiple family dwellings located in MR -2 and MR -3
Multiple Family Residential Zones. Site is also adjacent to a City park.
3. Recommend approval of request for gasoline sales and retail sales of minor
automotive accessories based on the existing character of the area at the
present time.
NORTHSTAR BUSINESS PARK LTD - Request for conditional use approval to
permit indoor hazardous and non - hazardous warehouse storage activities in a GC-
2, General Commercial Zone located in the Northstar Business Park on the south
side of State Road 46 West.
1. Site includes vacant land and an existing wholesale nursery establishment.
Various streets are under construction at the date of this writing.
2. Uses adjacent to site include a manufacturing facility located in an existing
RI -1, Restricted Industrial Zone and vacant land. Various one family
dwellings are located in general vicinity of site in unincorporated area Zoned
A -1, Agricultural.
3. Recommend approval of request for indoor warehouse and storage activities
based on similarity of requested uses with uses established in adjacent
RI -1, Restricted Industrial Zone and general character of immediate area at
the present time.
