City Commission Chambers Members Present: Tom Speer Eddie Keith Jay Malone Oletta Yates Ben Dyal Joe Dennison John Morris Leon Brooks Members Absent: John LeRoy Others Present: Jay Marder, City Planner Bettie Sonnenberg, Principal Deputy Administrative Official Marion Anderson, Recording Secretary The meeting was called to order at 7:00 P.M. by Chairman Malone. The first item on the agenda was a Public Hearing to consider a request for a Rezone from AG to MR -1, that property located at 2330 Narcissus Avenue. Owners /representatives: James K. & Joyce C. Lathan. Mr. Jim Lathan, 2330 Narcissus, stated that he wishes to rezone in keeping with the rest of the area and to develop a quadraplex in later years. Mr. Lathan felt there would be no detriment to the community in rezoning this piece of property. There was no one else present to speak in favor of or against the requested rezoning. Mr. Keith moved on approval. Seconded by Mr. Morris. Mr. Morris asked if Mr. Lathan had been advised to the possible necessities for the street improvements should he determine that he wants to go ahead and put in a quadraplex. Mrs. Sonnenberg stated "no, that this is a Seminole County road ". Mr. Morris asked Mr. Lathan if he would be coming in off of Terwilliger or the other end. Mr. Lathan stated from the other end, the west side. Mr. Morris suggested that as this area develops, Staff may want to advise the applicants of the necessity for street improvements. There being no further discussion, all in favor of the motion. Motion carried. MINUTES PLANNING AND ZONING COMMISSION Meeting of July 20, 1989 Page 2 The next item on the agenda was a Public Hearing to consider a request for a Conditional Use for the purpose of two bay, closed service station, automobile sales facility with very light service (repair), that property located at 818 French Avenue, in a GC -2 zone. Owner: Richard Fornell; representative: Eileen Montalvo. Mr. John Polacek, Apopka, stated that he is with Emerson Realty representing the applicant. The property is an old style service station and the applicant would like to sell used cars at this location. The applicant's intention is for car sales rather than any type of repair. He intends to detail and to do minor repairs. There will be no painting or welding. The sale of this property is contingent upon the rezoning. There was no one else to speak for or against the requested Conditional Use. Mr. Morris moved on approval of the conditional use. Mr. Dennison seconded. All in favor. Motion carried. The next item on the agenda was the consideration of the Site Plan for a detached sign for Spencer Pest Control, a commercial service located at 2562 Park Drive in a GC -2 zone. (Tabled 7/6/89). Owner: Bill Spencer; representative: Lewis E. Smith. Mr. Morris made a motion to remove from table. Seconded by Mr. Brooks. All in favor. Motion carried. Due to lack of representation for the second time, Mr. Morris moved that the site plan be denied. Seconded by Mr. Keith. All in favor. Mr. Speer opposed. Motion carried. The next item on the agenda was the consideration of the Site Plan for a detached sign for Drivers Oil Company, an automotive service station located at 2543 French Avenue in a GC -2 zone. Owner /representative: Alma Velazquez. Alma Velazquez, 90 Hidden Lake Drive, stated that she was representing her husband. Mr. Morris asked the total height of the sign. Mrs. Velazquez stated that the pole is 9 -feet and the sign is 5'x9', with the bottom of the sign being 15 -feet off the ground. Mrs. Sonnenberg stated that they are reducing the square footage of what was there. They are in compliance with the setbacks and overhangs are allright. They have agreed to put in landscaping in an area on the side. Mrs. Velazquez stated that the lettering will include the specials that are in the store. Mr. Dennison and Mr. Brooks moved on approval of the site plan. Seconded by Mr. Keith. All in favor. Motion carried. MINUTES PLANNING AND ZONING COMMISSION Meeting of July 20, 1989 Page 3 On the ;Addendum to the Agenda was the consideration of the Site Plan for a change of use to a retail sales use in an existing buildin' for The Fashion Explosion located at 1300 West 13th Street in a GCS -2 zone.' Owner: Mrs. Delores Anderson, representative: Cynthia Hillery. Mrs. Sonnenberg stated that she had misled the applicant in telling her what time to be here since she did not expect the Commission to finish so quickly. Mrs. Sonnenberg stated that it is a change of use for an existing structure. This used to be an old laundry on the corner of Olive and W. 13th Street and has been vacant for quite a while. A taxi dispatch stand was approved for this location about a year ago and is no longer there. In the old laundry area, the applicant wishes to have a small retail clothing store. The parking is paved and the Engineering Technician recommends they put in bumper stops. Mr. Morris moved on approval of the Site Plan. Mr. Speer seconded. All in favor. Motion carried. Mr. Morris asked about the truck traffic on Mellonville Avenue. Mr. Marder stated that some paper work has been passed but nothing definitive as of yet. It is still on a City Staff level and the County has not been notified yet. Mr. Keith stated that in front of Hampton Gardens there are newspaper machines on both sides of the sidewalk and asked if something could be done. Mr. Malone stated that the last time this issue was brought up, the City Attorney felt that this is freedom of the press. If the billboard is a signage problem we would request that Staff check into this. Mrs. Sonnenberg is to check. Mrs. Sonnenberg stated that regarding the car business at 25th and Sanford Avenue, the owner felt that he was not expanding his use. A letter has been sent to him stating that he needs to come forward with a site plan. Mrs. Sonnenberg stated that Budget Car Rental has been given to Code Enforcement for an officer to reinspect. Mr. Malone stated that this only happens at certain times and requested Staff ask the owner to stop. Mr. Morris moved on approval of the minutes. Seconded by Mr. Brooks. All in favor. Site is Zoned AG, Agricultural, contains a one family dwelling and covers approximately 32,670 square feet. 2. Site is adjacent to an existing MR -3, Multiple Family Zoning District which contains various two- and three -story multiple family dwellings. MR -3 Zoning provides for a maximum density of 20 dwelling units per acre. The requested MR -1 Zone provides for a maxim density of 8 dwelling units per acre. 3. Site is adjacent to an existing MI -2, Medium Industrial Zoning District which is basically vacant at the present time. 4. Site is also adjacent to various one - family dwellings which are agriculturally zoned in the unincorporated area adjacent to Sanford. 5. Recommend that the request to rezone to MR -1, Multiple Family Residential be approved based on the similarity of adjacent zoning and land uses as well as the existing character of the area at the present time . MONTALVAO - Request condition use approval to establish automobile sales with minor repair for property Zoned GC -2, General Commercial located at the northwest corner of French Avenue and 9th Street. 1. Site includes a vacant automobile service station and covers approximately 16,263 square feet. 2. Various retail sales and service uses, an auto repair establishment and the Police Station are located adjacent to the site in an area Zoned GC -2. 3. Recommend approval of conditional use request for automobile sales with minor service based on similar auto - oriented uses already established in the immediate area.
