Members Present: Eddie Keith Leon Brooks Tom Speer Brent Carli Jay Malone Joe Dennison John Morris John LeRoy Gary Davidson Others Present: Jay Marder, City Planner Bettie Sonnenberg, Zoning and Arbor Inspector The meeting was called to order at 7 :00 P.M. by Chairman Morris. The first item on the agenda was a Public Hearing to consider a request to rezone from. MR -2 to GC -2 for the purpose of commercial use, that property located South of Seminole Centre and East of Gregory Mobile Homes. Owner: Seminole County School Board; representative: Ned N. Julian, Attorney. Mr. Carli moved to table due to lack of representation. Mr. Keith seconded. All in favor. Motion carried. The next item on the agenda was a Public Hearing to consider a request to rezone from AD to GC -2 for the purpose of an automotive center, that property located as the south side of Highway 46 west of Kennel Road. Owner /representative: Dwaine R. Klein. Ms. Barbara Coleman, 121 W. Hillcrest Street, Altamonte Springs, stated that Mr. Gabbai is out of town and Mr. Klein could not be reached. The plan is for an auto center with light auto repair work. Ms. Coleman stated that there will be different spaces for lease to different individuals, all automotive related. Mr. Carli moved on denial. Mr. Davidson seconded. Mr. Malone stated that this is a main corridor to the I -4 interchange. Hopefully, we would put some type of pro- fessional building or build that area up with a little bit higher than junk yards and used car lots. Mr. Carli stated that there are plans out there of hopefully having a major hotel /motel chain in that area, or a highrise perhaps. Mr. Brooks stated that since there are churches in that area, he would think the churches would be more agreeable to the automotive center than to a hotel because the auto center would not be open on Sundays when the churches held their services. Eight were in favor of the motion, Mr. Brooks in opposition. Motion carried. MINUTES Planning and Zoning Commission April 21, 1988 page 2 The next item on the agenda was the consideration of the site plan for Dr. Murphy and Vaughn Veterinary Clinic, a veterinary office located at 2620 Orlando Drive in a GC -2 zone. Owners /representa - tives: J. Brannen Murphy and Joseph W. Vaughn, III, D.V.M. Dr. Brandon Murphy, 165 Leslie Lane, Lake Mary, stated that the property is vacant and is where the old Pinetree Inn use to be. Mrs. Sonnenberg stated that staff recommends approval subject to DOT permit and curb cut approvals. Dr. Murphy stated that it would be strictly for small animals. There will be indoor runs with tem- perature controls. Mr. Malone moved on approval. Seconded by Mr. Carli. All in favor. Notion carried. The next item on the agenda was the consideration of the site plan for Sandefur Properties Office, an office use located at 806 East 25th Street in a RMOI zone. Owner: Michael C. & Debra J. Tillis; representative: Leonard Feinberg. Mr. Leonard Feinberg, 1133 Louisiana Avenue, Winter Park stated that he is the architect for the project. Mr. Marder stated that there need to be standard 10x20 parking spaces, otherwise staff recommends approval. Mr. Feinberg stated that they are aware of the parking spaces and the spaces will be adjusted. This structure is a concrete block residence with a screened porch, flat roof and a flat roof car porch that has been enclosed. No structural testing has been done, but there are no cracks or settlement. The flat roof will have new trusses put on and will re- roof the existing roof. Mr. Carli moved on approval. Seconded by Mr. Keith. All in favor. Notion carried. The next item on the agenda was the consideration of the Sanford Auto Salvage - Storage Facility, a salvage storage lot located at the northwest corner of the intersection of Albright Road and Airport Boulevard in a Mi -2 zone. Owner: David Redwine; representative: Kim Townsend. Mr. Townsend, Engineering Services, 601 E. 25th Street, stated that this is an addi- tion to the north of the existing lot. On January 7 approval for a conditonal use was granted. At that time conditions were requested to be done to insure that the new lot would be the same. They feel now that they have a plan that satisfies the needs of staff, the Commission and the owner. The shells of vehicles are stored, then crushed. Storage will be off ground with no petroleum storage. A fence will be put in with same landscaping. No structures are involved. Mr. Marder stated that staff recommends approval. Mr. Townsend stated that they have approval from the County to cross the abandoned railroad and spur. Mr. Dennison moved on approval. Mr. LeRoy seconded. All in favor. Notion carried. The next item on the agenda was the consideration of the preliminary plat for Seminole Commerce Park, an eleven industrial lot subdivision located at 501 W. 5th Street in a RI -1 zone. Owner: Stuart Klapper; representative: Harry Reynolds. MINUTES Planning and Zoning Commission April 21, 1988 Page 3 Mr. Marder stated that this is basically a conceptual lot layout because the engi- neering questions have not been answered at this time. Staff recommended approval subject to engineering questions being answered. Mr. Marder also stated that there is to be an easement to maintain either side of the creek plus an outfall to the creek. Mr. Reynolds stated that a 25'easement from the top of the bank would be given for maintenance. Mr. Reynolds stated that he has a problem with the left turn lane and the striping going to the railroad tracts on Persimmon Avenue; this will have to resolved. DOT requirements a decel lane and the railroad tracts cannot be impeded. Approved by consensus the lot layout for Seminole Commerce Park. The next item on the agenda was the consideration of the site plan for a temporary office trailer use for Oyler Brothers Company, a landscaping contractor located East of Upsala Road and North of Metal Manufacturing Company in Block 19 of M.M. Smith's Subdivision in a CC -2 zone. Owner: Oyler Brothers Company; representative: Walt Freeman. Mr. Freeman, 1930 Silver Star Road, Orlando, stated that they have a trailer that they would like to move onto the site temporarily. They are asking to have the trailer there for 6- months. They probably will build one building but this is still being studied. This will be a metal building that could be built in 3 to 4 months. Mrs. Sonnenberg stated that recommendations from Mr. Simmons is that the Commission approve it for one -year because there are other considerations involved in this. They are negotiating for an entrance way on 46 and he feels that it might take longer than 6-months. Mr. Freeman stated that they will not start construction before they receive the entrance way permits. This site would be used to stage the crews in the morning for the landscape business. Plant and container material will be stored on -site. There will not be an office. Chairman Morris asked Mr. Freeman if what he was asking for is for a temporary per- mit to put a trailer back there, fence the property, store some materials, have employees report there in the mornings so you can then send them out to their jobs. He also asked if they wanted the employees to crane down that little dirt road off of Upsala back to your property? Mr. Freeman stated that this was correct. There will be approximately 14 employees. Their automobiles will be left on site with the employees taking company vehicles. They will have a temporary parking lot on -site. The company vehicles will be left there overnight. There will be port -o -lets. Mr. Speer moved to approve for 6- months, not renewable. Seconded by Mr. Keith. All in favor, Mr. Carli opposed. Motion carried. Mrs. Sonnenberg stated that staff approved a small addition to the rear of Dr. Bellhorn's. Cardinal Industries' small storage facility in front and San Antonio Rose Cafe, 1008 French Avenue modified the parking and additional landscaping. The deteriorated paving in the alley will be checked. Mr. Malone stated that on the automobile alley on 17 -92 is bursting at the seam. Particularly the new site plan that was approved for Avis. They are between 17 -92 and the hedges with automobiles. Also Seminole Ford and others. Mrs. Sonnenberg to check on this. MINUTES Planning and Zoning Cormtission April 21, 1988 Page 4 Mr. LeRoy asked if we authorized two entrances into Tropic Park off of 17 -92. Mrs. Sonnenberg stated that there is one main entrance but there could be three. There are four lots fronting the highway, two on either side of the main entrance. The two pairs of lots, on the lot lines have an entrance that they can get in and out of. Mr. Malone questioned 301 Park Avenue as to the parking lot and a care taker with 10 kids. Marder, City Planner DATE: April 14, 1988 SUBJECT: Planning Recommendations For Meeting of April 21, 1988 Item No. 1: Ned N. Julian, Jr., Seminole County School Board Attorney - Request to rezone from MR -2, Multiple Family Residential to GC -2, General Commercial for property located east of Orlando Drive /U.S. Highway 17 & 92. I. Site is Zoned MR -2, Multiple Family Residential and appears to be vacant at the present time. 2. Site is adjacent to GC -2, General Commercial Zoning District which includes a shopping center and various automobile, truck and mobile home sales establishments. 3. Site appears to be located so that it will have frontage on the proposed Lake Mary Boulevard Extension between Orlando Drive /U.S. Highway 17 & 92 and Sanford Avenue. 4. Future Land Use Concept Map of Comprehensive Plan reflects a Community Commerce land use classification for site. site appears to be located outside a Resource Protection area on the Future Land Use Concept Map. In general, the request is consistent with the Comprehensive Plan. 5. Recommend approval of request to rezone to GC -2, General Commercial based on similar existing zoning already established in immediate area and existing and anticipated character of area. Item No. 2: Sam Gabbai Representing Dwaine R. Klein - Request to rezone from AD, Agricultural to GC -2, General Commercial for property located on the south side of State Road 46 west of Kennel Road. 1. fronts is zoned AD, Agricultural, fronts State Road 46 and appears to include a roadside produce stand. 2. Site is adjacent to commercial zoning in the unincorporated area which includes wholesale distribution, retail sales and services and professional offices. 3. Site is also adjacent to a church with educational facilities. Various single family residences are located in geneial vicinity of site. 1 4. Future Land Use Concept map in the Comprehensive Flan reflects a Regional Commerce land use classification which is generally consistent with the request. 5. Recommend approval of the request to rezone to GC-2, General Commercial based on site's relationship to a major highway and existing commercial zoning and land uses already established in immediate area at the present time.
