The meeting was called to order at 7:00 P.M. by Chairman Carli.
The first item on the agenda was the consideration of a request to rezone from AD, to
that of GC -2 for commercial offices, that property located as the corner of S.R. 46 and
Kennel Road.
Owners /representatives: Nicholas & Norma Fertakis.
Norma Fertakis, 375 East Lake Mary Boulevard, stated that the rezoning request was com-
patible with the Land Use Plan. Mr. Morris asked if they owned thepropertyon the
west side of Kennel Road and why wasn't it included in the rezoning request. Mrs.
Fertakis stated that they do not own the property on the west side.
Mr. Morris stated that it looked as if it would be spot zoning and stated that it would
be wise to request the opinion of the City Attorney as to whether spot zoning would be
an adverse condition under the Comp Plan. Mr. Morris moved on approval of the rezoning
request. Mr. Speer seconded. All in favor. Motion carried.
The next item on the agenda was the consideration of the conditional use for property
located at 410 Mattie Street for the purpose of manufacturing - electronic equipment in
a GC -2 zone.
Owner: Bammac, Inc.; representative: Ehrman Mack.
There was no one present to represent the conditional use when the hearing first
opened.

Mr. Anthony Panzino, 607 E. Mattie Street stated that he is opposed to the tractor
trailers coining into the area. Delivery is fine but does not want tractor trailers
parking over night. He had no objection to the use, but if approved, with the con-
dition of no over night trailer parking.
Chairman Carli pointed out that included in the City Planner's recommendations was that
tractor trailers and other large, multi -axle commercial vehicles shall be prohibited
from being located upon or otherwise serving the activities being conducted on the pre-
mises.
Mr. Keith moved to table the request for a conditional use. Motion died due to lack of
a second. Mr. Morris made motion to deny the conditional use. Seconded by Mr. Keith.
Opposed to the motion were Mr. Brooks and Mr. Dennison. Motion to deny carried.
The representative to the conditional use showed up. Mr. Brooks made motion to rehear
the conditional use. Died for a lack of a second. Mr. Morris moved to reconsider the
previous motion. Seconded by Mr. Davidson. Opposed to the motion was Mr. Keith.
Motion to reconsider the previous motion carried.
Mr. Ehrman Mack, 212 Enchantment Drive, Lake Helen, stated that they previously manu-
factured electronic equipment at this site. Plan to use this building for overflow
work. There will not be more than 5 employees at one time. Presently storing surplus
there now. There will be UPS service only. There will be no reason for tractor
trailers. No conveyor belts have every been built at this site and there never will
be. The doors will be closed except for loading or unloading. Hours of operation will
be from 7:00 to 3:30.
Mr. Carli stated that the Commission is requesting a 3' high hedge, 5 -foot wide, with a
tree every 50 -feet the entire length of Mattie Blvd. for landscaping requirements. Mr.
Mack stated that there is cemient under that grass.
Mr. Harold Highsmith stated that he has no objections if this is going to be similar to
what was there before. Mr. Mack stated that there will be no combustible material
stored on the premises.
Mr. Morris moved on approval of the conditional use subject to site plan approval and
the City Planner's recommendations. Mr. Keith seconded. All in favor. Motion
carried.
The next item on the agenda was the consideration of the conditional use for property
located at 1215 French Avenue for the purpose of a tire service center in a GC -2 zone.
Owners /representatives: Blen & Jackie Gibson.

Mr. Andrew Kutz stated that the essence of the request is to remove and install tires.
Only tires will be installed on site, will not be involved with anything other than
tires. Mr. Kutz stated that it will take same time to arrive at the drainage retention
scheme and the landscape scheme and requested the opportunity to work with staff in
resolving these issues.
Bob Loveland, Loveland Refinishing, asked if everything will be stored on the inside of
the building at night or if they will have a fenced in area to store things outside of
the building. Chairman Carli stated that part of the recommendation is that outdoor
display of new or used merchandise shall be prohibited.
Mr. Simmons clarified that the conditional use requires a regular site plan. Mr.
Morris moved on approval of the conditional use subject to the recommendations by
Staff. Seconded by Mr. Dennison. All in favor. Motion carried.
The next item on the agenda was a discussion of a waiver of off - street parking require-
ments as requested by Planning and Zoning Ccmnission on site plan approval, 11/6/86,
for Peoples Work Force, 405 East 4th Street in a GC -2 zoning.
Owner /representative: Charles M. Cameron.
Mr. Cameron, 2005 Oak Avenue, stated Lucky Investmnents, owned by Joe Gazil, Sr., has
leased the property to sane other party with the condition that Peoples Work Force not
utilize the parking spaces in the lot. On September 23, Gazil sent a copy of a letter
to the City denying parking for Peoples Work Force. Mr. Cameron stated that there is
only two spaces available on this piece of land for parking. It has already been
concreted and is being used for parking. The lot is 53 'wide and 46' deep. The
building is 30 Mr. Cameron stated that he observed the area one day and found
that 7:00 a.m, is one of the busiest times and 3:00 to 5:00 in the afternoon is the
other busiest time. The majority of the people that Peoples Work Force employ cane on
foot.
Mr. Speer made motion to waive the seven off - street parking spaces. Seconded by Mr.
LeRoy.
Mr. Morris stated that he understands the concerns that this Board has regarding the
parking requirements necessary for Peoples Work Force in trying to provide employment
for unfortunate citizens of the City of Sanford; however, the Board should look to the
reasons why the parking lease was terminated. Mr. Morris stated that obviously the
Gazils had some problems with regards to this part of the parking area and he has some
problems whether or not this Board should transfer these problems to other areas of
the immediate neighborhood. Mr. Morris stated that the Peoples work Force has the
responsibility regarding the people that are being employed to see that they recognize
and respect the rights of the neighbors. As a relinquishment of the off - street
parking, Peoples Work Force must impress upon employees to respect their neighbors.

Mr. Dennison stated that it is hard to believe that the Peoples Work Force are the only
contributors to the problem.
All in favor. Motion carried.
On the Addendum to the Agenda was the consideration of the preliminary plat for
Whippoorwill Subdivision, a 26 lot single - family detached home use located at 3400
Mellonville Avenue in a SR -1 zone.
Owner /representative: Robert E. McKee.
Mr. McKee stated that there will be a sight proof fence on Mellonville side in the
25 -foot buffer. There is existing heavy growth around the railroad tracks; so, there
is no need to wall the tracks.
Mr. Morris moved on approval of the preliminary plat subject to final engineering. Mr.
Speer seconded. All in favor. Motion carried.
Mr. Davidson asked if anything had been done relative to the junkyard on 17 -92 behind
Dunbar's. Mrs. Sonnenberg stated that Code Enforcement had contacted Mr. Dedellow.
First, Mr. Dedelow said that it did not belong to him and that it was in the right -of-
way, Code Enforcement has been in contact with him again and are proceeding.
Mr. Morris stated that Mr. .Marder has demonstrated some insight relative to Ratliffe
Junkyard that is far reaching in effect. It is very perceptive. Mr. Morris stated that
they may want to reeval -uate their position in light of the possibilities that Mr.
Marder has brought forth relative to the Expressway changing the requirements in that
area.
Mrs. Sonnenberg stated that she has sent a request to the City Attorney addressing the
expansion of the non -- conformity and the uses associated with it.
Mr. Morris asked if the City could request the applicant to provide the City with test
borings regarding pollution. Mr. Simmons stated that there needs to be some reasonable
cause for suspicion of pollution, e.g. a sheen on the lake.
Mr. Brooks moved to approve minutes. Mr. Davidson seconded. All in favor. Motion
carried.

SUBJECT: Planning Recommendations for Meeting of October 6, 1988
DATE: September 29, 1988
NICHOLAS FERTAKIS /NORMA FERTAKIS - Request rezoning from AD,
Agricultural, to GC -2, General Commercial for property located at
southeast intersection of State Road 46 (West First Street) and
Kennel Road.
1. Site is zoned AD, Agricultural, is presently being utilized for
agricultural purposes and fronts an arterial roadway, State
Road 46.
2. An auto parts and repair establishment plus a junk yard are
located adjacent to site in commercial and industrial zoning
districts in an unincorporated area. Existing GC -2 Zones are
located in close proximity to site.
3. A church with day care and various travel trailers and mobile
homes are located in agricultural zones in City and unincor-
porated areas near site.
4. Recommend approval of GC -2, General Commercial Zoning, based on
site's location on a major arterial and similarity of existing
zoning already established in the immediate area.
BAMMAC, INC - Request conditional use permit to conduct manufac-
turing of electronic equipment in a GC -2, General Commerical Zoning
District, located on Mattie Street between Sanford Avenue and
Grandview Avenue.
I. Site is located on the north side of Mattie Street, Zoned GC -2,
and includes an existing warehouse with various out - buildings.
2. An existing SR -1, Single- Family Residential Zone located south
and east of site includes various single - family residences.
3. Site is adjacent to a vacant car lot and vacant land zoned
GC -2.
4. Recommend approval of conditional use request based on the
existing character of the area at the present time with the
following conditions:

a. All activities shall be conducted indoors. Except for
customary entering /exiting of the premises and necessary
deliveries, doors and windows facing Mattie Street shall
remain closed.
b. Manufacturing activities shall be limited to assembly of
electronic components and related activities.
C. Machining, hammering and any other activities that produce
loud noise shall be prohibited.
d. Tractor trailers and other large, multi -axle commercial
vehicles shall be prohibited from being located upon or
otherwise serving the activities being conducted on the
premises.
e. A 5 -foot wide landscaped area along Mattie Street shall
include a 3 -foot high hedge and one tree every 50 -feet.
f. The use shall be established within 90 days of conditional
use approval.
BLEN AND JACKIE GIBSON - Request conditional use permit to
establish a tire service center for property zoned GC -2, General
Commercial, located on French Avenue between 12th and 13th Streets.
1. Site is located on French Avenue, is Zoned GC -2, includes
several existing buildings and appears to be utilized for out-
door sale and display of new and used merchandise.
2. Site is adjacent to furniture sales, auto repair, restaurants
and other commercial uses located in GC -2 Zoning.
3. Single - family residences are located adjacent to site on West
12th Street and Laurel Avenue.
4. Recommend approval of the conditional use permit for a tire
service center based on similar existing uses and zoning in the
immediate area and with the following approval conditions:
a. All tire service shall be indoors.
b. Outdoor display of new or used merchandise shall be prohi-
bited.
C. Landscape shall be as follows:
a. French Avenue - 10' wide landscaped area; one tree
every 25 -feet with 3 -foot high hedge between trees.

b. West 12th Street and Laurel Avenue - 5 -foot wide
landscaped area; one tree every 50 -feet with 3 -foot
high hedge between trees.
d. Vehicular access shall be limited to one per street front-
age with each access to be less that 40 -feet in width.
e. The use must be established within six months of con-
ditional use approval.
