Keith Gary Davidson Sheila Roberts Jay Malone Brent Carli Members Absent: Others Present: Dr. Hortense Evans Joe Dennison Commission Gary Winn, Building Official Bill Simmons, Director of Engineering and Planning Jay Marder, City Planner The meeting was called to order at 7:00 P.M. by the Chairman, John Morris. The first item on the agenda was to hold a Public Hearing to consider a request to rezone from AD to that of MR-1, property located west of Airport Boulevard between 25th Street and Country Club Road, represented by Robert Seigler. Mr. Robert Seigler stated that he was representing Mr. Eliezer Choc, owner. Mr. Seigler stated that from the configuration of this piece of property it has been very difficult to do any anticipated use. At the east there is a portion of County property which precludes them from doing any practical planning on it. Several hundred acres to the south that is now going through DRI that is an enclave situated between the City of Sanford and the City of Lake Mary. The County is going to allow development of that property of 1200 to 1300 acres. Mr. Seigler also stated that they applied to rezone the north half of this property because with the anticipated widening of 25th Street and with the potential commercial zoning across the street and the General Sanford Estates DRI, there is no way they can properly plan for the entire tract. Mr. Seigler stated that the ultimate intended use of this property by the owner would be to develop into sane units on the north side and hopefully depending on what happens to the General Sanford Estates, they would go into the whole piece situation, similar to Bram Towers on a very low scale. Mr. Seigler stated that they wanted to get the residential part of the property addressed and wait to see what happens in the future. He stated that they were not really concerned with the decision tonight because without an office - professional classification in the City code, it might be that they should came back with a PUD. If they had to cane back with a PUD it may be several years until they could properly address that section of 25th Street. Mr. Charles Thorne of 108 West Crystal Drive spoke in opposition to the proposed rezoning. He stated that the 247 residents of the Loch Arbor subdivision are abso- lutely opposed to any rezoning of that particular piece of property at this time. MINUTES - PLANNING AND ZONING C(MMISSION - June 4, 1987 Page 2 Mr. Thorne stated that this property was attempted to be rezoned before and was turned down because it is in the bogs. He stated that there is a traffic problem exiting to Lake Blvd. onto 46A. Mr. Thorne stated that to rezone the property multi -home is not in keeping with the area of all single family homes. Mr. Don Nicholas of 3206 Country Club Road spoke in opposition to the proposed rezoning. Mr. Nicholas stated that his major concern is traffic. Mr. Nicholas stated that General Sanford Estates is planned for approximately 1460 homes in and around their tract and will take care of the traffic problems for the 1460 homes. Mr. Nicholas had concern for the drainage stating that the excess water that runs off of their property runs dawn to that area. Mr. Nicholas stated that the General Sanford Estates would generate about 700 children in the community and he was told that that would not have an impact on the schools. He stated that Idyllwilde is at capacity and he does not foresee another school going in anytime soon. Another concern of Mr. Nicholas was how this particular piece of property got to be within the City limits in the first place. Mr. Nicholas questions the legality of the annexation. Ms. Sonya Greenlee of 205 Lake Boulevard spoke in opposition to the proposed request for rezoning. Ms. Greenlee stated that she would like to see the integrity of the single family neighborhood preserved. She stated that a dangerous precedent is set when existing single family homes are encroached upon by multi - family homes. Mr. Roy Rice of 203 Forest Drive spoke in opposition to the request to rezone. Mr. Rice stated that this property was denied by the County to be rezoned for a con- venience store some time back because of the right-of-way of 46A and Country Club Road and any entrance onto 46A would be a traffic hazard. Mr. Rice stated that multi - family is not compatible with anything in the area. Mr. Malone stated that after reading the staff's recommendation he could see that the Commission did not have a choice and moved that the rezoning be denied. Seconded by Mr. Carli and Mr. Keith. All if favor. Motion carried. The next item on the agenda was to consider a request for waiver for sight proof fencing along the northerly property line at 3150 Orlando Drive, Shoneys Restaurant represented by Mr. Jim Hartman, Director of Operations. Mr. Hartman stated that it would be an advantage for their customers to look out windows and see the lake; just a whole lot better view. Mr. Carli asked what was going to be done about the median. Mr. Hartman could not give an answer at this time. Chairman Morris asked Mr. Simmons if he would check and see what the situation is with DOT with regards to the proposed highway improvements that are shown on the site plan; if, in fact, they were not allowed to proceed with their proposed improvements reference the median cut, and find out why. Mr. Carli asked if the staff had any contact with the Scenic Improvement Board because it is dealing with City property as a buffer. Mr. Simmons stated that the SIB had not been invited to ccmTent on the sight proofing at time of site plan review. MINUTES - PLANNING AND ZONING COWUSSION - June 4, 1987 Page 3 Mr. Malone made motion to grant request for waiver. Seconded by Ms. Roberts and Mr. Carli. Mr. LeRoy recommended that 3 laurel oaks trees to be located by staff be included in the motion. After discussion it was decided that 6, minimum, laurel oak trees be included in the motion. Motion so amended by Mr. Malone. All in favor of the amendment. Notion carried. All in favor of the motion as amended. Motion carried. Mr. Marder stated that completion of the numbers and data collecting with regards to the Comprehensive Plan support documents are rapidly underway; and we have the actual plan document in terms of future land use concept. Chairman Morris stated that the Commission has the Minority Report of the Group Homes and Foster Care Facilities Advisory Committee and asked where the Majority Report is. Mr. Simmons stated that he has seen a copy of the Majority Report and would see that the Commission was mailed a copy. Mr. Simmons stated that the City Commission directed staff with considerable input from the Attorney move toward preparing a draft of the ordinance so that they could then look at the specific words and spe- cific impact as to how it would fit together, then take another look at it, then once they have the ordinance the way they think they want it, then pass it to Planning and Zoning for a public hearing and for input and recommendation. Mr. Carli stated that there is a gentleman living out of an R.V. by the name of Mr. Gore. Mr. Simmons stated that the Code Inspector will check. Mr. Carli stated that it was brought to his attention by a citizen and businessman of this community that he was having a problem with the City of Sanford, One Harbor Place, and One Harbor Place has pointed out that it is not all on the leased pro- perty. Specific items brought to Mr. Carli's attention was the transformer and the air conditioning unit for the Place that is on beach side and not on leased property, and is not being maintained. Mr. Simmons to take a look at this and get something going on it as appropriate. Mr. Malone inquired as to Beda Marine. Mr. Winn to check on this to find out where the report is because the Code Inspector has been on vacation for a week. Mr. Malone made comments relative to possible staff's actions regarding the home occupation licenses and feels unccmfortable not having any ideas of how the proce- dures work and whats going on and stated that he would like to have the home occu- pational licenses returned to the Planning and Zoning Commission. Chairman Norris stated that the reason behind delegation the responsibility to staff was that it became so routine and became so cumbersome to the public in having to come down here to get their occupational licenses from the Commission that we thought it would be more expeditious to the public as a whole that it should be a staff func- tion provided they met certain criteria. Mr. Carli agreed with Mr. Malone stating that five members of the Commission had never delt with the responsibility of dealing with a portion of the responsibilities of the Commission and he would like to see that hcme occupational licenses be brought back. MINUTES - PLANNING AND ZONING COMMISSION - June 4, 1987 Page 4 Mr. Malone made motion to bring back hame occupational licenses. Mr. Carli seconded. No further discussion. Motion carried. Mr. Malone stated that the house across fran the Baptist Church on Park Avenue is definitely not a single family residence and requested Mr. Simmons have code enfor- cement check on this. Mr. LeRoy is concerned about the storage of cars at the Park Avenue Car Wash. Mr. Winn stated that Dan Florian had checked on this and the question about him running a used car lot was proven false. Mr. Winn stated that some of the cars up there with writing on the windsheilds were being detailed, believed 4 or 5 vehicles of his own that are licensed are parked in the back of his building. Chairman Morris requested a copy of Dan's report. Mr. Carli had concern for Aristocrat Motors, stating that the cars are being stored in the woods out back with engines torn out, transmissions all over the place, and would like this checked. Mr. Simmons stated that this would be checked. Motion to approve minutes as circulated made by Mr. Davidson. Seconded by Mr. Carli. All in favor. Motion carried. Meeting adjourned at 8:00 P.M.
