A public hearing was held to consider the rezoning request from Mr. William Stemper to rezone from R -1, Single Family Dwelling to that of C -1, Neighborhood Commercial District that property legally described as the North 96 feet of East 66 feet of NW'k of NW'k of SWk of Section 36, Township 19, South, Range 30 east less North 30 feet for public road. and the South 46 feet of the North 142 feet of the East 66 feet of NWk of NW'k of SWk of Section 36, Township 19 South, Range 30 East. And that part of the East 146 feet of NW'k of NW'k of SWk of Section 36, Township 19 South, Range 30 east, less East 66 feet) lying North and East of perpetual easement and right -of -way granted to the State of Florida, recorded in official records 37, page 320, public records of Seminole County, Florida, LESS30 foot right -of -way for Country Club Road, off North side thereof. Mr. William Stemper appeared to voice this request and showed slides of the areas proposed for rezoning, including the showing of a similiar convenience food store that would be erected in the area, should the rezoning be allowed. After appearance of Mr. Stemper, Mr. R. D. Grieme, 1200 . W. 20th Street, Sanford, Florida presented a petition protesting the rezoning of this area, reading as follows: 1203 West 20th Street and property immediately adjacent thereto;We, the undersigned, living in the so stated area along West 20th Street, petition the proposed rezoning from R -1, One family dwelling district-to C -1, Neighborhood Commercial District, We feel Z & P Minutes June 18, 1970 Page 2 that the proposed action will bring in business causing traffic and safety problems for our children. Undesirable visitors, litter problems and disturbance of the peace will be unwanted results from this rezoning. Since one grocery store is already close enough for any purchases, another such store so close is unnecessary and undesirable in our neighborhood. This petition was signed by fifty one persons living in the area. Appearing to voice objection to the rezoning were the following property owners: Mrs. James Hunter, Patrick & 20th Street Katherine Brush, 1210 19th Court Carem Gager, 1209 W. 19th Court Harriett Gazil, 2021 Chase Ave. Others in the audience voiced objection but did not come forward to speak. Mr. & Mrs. Gilbert Grant, 1210 W. 20th Street and Mr. Paul Pew, 1200 West 22nd Street appeared stating they had no objection regarding the rezoning. A lengthy discussion followed after dismissal of the audience and Mr. Martin Gainer, City Planner recommended that the rezoning not be granted siting the following reasons: I. Further commercial establishments not needed in this particular area. 2. encroachment in an established residential neighborhood. 3. rezoning would present a decline in residential features. 4. increase in traffic, street is residential and narrow. 5. does not follow the local general development plan. 6. sets precedent and further rezoning would be forthcoming. After discussion and on motion from Mr. White it was recommended that the Zoning and Planning Commission deny forwarding a recommendation to the City Commission to rezone the said property from R -1, Single Family residential to C -1, Neighborhood Commercial. Seconded by Don Bishop and carried with a unanimous vote. Z & P Minutes June 18, 1970 Page 3 A discussion regarding the benefits that might be derived by the City of Sanford from the Federal Flood Insurance Program was next on the agenda. After careful study it was determined that this program would not prove feasible for the city. Mr. Martin Gainor gave a report on the Survey and Planning Application for the City's first Urban Renewal Project and presented additionalcopies to the Building Official. The Building Official suggested that a study of the modular homes be continued and that further safety features be required in the prefabricating of these homes, such as foundation walls to be enclosed and meet the live and dead loads inflicted on them. It was decided that a proposal be drawn up for review at the next meeting. The minutes of the last meeting were approved as submitted. Mr. Risner reminded the members that the recertification of our Workable Program would be necessary in 1971, and that help from the Atlanta HUD office could be expected in preparing this recertification resulting from the visit of Mr. Edward Meill. There being no further business the meeting was adjourned. Chairman
