McKibbin, Galloney, Karns, Harris, and Bush. Also present were City Manager Knowles and Building Official Yelvington. Chai McKibbin called the meeting to order and dis- pensed with the reading of the previous minutes. There were approximately 20 to 25 persons present in the audience who represented property on West First Street. They were 'appearing with regards to the proposed new Zoning Ordinance nand the proposed new zone of R -3 (one and two- family zone) on West First Street, from Poplar Avenue west to the city limits. The Chairman outlined to these people the Comp.re- hensive.City Plan and explained that the Zoning and Planning Commission had had their Public Hearing on December 28, 1961; . this Board;'s work had been completed and that the City Commission had set up their public hearing for January 22, 1962. Mr. Ed Shinholser, local attorney, appeared before the Board as a representative for the Real7* Trust Company who in turn represented the Kilgore Seed Company's property on West First Street as Block 2, Tier 17, St. Gertrude's Addition. He stated that due to the new proposed zoning to that of residential nature, the Kilgore Seed Co. was concefned with future expansion at this new location. In a lengthy discussion with the. Board, Mr..Shinholser felt that the City.of Sanford's commercialigrowth would be .st*mied if W. .First Street were not zoned commercial due to the .fact that it was already apparant that the commercial growth was going in that direction; es- pecially with the new construction of the Firestone Store on the SW corner of 1st and French. He felt that the potentiality of French Avenue was still young and this was not a basis for what West First Street would Z & P Commission Minutes 1/4/62 2 develop into commercially. However, Mr. Shinholser did state that there was no hardship regarding his client at present. His recommendation to the Board was that, both sides of West lst Street from Poplar Avenue west to the city limits be zoned commercial. Other persons owning property on West First Street and who were heard by the Board are as follows: 1. William Kirk ... felt that people coming into Sanford are not interested in going thru a second rate housing proj�rct. Want to see some place where they can lodge and eat when coming off of new federal highway. Urged the Board to reconsider the zoning. 2. Dr. Munson ... used DeBary as an example that if it is to be a suburb of Sanford, this highway should be commercialized; otherwise, with the access of new federal highway they will go on thru to Orland to shop. However, if West ist'Street were commercialized, theyimight shop in this area. Felt that Board was prohibiting "natural growth ". 3. Mr. Ball of Ball Bros. Trucking ... will move from temporary location on West 13th.Street back to their permanent location on West lat. Will be moving back into a residential use. Their property needs improving when they move back. 4. Mr. Bishop ... owner of property with a structure on it near IPoplar Ave. Has had it sometime; structure needs improving; bought property as comm rcial use. 5. Walter Routh ... Property owner on West lat. The only thing it can be is commercial use. 6. Randall Chase ... Make it as easy.as possible for com- mercial to come into Sanford. 7. Mr. Bird ...Told those present.to remember.Jan. 22nd ls; CL O 0 M w v u c.. Ob 0 M E Z & P Commission Minutes 1/4/62 3 Public hearing by City Commission, and that this is not in fine print. 8. Mr . , ,Jones - Jones Tire .Shop ... owns 5 acres. Would not,build a home on West lst. (note: outside city limits) . 9. Bill Wieboldt ... still owns one lot. Thinking that it would go commercial, he had not sold it. (SE cor. of Avocado). Not a good location for good homes. 10 . Mr . ,Price ... "You should spend a night in my bedroom" . If trend has anything to do with it, commercial will go on West 1st. Approximately five of these property owners in this area have had direct offers made to them regarding their property being for sale for commercial use. Mr. Harper with one of the local real estate offices mentioned that they had had inquiries about this area In the last 8 months from various oil companies. The Board emphasized to the property owners that in following the Comprehensive City Plan drawn up by City Planner George.Simumons, when a throughway is widened it does not always mean thatithe adjoining property should imme diately go to a commercial .zone. Under good planning a highway is for the .flow of traffic and not to be congested by strip-co rcial zoning. Mr. said that many a .city has gotten itself into a jungle with "natural growth ". Mr. Bush stated that the Federal Highway is approximately three miles from the city limits line .itself. Mr. Harris stated that the Board was aware that there could be some hardship in one or two cases presented and would need someiconsideration, but questioned why the.interested persons had not used French Avenue for commercial purposes. One ,major point the Board stressed to the property owners was that they were not zoning for those who were dealing in speculation. Z & P Commission Minutes 1/4/62 4 However, the property owners did not concede to the Board.'s view that a through highway was for the movement of uncongested traffic. The property owners were told that the Board would take the area under advisement and that they could appear at the City Commission's public hearing in January. The Board then went into Executive Session and discussed to some length the presentation by the various property owners regarding,commercializing West 1st Street. It was the consensus of opinion of the Board that, there was only one case in the area that presented a hardship and this could be handled in the future.since it was not a pressing matter at this time. Wherefore, the final decision was that the area would remain as proposed for recommendation to the City Commission. In viewing the proposed zoning map, it was moved by Mr. Karns, seconded by Mr. Harris and carried that,.the area on the west - side of French Avenue from 22nd to 24th Streets, for one lot in depth, be zoned commercial (C -1). A written proposal was then presented for an additional and conditional use for commercial off - street parking in a residential area to be included in the proposed new zoning ordinance. Moved by Mr. Harris, seconded by-Mr. Karns and carried that the above proposal be adopted and included in the new zoning ordinance as written. ThelBuilding Official recommended t] dition of the zones for the colored race, the new ordinance be revised. Also, that Regulations pertaining to Items 9, 10 and "ground" bb eliminated. The Board was in the above changes. hat since the ad- the Articles in under the Sign 1.1 that the work full accord with Z & P Comm ission Minutes 1/4/62 5 It was moved by Mr. Harris, seconded by Mr. Karns and carried that the Del -Mar site on Old Lake Mary Road between Country Club Road and 25th Streets be changed to an M--1 zone.on the new proposed zoning map. It was agreed by the Board that they would appear before the City Commission in a body to outline and discuss any.phase of their recommendations regarding the now zoning ordinance and map and to enlighten the City Commission re- garding their reasons for the zoning on West First Street.
