McKibbin, Wharton, Talley, Karns, Harris, and Lee. Also present were: City Manager Knowles and Building Official Yelvington. Chairman NeXibbin called the meeting to order. Reading of the previous minutes was waived. Susie M. Hollice presented a request for consideration to re- zone from that of R -5 to C -1 the West 81 feet of the South one -half of Block 11, Tier 13, Less the North 37 feet for a retail grocery store. Location being the NE corner of lOm Street and Pecan Avenue. The Board was told that this is presently a vacant structure; was a non - conforming use as a grocery store; has not been occupied as such in over a year; and, is presently on the Group III Con- demnation. The property owner stated that at present if Mr. Carlton did not lease the building for a grocery store, there was a person interested in renting for a TV repair and sales. During discussion it was brought out that Mr. Carlton was established'elsewhere and the property owner did not realize the decayed and hazardous condition of the building. Also, the pro- perty owner did not have any definite plans for repair of the building other than the flooring. On the! basis of the past non -- conforming use; vacant for over a year; condemnation; and the character of the neighborhood where - by there are retail establishments within six blocks of West 136 Street, in commercial zoning; it was moved by Mr. Harris to deaf the requesti Lotion s6conded by Mr. Karns and carried unanimously. Application for re- zoning from that of R -1 to that of C -2 for Lot 6, Block C, Buena Vista Estates was submitted for Archie C. Harriett, as owner. Property location being that of 1521 Celery Avenue and /or SW corner of Celery and Summerlin Avenues. This is an existing commercial building which is a plumbing sales and service. The owner is coatemplating an addition of 10 x 12 feet for an air - conditioned office and planning room. Due to this request, the Board took under advisement the Giant's Dormitory in this immediate area, which when used by the farm training clubs is a multiple use. Also, Mr. Harriett had constructed this building under the former zoning ordinance and this was originally a commercial zone. Also, it was discussed that due to the type of business, there would be some.expansion needed, plus the fact that there was some outside storage in- volved. Z & P Commission August 16, 1962 2 Moved by Mr. Harris, seconded by Mr. Talley and carried, the followiAg is recommended to the City Commission for re- zoning: BOTH SIDES OF MELLONVILLE AVENUE - from Celery Avenue, east. 1. Rezone from an R -2 to that of R- NORTH SIDE of Celery Avenue for a depth of 350 feet bounded on the west by Mellonville Avenue and on the east by the westerly boundary line of Mayfair Section First Addition. Legal: S 350 feet of Lots 22, 23 and 24 of Pace Acres of Plat Book 3, Page 21, Seminole County Records. 2. Rerzone from an R -1 to that of C -1 Those lots abutting the SOUTH SIDE of Celery Avenue from Douglas Avenue to the east city limits line. Legal: Lots 1 through 6, Block B Lots 1 through 6, Block C Lots 1 through 3, Block D - Buena Vista Est. It was noted that under the C -1 use Mr. Harriett would be allowed to construct his addition, but with a sight -proof fence requirement. The BoFd discussed revisions and possibly adopting a new policy regarding the application, fee, etc. on re- zoning. The Board requested that the Building Official review this matter and present to them at their next meeting a revision on the following suggestions: 1. All applications will be made by the person who owns the property. 2. Application must be filed in the City Manager's office no later than days before regular meetings, which are held owe 1st and 3rd Thursday of each month in the City Commission Room of the City Hall at 8 PN. Whereby this allows for publication of notice of the Board's intentions to discuss and pass on the reLZOning request, plus the members reviewing the area and visiting the premises. 3. A fee of will be paid at the time the publica- tion is fi = Focover publication notice of 'Public Hearing legal advertisment by the Zoning and Planning Board, plus a fee of for city's legal Public Hearing advertisement. Notification by individual letter will be mailed to the abutting property owners re applicant's request for re- zoning and will also state the date that the Public Hearing will be held by the City Commission. 5. Notification is mailed to propert owners whose property abutts within three hundred (300' feet of the property owner requesting consideration for re- zoning. 6. Abutting property owners whose zoning is that of a lower or the same classification of that being requested will not be notified by individual letter. There being no further business, Mr. Wharton moved for adjournment, seconded by Mr. Valley and carried. retary a rm�
