McKibbin, Harris, Johnson, Lee and Wharton. Also present was Building Official Yelvington. Meeting was called to order by Chairman McKibbin. Reading of previous minutes was waived. � 0 d Q Lj CL CY- 0 G M C� F e0 V N Mr. Merle W. Warner of 708 S. Park Avenue appeared before the Board regarding a possible amendment in the.text of the Zoning Ordinance.whereby it would allow him to operate a real estate office as a "home occupation" at his residence in the near future. His property is situated in an R -3 (multiple family zone) . He also stated that he had purchased this property 7 years ago along with the vacant lot to the south of his residence; purchasing it not as a home, but strictly on use as a business basis. The Board explained to Mr. Warner and it was understood that, at the time he the property it was situated in an R -2 zone with the allowance of home occupation., including any vocation.or trade with provisions. However, a Public Hearing was held and .a new Zoning Ordinance adopted in February, 1962, whereby real estate - offices were among others that are not permitted as a home occupation. Chairman McKibbin asked the Board if they wished to refer the situation to -the City Commission on the basis that the use be allowed in the zone or that the text of the zoning ordinance be amended. To be referred to them without the Zoning and Planning Commission's recommendation. No recommendations were made and no action taken by the Board on this matter. The Board .felt that any matter referred to the City Commission should .be -done only with a recommendation from the 2 and P Commission. • a r w U) d CL O; 0 0 co Z & P Minutes 3/7/63 2 The Board's feeling too was that, based on the Planner's recommendation, considerable thought and advance planning ideas had been given to home occupations in adopting a new zoning ordinance. Mr. Howard Rollins, owner of commercial property in a C -1 zone, Neighborhood- Comnerciai, at 2617 S. French Avenue, appeared before the Board to request the use of the building for a "pet poodle grooming shop ", which would also entail retail supplies for canines, plus he would have from time -to -time puppies for sale. It was not to be a boarding kennel; however, there was a possibility that a dog or dogs might be left there overnight by longer by the owner. A lengthy discussion followed this type of operation is more -or -less allowed.only in an M -1 District as defined under - Veterinary.hos'pita.l and kennels whereby grooming is an assumed service. It was discussed pro and con regarding a pet shop, with possible overnighfhousing being a nuisance pertaining to barking, outside cages, etc., in a C -1 area bordering a residential area. Mr. Rollins stated to the Board that this building was air conditioned whereby.he .felt it would control the noise. Mr. Harris moved that the following be recommended to the City Commission: Amendment in the Zoning Ordinance in all NEIGHBORHOOD C014SERCIAL DISTRICTS under Uses Permitted whereby.pet'store, grooming shop or pet supply store be allowed in the C -1 zone if the building is constructed so that no animal noise may be heard outside the building, and no animal odors emit therefrom. All necessary equipment for the operation of the business will be housed the building and no animals kept, housed, or caged outside the building. Motion seconded by Mr. Johnson and carried. s w a Z & P Minutes 3/7/63 3 Due to Mr. D. S. Talley's transfer to Atlanta, Ga., his resignation was accepted by the Board regret. Mr. Wharton moved that Dr. C. F. Brooke Smith be recommrended to the City Commission for-appointment to the Zoning and Planning Board to fill this vacancy. Motion seconded by Mr. Harris and carried.
