Members present were Messers. McKibbin, Bush, Karns, Harris
and Johnson. Also present were City Manager Knowles and
Building Official Risner.

The meeting was called to order by Chairman McKibbin.
The reading of the minutes of the previous meetings was
waived.
0 Mr. Walley Dietrichs, as agent for the purchaser, submitted
a written application requesting a "conditional use" for Mrs.
Abrams to operate a childrens' day nursery at 2440 Oak Avenue,
which is presently an R -lA zoning.
Legal description of this property being: Lot 91, less
the N 12' and all of Lots 92 and 93, Franklin.Terrace.
The Chairman explained that under the present Zoning
Ordinance, Article III, Sec. 2, Page 11, public schools,
nursery schools and kindergartens may be allowed as a con-
ditional use when after review of an application and plans
appurtenant thereto and hearing thereon, the Planning Board
finds as a fact that the proposed use or uses are consistent
with the general zoning plan of the City of Sanford, and with
the public interest, the Zoning and Planning Board may recommend
to the City Commission the permitted conditional use in an R -1A
One. Family Dwelling District.
It was noted in the written application from Mr. Dietrichs
that he had talked with the adjoining

indicated no objection to the applicant's intended use of the
property.
IJ Mr. Dietrichs approached the Board and stated that,
Mrs. Abrams would live.on the premises and operate the nursery
3..� in the manner of a home occupation; that she would put up fencing;
and she was experienced in this field since she had operated a
C6 nursery for older children in Miami.

He also stated that he had talked with Mr. Earl Moxley,
abutting property owner to the south of 2440 Oak, and Mr. Moxley
had registered no complaint to the intended use of the property
for a nursery school.
The Board recalled that when the property at 2440 Oak was
formerly.owned and occupied by Capt. Rowell there was objection
to rezoning,the residential area to the east to commercial for
the construction of the Food Fair at the hearing of the Zoning
and Planning Commission. However, at the City Commission's
public hearing later, the property owners were not present
and the property was zoned commercial.
It was pointed out that, with the Food Fair store, there
is the noise of delivery trucks, refuse pickup, and air con -
ditioning throughout the day and night, plus the glare at night
from the.lights on the parking lot. It was also noted that
the residential property has remained vacant for some time.
An observation that the Board members concurred with was
that this child's day nursery operation was a good practical
use for the property.
Moved by Mr. Harris, seconded by Mr. Johnson and carried
that the property at 2440 S. Oak Avenue be recommended to the
City Commission for a conditional use as a children's day
nursery to be operated by Mrs. Abrams.
There being no further business, the meeting adjourned.
