HomeMy WebLinkAbout02.11.55MINUTES OF SPECIAL MEETING OF THE PLANNING and ZONING COMMISSION, CITY HALL, SANFORD, FLORIDA, FRIDAY, FEBRUARY 11th, 1955 Members present: Robert S. Brown, Chairman A. L. Gillon, Building Inspector Don Rider, Jack Sutherland (newspaper staff), John Krider, City Commissioner, Brailey Odham (builder) Fred Williams Forrest Breckenridge John Ivey Ted Williams Otto Borsdorf Chairman Brown called meeting to order. Mr. John Ivey and Ted Williams appeared before the Board with a request of re- zoning South side of 25th from the Pig'n Whistle east to McReynolds Drug Store an area of 250 feet in depth for a commercial or retail business; the idea being to eventually work toward a "shopping center" in this area. This area is presently zoned R -1. Mr. Ivey mentioned that he had a request for a hardware store, which he might consider. . During the discussion regarding this request, the.Board felt the business should be one that would operate only during the day and close sometime around 6 :00 p.m., since a residential section is bordering this area. Mr. Gut referred to and read from the Sanford City Code, Sec. 16, P. 339, C--N commercial - retail (neighborhood shopping) district wherein any drive -in restaurant, where food or drink is consumed on the premises is prohibited; also, no bar, cocktail lounge or similar establish- ment where alcoholic beverages would be consumed would be per- mitted. Under this section, it also states the restrictions and limitations as to the way the lighting equipment shall be used in order to prevent lights from shining in windows of adjoining residential property. Thus, any type of business that would continue into the night would not be permissible. The above area.is bordered on 3 sides by residential property. Minutes of February 11th, 1955 Page 2 Mr. Odham's idea, with reference to the above described property, Is to create or construct a colored housing project, which would be individually financed FHA and VA homes. The cost of this project would run from $250,000 to 0300,000. Mr. Odham went on to state that this project would have city water, city sewer, and paved streets, which would be constructed at his expense and according to figures given to him there are 1,200 colored people that are capable of paying $35.00 a month or over on homes of their own. Mr. Gut then moved it be recommended to the City Commission -- (please see recommendation #4 on attached list which is < hereby made a permanent part of these minutes). Motion was seconded by Mr. Collins and carried. a Request of Otto Brosdorf and son Robert to start a nursery at 2557 Palmetto Avenue was then brought before the Board's L attention. However, since this request was not for re- zoning 0 and was in a form of a variance, the request was referred to the Board of Adjustment. Mr. Brailey Odham next appeared with a request to re -zone the CU area on Mellonville Avenue across from the new and old ball m parks presently zoned R -1 and R -lA; part of Lot 4, less the IL North 150 feet, all of Lot 5 & Lot 6 of Ella Pace sub- division; ❑ all of Blocks 1 & 2 and part of Block 3 of Eldorado; Blocks X , 2 & 3 of Eldorado are presently zoned 0-1. Z Mr. Odham had drawn up a map showing the lot numbers, vacant H lots, location of existing houses in this area as to colored and white residences, school board property, and the lots which he had an option on to purchase. Also, Mr. Odham had provided a buffer strip on the map, which he said might be from 70 to 75 feet and this strip he proposed to deed to the City, if they so wanted. Mr. Odham's idea, with reference to the above described property, Is to create or construct a colored housing project, which would be individually financed FHA and VA homes. However, Mr. Gut wentAo explain that the Board < itself is interested only in what is best for the City as a whole, and this area, in his opinion, was a very poorly chosen piece of land that would create alot of resentment; further, it would not receive his recommendation to the City Commission. It was felt by the majority that there would be concerted protest for the in enlar in a and rather than waste time on a public hear on his area, they try and arrive at a solution that would be agreeable to all. 0 Mr. Odham stated that a problem is never solved by ignoring it, 4 and if something isn't done about the situation, the colored IL will be living next door to all of us. Every member present as stated that he would be glad to put in some over --time on the problem. d Z d Minutes of February 11th, 1955 Page 3 Mr. Wright's motion that the request be turned over to the City Commission as plated, also died for lack of a second. After further consideration, the Board still felt that they wanted more time to consider this request and have a chance to look over the proposed site. Mr. Wright then stated he wished to withdraw his recommendation. Chairman Brown asked the members not only to check this area, but to please drive all over town and check other areas that might be suitable and available for this existing problem. Commissioner Krider was present at the meeting in behalf of the annexing of more property within the City Limits. This was recommended in 1953, but no action taken. It was felt that this action should be taken at this time, due to the fact that the "legislature" is meeting now and another 5 years from now will be too late to take in the area especially near the new school site at 27th Street. Some felt that areas should only be taken in where the City can furnish city ser- vices. Mr. Krider mentioned that extension of utilities is based only on demand and that since the new sewer work construction in the City, utilities are at the City Limits now. It was quite agreed by all that the City should have expansion area to grow in and this school site area would then be more -or -less of a "fringe" area for any expansion. Again, it was mentioned. if not taken in now, the site would become a patchwork of shacks and dwellings due to the fact that there is no County restrictions at the present. Mr. Lee moved that the -Board re- submit their former recommendation. with regards to annexing property within the City Limits, including one - quarter section or mile south of 27th Street. -- (please see recommendation #5 on attached sheet and also outlined map, which is made an official part of these minutes.) Above motion seconded by Mr. Wilson. Motion carried. Mr. Gut then moved that the amended recommendation on the attached sheet - listed as recommendations #1 and #2 - be adopted and sub- mitted to the City Commission. Motion was seconded by Mr. Stanley and carried. Mr. Gut moved that amended recommendation #3, on attached sheet, be adopted and submitted to the City Commission. Motion was seconded by Mr. Lee and carried. Mr. Gut moved that amended recommendation #4, on attached sheet, be adopted and submitted to the City Commission. Motion was seconded by Mr. Collins and carried. The reading of the regular minutes, dated January 20th, 1955, stood approved. It was voted by majority members that meeting would adjourn to regular meeting of February 17th, 1955 to continue the discussion of Mr. Odham's request on above proposed colored housing site.
