MoKibbin, Horgan, Johnson, Faville, and Talley. Also present was Building Inspector Yelvington and City Eger Knowles. Meeting was called to order by Chairman HoHibbin. Minutes of the February 20, 1958, meeting were read and approved. Chairman MoKibbin then read the letter of resignation from board member Mr. A. L. Collins. Hr. Collins is being transferred to a different locale by the Atlantic Coast Line Railroad., Mr. Morgan moved that we accept Mr. Collins' resignation with regret and that a letter to this effect be written to him. Notion seconded by lr. Johnson. Motion carried unanimously. The board then discussed local men who could possibly be named as potential members on the board. Mr. Carroll Burk -newly established lawyer with Maok Cleveland's office, was suggested due to his showing interest in civil undertakings of the city. Also, Mr. Don Thompson, an architect and associated with Mr. John Burton's office, was mentioned for his keen aptitude. However, at the present time, Hr. Thompson is residing outside the city limits, and Would not be eligible for appointment to the board. The new of R. C. Harper, Jr., was also mentioned and requested that it be kept in mind for future reference. Referring back to the previous list of possible eligible mamas, Mr. Horgan moved that the names of George Andrew Speer and Ralph Pesold be submitted to the City Commission for the appointment of one. Motion seconded by fir. Johnson. At this point Mr. Morgan was requested and agreed to amend his motion to include the names of M. L. Raborn,'Jr., to the recommended list. Amended motion seconded by Mr. Faville and carried. City Manager Knowles gave a brief report, per conversation with Mr. Kirohoff, regarding their property in the Wynnewood section that has been used as a nursery and outlet for plants, shrubs, eto. Since the board had spent much time in study and discussion on duplexes; where they should be allowed and the regulations pertaining to them, Mr. McKibbin asked the board for opinions as to the already proposed areas. In reviewing the previous overlay work on duplexes and the suggested areas in the minutes of December 5, 1957 the following seven (7) areas were proposed for duplexes and so reoommmended to the City Commission, with respective action to each. 2 & P Minutes March 20, 1858 - 2 - Areas which are to be designated for duplexes by an overlay maps 1. The R-•1 zone and the R -1A zone in that area bounded by Pine Avenue on the west= 2nd Street on the north; Mellonville Avenue on the east; gad, 11th Street on the south. Mr. Faville moved for the adoption of this area under item il. Motion seconded by Mr.'Talley and carried. 2. The R-1 area from Rosalie, Drive north to Celery Avenues bounded on the east by the city limits; on the west by the east boundary line of the Rt1A area extended north to Celery Avenue. Mr. Morgan moved for the adoption of this area under item J2. Motion seconded by Mr. Johnson and carried. 3. The R -1 area between French Avenue and Sanford Avenue, from 4th Street to the Railroad. Mr. Faville moved for the adoption of this area under item-#3@ Motion seconded by Mr. Harris and carried. 49 The R -1 area between Cedar Avenue and French Avenue, north of 5th Street. Mr. Harris moved for the adoption of this area under item f4. Motion seconded by Mr. Talley and carried. 5. The R -1 area from 18th Street to 25th Street, between Maple Avenue and the west city limits little. Mr. Morgan moved for the adoption of this area under item #5. Motion seconded by Mr. Johnson and carried. 6. The R-1 area east of Sanford Avenue to Princeton Avenue and between 24th Place and 25th Street. Mr. Faville moved that item #6 be'adopted and so recommended to the City Commission. Motion seconded by Mr. Harris and carried. 7. The R -1A area only from 23rd and 25th Streets, from Park Avenue to Sanford Avenue. Mr. Horgan moved for the adoption of item #7* Motion seconded by Mr. Harris and carried. The board then discussed proposed regulations for the aforementioned duplex areas. There was muoh pro and con theories as to the uses permitted, such as professional office in one of the duplex units. It was felt that these duplex uses permitted should coincide with the existing uses permitted in the same districts, such as an R -1A area does not permit a professional office. w I W U) W C. Cd C� 0 0 M Z & P Minutes March 20, 1968 - 3 - Building Inspector Yelvington felt that there would be controversy over the fact that if a duplex construction met all the requirements in an R-1 zone under the proposed regulations being discussed, then how could you explain the fact to a person that they would not be allowed to convert an older building into two apartments in the same zone even though they too could meet all the requirements as to area and frontage required, plus the front, side and rear yard requirements. City Manager Knowles felt that the board was creating a variance for duplexes and their regulations by ordinance, and questioned the legality of so doing. Upon motion of Mrs Faville, seconded by Mrs Harris, and carried, the following recommendation was made to the City Commission in regards to regu- lations for the duplexes under overlay areas& Regu lations In certain R -1 and R -lA areas, hereafter to be determined by the prescribed procedure, the construction of duplexes shall be permitted, provided the following limitations are observed: As Uses Permitted& 1. Residential 2. One of two units residential; other unit permitted for use as professional office. First floor area Requirementss cP) For one story dwelling - 1,500 square feet of living areas d LLl It was the consensus of opinion of the board that the recommendations as CL to overlay areas and regulations be submitted with the specific request that °b they be thoroughly checked as to the legality by the City Attorney. 2 Since the City Zoning and Planning members have been discussing air port zoning, Chairman McKibbin, who is on the committee regarding County Air Port 0 Zoning, read a proposed resolution regarding certain areas to be restricted in 0 relation to the Naval Air Station runways. The areas being discussed or proposed at present area south of 25th Street; east of 17 -92 and west of Fake Jessup. The immediate area of the runway extensions have no restrictions. 2 & P Minutes Yaroh 20, 1958 - 4 Mr. MoPibbin stated that there would be a County Zoning Hearing in regards to air port zoning at 2s00 P.M. on the 8th of April at the Court House for interested board members.
