ZONING AND PLANNING COMMISSION
Regular Meeting
February 5, 1959
7:30 P.M.
City Hall
Members present were: Messers. McKibbin, Kirtley,
Faville, Talley, Morgan, Lee, and Johnson. Also present were:
City Manager Knowles and Building Inspector Yelvington.
Chairman McKibbin called the meeting to order.

Minutes of the meetings for December 4, 1958
and January 9, 1959 were read and stood approved.
Discussion of the board was then brought about by
the request of Mr. George Fouser to rezone from an R -1 area
to that of multiple family (R -2), Lots 6 and 7, Block 12,
Tier 6, E. R. Trafford's Map of the City of Sanford. Location
being the southeast corner of 10Q Street and Elm Avenue.

The board then had a lengthy discussion in regards tc
the area immediately surrounding this requested area; noting
one of the biggest factors being that this section contained
many old -type homes already housing non - conforming apartments.
Mr. Faville commented that the existing R -1 areas now
seemed to contain more of the older type homes, and that in his
opinion he could see no objection to having duplexes in the R -1,
single family, areas. He further questioned the fact as to
why the Zoning Ordinance could not be so amended and thus take
care of the duplex problem that has existed so long. The
majority of the board felt that with the aesthetics of the
present -day duplex construction, it seems that they would not
be objectionable in some single family areas, as for instance
in the R -1.
It was also mentioned that some consideration should
be given to creating a duplex district with the stipulation
that single family dwellings could also be placed in this same
area.
Concluding their discussion with the fact that this
area under discussion for Mr. Fouser has a trend toward re-

zoning, Mr. Faville moved that both sides of Elm Avenue, from
alley to alley, from 6Q Street to 13% Street be rezoned from
that of R -1 to that of multiple family, R -2.
Legal description being:
a. East one -half (1/2) of Blocks 8, 9 10,
11 12, and 13, and Lots land 2 of
Block 14, all in Tier 7.
b. West one -half (y2) of Blocks 8, 9, 10
11 12, and 13, and Lots 6 and 7 of
Block 14, all in Tier 6.
Motion seconded by Mr. Morgan and carried unanimously.
The Building Inspector then presented a request for
the off - street parking plan for James Peterson, new duplex
store at 1519 and 1521 W. 13b Street. Mr. Morgan moved that
a number of twenty (20) off - street parking spaces be approved.
Motion seconded by Mr. Johnson and carried.
The Building Inspector then asked the board members
if they would like to review the matter from the previous
minutes regarding possible amendment to: Section 6, Paragraph
D, (Front yard required), whereby the amendment could be made
as an addition to the paragraph as follows:
- -- "but, in no case shall the required front
yard exceed 35 feet ".
This amendment would of course apply to each section or paragraph
of the Zoning Ordinance regarding the front yard requirements
in the residential areas.
A lengthy discussion followed on whether the proposed
amendment as to a fixed or an average set -back on front yard
requirements would solve the majority of the Building Inspector's
problems. The matter was deferred until a discussion could be
held with the city planner.
There being no further business or discussions, the
meeting adjourned.
