Regular Meeting
February 19, 1959
Members present were: Messers. McKibbin, Kirtley, Karnes,
Talley, Harris, Johnson, Morgan, and Lee.
Also present werel: City Manager Knowles and Building
Official Yelvington.
Meeting Was called to order by Chairman Mcgibbin,
Mr. Max Johnson appeared before the board in regards to his
request to rezone from that of 0-1 to C -2 (Commercial- Industrial)
Lot 3, Block A, Buena vista Sub- division; location being the south
side of Celery Avenue, east of Mellonville Avenge, in order that
he might re- establish the use of his property for a mechanical
garage, since the structure on the property is of little value
only as a repair shop. However, the past use of the property,
since 1955, was the operation of a used car lot,
A discussion followed regarding locations of various filling
stations that were actually operating a so- called mechanical re-
pair service in conjunction with their station and in some cases
may be isolated in a commercial area, but were completely surrounded
by residential areas. Mr. Harris stated that the old conception
of a mechanical garage included paint and body work and that it
does not hold true in the present method of operation whereby they
are separate operations; and, therefore, he recommended that
mechanical garages be allowed in the commercial- retail zone, but
that paint and body shops continued to be excluded.
Mr. Morgan moved that under Section C -1, Paragraph 8 - "Uses
Permitted ", the phrase mechanical garages be deleted and "paint
and body shop" be inserted. Motion seconded by Mr. Johnson and
carried.
Mr. Frank George, Architect, appeared with his client Mr.
Gormley in regards to the possible acceptance of off - street park-
ing facilities for a new Gormley building located on the N.W.
corner of 3rd. Street and Palmetto Avenue, due to the fact that
at the present time the existing structure is termed a "temporary
structure" until the deadline of November, 1959, according to an
agreement made through the Board of Adjustment of the City of
Sanford.
Mr. George pointed out to the board that the property was
49.6 ft. in a north and south direction and 58 ft, running east
and west on 3rd. Street, which does not include the required 20-
foot on the rear, which could still be maintained. He also ex-
plained that to the rear of the Gormely's building, but between
Gormley's and the alley was a 1 -)k story frame building. There-
for, off- street parking to the rear was impossible. An appliance
store building with a roofed patio in the front is the proposed
design. Mr. Gormley mentioned that he had two employees, including
himself, plus two delivery trucks, which he had been parking on
the front for the present loading and unloading.

Mr. Yelvington mentioned that in solving the ordinance re-
quirement, a retail business must be housed within a building,
he had approved of the outdoor patio being enclosed with a chain
fence.
Mr. George then asked the board members to consider the
possibility of off - street parking whereby Mr. Gormley could widen
and pave the parkway on the south side of his property.
After considerable discussion on the previous off - street
parking plan where only 2 to 3 cars, and possibly 4, could park in
the space, Mr. Morgan moved that the following recommendation for
off - street parking for the area be approved:
Widen and pave, at Mr. Gormley's expense, the
north side of 3rd. Street from the proposed
access road into the property east to Palmetto
Avenue; with the stipulation that the widening
and paving would be kept within the City's
specifications.
Motion seconded by Mr. Lee and carried.
Mr. Harris brought to the board's attention his previous
discussion and comments regarding homes constructed on corner lots;
this being a situation where the owner or builder would have the
choice of turning the house around and thereby ch*ing.his own
front yard, other than as platted, as long as the required set backs
were maintained.
Mr. Harris then entered a motion to amedd the Zoning Ordinance
regarding requirements pertaining to front and rear yard on corner
lots with the following recommendation:
"On a corner lot either yard facing the
street may be considered front yard; opposite
selected front is rear ya c�-=R
Motion was seconded by Mr. Morgan and carried.
However, Mr. Yelvington, Building Official, stated that he
wished to go on record as definitely opposing this recommendation
in that, "due to the way our other requirements are written in the
Zoning Ordinance pertaining to 'accessory buildings', they can
and in all probability would, if the owner so chooses, be built
right on the front line of the property ". Mr. Yelvington was
pointing out to the board that with this recommendation, the prop-
erty owner of a corner lot could jeopardise the adjacent property
owner by placing a little red barn right out to the front line of
his property, if he so wished.
After considerable discussion, Mr. Harrip conceded to Mr.
Yelvington's opposition of the recommendation and, therefore,
requested the Chairman to ask for approval to rescind his motion
regarding homes on corner lots.

Mr. Morgan, as a second to the motion, was agreeable that the
recommendation be rescinded, which was also agreeable to the board.
Mr. Yelvington suggested that it might be well for the board
to think about the possibility of setting a minimum front line
requirement and then let the people do as they please. Chairman
McSibbin felt that the present ordinance should be amended so that
no construction would be allowed between the street and the front
building line of the house.
Mr. Harris stated that our present system or requirement has
become obsolete and under present construction of homes in the
various sub - divisions, it does not apply to the best advantage,
and will prove itself so as the corporate city limits expands.
Mr. Yelvington then brought to the board's attention the off -
street parking approval for a self- service laundry, corner of Olive
and W. 136 Street. After viewing and discussing the proposed plans.,
Mr. Morgan moved that sixteen (16) off- street parking spaces be
approved. Motion seconded by Mr. Harris and carried.
The minutes of the board date. February 5, 1959, were read
and approved.
There being no further business before the board, Mr. Morgan
moved for adjournment. Motion seconded by Mr. Johnson and carried.
