The violations noted must be addressed before the plans can be approved. Changes to plans shall be submitted on the same size format as the original submittal. Changes to construction documents that require an Architect or Engineer's seal must be submitted with the appropriate seal. Provide two copies of affected plan sheets and /or supplemental information as requested. COMMENTS: The document you submitted as a "Scope of Work" is actually a bid proposal and as such, does not provide a clear and concise detail on what work you are actually performing. In order to approve a permit, I need further clarification on the issues below. 1. The "Exterior" section lists installing new soffit around the house. Is this soffit aluminum, vented, plywood? Please provide the exact type of soffit that will be installed around the house. If the soffit is aluminum, please provide two copies of Florida Product Approval and manufacturer installation instructions for review. FBC 107 2. The "Exterior" section suggests replacing an exterior door. Please specify if an exterior door will be replaced and if so, please provide two copies of Florida Product Approval and manufacturer installation instructions for review. FBC 107 3. The "Kitchen" section indicates that the kitchen layout will be changing. Please provide an existing layout and a proposed layout of the kitchen and provide the following information on the proposed drawing: a) How will the new cook top /range receive power? b) For the new countertop space where the new cook top will be installed, receptacles are required within 24 inches of the range on each side in accordance with NEC210.52(3)(C) and must be GFCI protected in accordance with NEC210.8. c) A receptacle is required on the living room side of the new wall where the cook top will be installed in accordance with NEC210.52(A)(2). d) On the proposed layout, please indicate how many new recess cans will be installed and the location of the switch. FBC 107 -1- 4. The `Main Bath" section indicates that a new exhaust fan will be installed and the exhaust duct will be vented out of the soffit. If the soffit is vented aluminum, the exhaust cannot discharge through the soffit in accordance with FBCR M1501.1 and M1507.2. The only way a bathroom exhaust can discharge through a soffit is if there are no openings in the soffit within 3 feet to any side. Please verify and revise accordingly. FBC 107 5. The "Mini Hallway" section indicates that an attic access will be created. Please provide the size of the attic access and show that a switched lighting outlet will be installed, in accordance with NEC210.70(A)(3) FBC 107 6. The "Mini Hallway" section indicates that new ductwork will be installed. Please provide a duct layout that shows the new ductwork, the size of the duct, and register size. FBC 107 7. The "Bedroom" section indicates a new "jack vent" will be installed and the existing supply register will be moved. Please indicate this on a duct layout. FBC 107 8. The "Rear Bath" section indicates a new exhaust fan to be installed and vented through the soffit. Please see #4 of these comments and revise accordingly. FBC 107 9. The "Rear Bath" Shower appears to show a completely rebuilt and /or resized shower space. Please provide a proposed shower detail indicating the size of the shower and any changes to the existing walls that will take place. 10. The "Laundry Room" section calls for a GFCI plug for the laundry. Is this a new receptacle or existing? Please clarify. FBC 107 11. Please place a note either in the new scope of work or on the floor plan that smoke detectors will be installed throughout the house, as required for new construction and in accordance with FBCR R314. FBC 107 ** Based on the comments above, further documentation is required to be submitted for review. - Please submit two copies of an existing floor plan and two copies of a proposed floor plan indicating the state of the existing work areas and what you intend to construct in the new work areas. Alternatively, separate details of each work space (kitchen, bathrooms, laundry) can be submitted. - The electrical information needs to be provided on this floor plan, as requested in the comments. - For a duct layout, the floor plan can also be used. - Please provide a new scope of work that details the code related items only. As previously stated, a scope of work has not been provided; only a bid proposal. Painting and cosmetic work does not need to be detailed in the scope of work. ARTICLE II SCHEDULE AND TIME OF PERFORMANCE A. Contractor will begin work on June 13, 2014 to be completed by June 30, 2014. B. As this project is time sensitive, Contractor will be assessed a fee of One Hundred Dollars ($100) per day for each day that work is not completed after the final deadline of May 28, 2014, unless Client consents to a specified extension. Additional damages will be assessed and liquidated damages will be deducted from the total payment amount due to Contractor under the payment schedule specified in this Contract. C. In the event that Client and Contractor agree on changes to the Project after this Contract is executed, the Parties will agree to new time deadlines that are reasonable in light of the modifications. ARTICLE III PAYMENT SCHEDULE A. In consideration of the performance of this Contract, Client agrees to pay Contractor the sum of TEN THOUSAND FOUR HUNDRED AND THIRTY FIVE DOLLARS AND ZERO CENTS ($10,435.00) (the "Contract Price ") on the following payment schedule for the services. B. After receiving notification by Contractor of each stage of completion, Client or its designee will inspect and approve the work or request any necessary adjustments to same. Payment shall only be adjusted upon the mutual consent of both Parties if due to unforeseen events or the parameters of the work are expended materially beyond the terms of this Contract. This Contract and associated fees will be modified accordingly. ARTICLE IV CHANGES TO THE WORK A. All changes or modifications to the work ordered by Client must be made in writing, with appropriate adjustments made to the total payment and payment schedule. The approval of both Parties shall be required for substantial project changes such as the date of completion, project price, and substantive modifications to the project itself, and notification of these changes must be made in a timely manner. B. If these changes should require additional expense to Contractor, Contractor must make a claim for increase in payment, in writing, to Client, in a timely manner. Client must approve this claim for increase in writing prior to any changes to the work, project, or schedule. ARTICLE V DELAYS A. If Contractor is delayed from completing required work due to unavoidable casualties, Client shall grant Contractor an extension for the completion of work equal to the delay. Unavoidable casualties include, but are not limited to, fire, flood or natural disasters, delayed acquisition of materials or material delivery, and negligence on the part of Client. B. In the event of unavoidable casualties, Contractor shall properly document both the event and the impact of that event on project completion. Documentation shall be presented to Client in a timely manner. ARTICLE VI RIGHT TO STOP WORK A. If Contractor fails to correct defective work or persistently fails to supply materials or equipment in accordance with the Contract Documents, Client may order Contractor to stop the work, or any portion thereof, until the cause for such order has been eliminated. ARTICLE VII ACCESS AND CONDITION OF PREMISES A. Free access to the work and project site shall be granted by Contractor to Client, the designated agents of Client, and all necessary public authorities. B. Contractor agrees to keep the premises clean and orderly. Contractor shall remove all debris as needed during the hours of work in order to maintain work conditions free of health or safety hazards. ARTICLE VIII WORK PERFORMANCE AND WORK QUALITY A. Contractor shall conduct its activities in a professional manner and adhere to the reasonable wishes of Client in relation to its working schedule. Additionally, Contractor's work shall adhere to and be in compliance with both the Standard Practices of the Trades and any relevant Manufacturers Specifications. B. Contractor shall protect all work adjacent to the Project site from any damage resulting from the work of Contractor and shall repair or replace any damaged work at its own expense. Contractor shall take all precautions to protect persons from injury and unnecessary interference or inconvenience. ARTICLE IX WARRANTY A. Contractor hereby warrants that the work performed and the Project completed will meet the standards set forth and agreed upon by the Parties. Contractor agrees to fix and otherwise remedy any defects found by Client in the work within 1 year after the date of final completion at Contractor's own cost. B. Contractor is only responsible for damage resulting to the Project from negligence, dangerous activities, intentional disregard of professional standards of care normally exercised within the industry, or breach of any governmental statute, ordinance, local rule, or law. ARTICLE X LICENSES AND PERMITS A. Contractor and Client agree that no permits are necessary for this project. ARTICLE XI FINES A. Contractor is responsible for maintaining proper work, safety, and environmental protection standards. Contractor agrees to hold Client harmless for all fines from federal, state, or local agencies and regulators. Contractor will work in compliance with all standards required by the EPA, OSHA, and other applicable federal agencies. Contractor will be responsible for paying all fines and judgments levied by these agencies resultant from the performance of this Contract. ARTICLE XII RELATIONSHIP OF PARTIES A. The relationship created between the Parties shall be limited to that of independent contractors. Neither party shall undertake any actions that would imply or seek to establish, any partnership, ownership, employment, joint venture, or trust relationship between the Parties, except by amendment to this Contract. ARTICLE XIII ARBITRATION A. Any dispute or claim related to or arising from this Contract, its performance, breach, interpretation, validity, or enforceability, shall be exclusively (except as provided below) resolved by final binding arbitration before the American Arbitration Association (AAA), utilizing AAA Commercial Arbitration Rules. B. The arbitrator shall be selected using AAA procedures. The arbitrator shall render a written decision within thirty calendar days of the hearing. The arbitrator may award attorneys' fees or punitive, incidental, consequential, treble, or other multiple or exemplary damages. C. Awards shall be final, binding, and non - appealable, with the exception of the grounds for appeal guaranteed by the Federal Arbitration Act and applicable laws.
