This Utility Easement is made and entered into this day of

other good and valuable conaideradion, the receipt and sufficing of which is hereby
aoknow|edged. GRANTOR does hereby grant and convey tothe GRANTEE and its aeeigna, on
exclusive easement and right-of-way for utility purposeo, with full authority to enter Vpon,
excavmto, construct and nnaintain, as the GRANTEE and its assigns may deem neceoeary,
electrical po|es, telephone po|ao, wires, utility |inoo, guy wires and eppurtenencea, ditohea,
water pipae, eavver pipee, gas pipes and rneine. communication lines and haci|itiee, oidevvo|ke,
access roads and any other utility facilities, and associated foci|itime, over, under, upon and
through the following -described lands situate in the County of Seminole, State of Florida, to-
wit:

That east west alley which is 16 feet in width and king north ofHighway and
south ofNo right-of-ways, west cfCypress Avenue and east of Sanford
Avenue as platted as part of Ginden/i||e Heightm, as recorded in Plat Book 4,
Page 42 of the Public Records of Seminole County and as shown on Exhibit "A"
(Pictorial Map).
To Have And To Hold the right to reasonably enter upon the contiguous lands of the
GRANTOR in order to accomplish the aforesaid actions and free ingress and mgnaae over and
across the said property.
Further, To Have And To Hold said easement and hg unto said GRANTEE
and its assigns forever.
The GRANTEE and its assigns shall have the right toclear, keep clear and remove from
said right-of-way all tnaee, undergroxth, and other obstructions that may interfere with |ocadOn,
exuovotion, operation or maintenance of the utilities or any facilities installed thereon by the
GRANTEE and its aeoigne, and the GRANTC>F{, and the eucneeeone and assigns of the
GRANTOR, agree not to build, construct or create, or permit others to build, construct or create

any buildings or other structures on the said easement and/or right-of-way that may interfere
with the location, excavation, operation or maintenance of the utilities, or any facilities installed
thereon, unless approved by the City after other adjacent property is assembled and/or the
property owner has made any required utility adjustments or arrangements for impacted or
future City services or needs. The owner shall move, or cause to have move, as required by the
City, any structure or other improvements within the vacated right of way for any required City
services improvements or required maintenance activity within the vacated alley acceptable by
the City.
Together With all other Common Law covenants of seisin, the conveyance also
includes the covenant of further assurances and it is acknowledged by the GRANTOR that the
doctrine of after acquired title may be applicable to this conveyance.
