Mr. Singeisen called the workshop meeting to order at 5:06, PM.
Ms. Tebo handed out examples of code violation notices to the Board. She explained the
difference between the Code Enforcement Process and the Warning Process. She said the
Warning came first and had to be in person. There is a 30 -day time limit, and after time
expires, if the violator has not complied, they may be cited. The Code Enforcement
Process includes going before the Code Enforcement Board. She stated that the Code
Enforcement inspectors usually talk to the citizen first, check with Ms. Gerli, then, if
there are no results, write the warning. Mr. Myers said they had discussed in the past a
punitive fine for people who went before the Historic Preservation Board after the fact.
Ms. Gerli said after the fact permits cost a double permit fee. Mr. Myers noted that many
people come before the Board claiming to be ignorant of the codes, and he didn't think
they really were. Also, there is the question of the infraction being irreversible. Ms.
Tebo said that an irreversible infraction would be given a citation and a $50.00 ticket, but
would not go before the Code Enforcement Board.
Mr. Myers said he would like to see an HPB process established for this circumstance.
In answer to a question, Ms. Tebo stated that there could be a two- to ten -month time
frame on a violation, depending on what a "reasonable time" is and whether or not the
customer receives the certified letter in a timely manner.
Ms. Gibbs asked if it is an infraction to tear off a front porch without a permit or an
approval from the HPB, and was told that the infraction would have to be something
really serious before Code Enforcement would ticket the customer.
Ms. Shreve asked what the HPB recourse is when a C of A is issued with stipulations,
and the customer doesn't comply. Ms. Tebo told her it would be a violation of Schedule
S, and there could be a ticket issued. Mr. Singeisen asked if the C of A becomes part of
the package, and was told it did, and the inspectors would look at the HPB- approved
work, along with the rest.
Mr. Singeisen stated that he saw a future problem in that some people in the Historic
District ignore problems until the building needs to be torn down, and then they get a
condemnation. Ms. Shreve asked what the recourse is for burned buildings, and was told
they usually are condemned.
Mr. Singeisen asked if there was a report on Lighting Guidelines, and was told there was
not. It will be postponed for discussion next month. The Education Committee did not
have a report, nor did the Materials Committee.
Mr. Singeisen welcomed their new Board member, Tom Goodman. Mr. Goodman
introduced himself and gave a brief background.
Mr. Singeisen asked to appoint the Selection Committee for the consultant that will
rewrite Schedule S. Mr. Singeisen recommended one member from each committee, and
two people from the Board at large. Mr. Singeisen, Ms. Shreve, Mr. Then, Ms. Gibbs,
and Mr. Goodman, with Mr. Sylvester as an alternate will be on the selection committee.

Mr. Singeisen called the meeting to order at 6:06, PM.
Mr. Singeisen asked for approval of the April 11 minutes. A correction was requested for
Item 4b. Ms. Farrell motioned to approve. Ms. Gibbs seconded. Motion carried 10 -0.
Item 4a, 207 E. 11 th Street. Rachel Cheek was there to present. Ms. Cheek asked Ms.
Gerli what she had found out regarding her application. Ms. Gerli said that Engineering
would not recommend approval of a new curb cut. Ms. Cheek asked her who she needed
to talk to in order to get one, and was told that there are no variances given for parking on
the ROW. Mr. Singeisen told her that her application was to install a curb cut; did she
have an alternate plan, or should the Board act on the request as is? Ms Cheek said she
would like to look into the matter further. Mr. Singeisen stated that for record - keeping
purposes, the Engineering Department recommends not approving ROW use. He
recommended that she withdraw her application at this time, and she did.
Item 4b, 317 S. Oak Avenue. Angela Toney, continued from April 11, 2002 meeting.
Darrel Duncan presenting: request to move house from 317 Oak Avenue to 1205 Elm
Ave. He was asked for a site plan. He said he did not have one at this time, as Ms.
Toney is waiting for HPB approval before she goes to any great expense. Ms. Valente

said she had one. Ms. Gibbs said that a house probably could not be put on the property,
as legally it has unity of title, and it could be a non - conforming lot. Mr. Singeisen said
that the Board should really wait until Ms. Toney could be present.
Mr. Myers moved to table the item. Seconded by Stevens. Motion carried 10 -0.
Item 4c, 618 S. Oak Avenue, extend wooden fence to enclose back yard. Georgia Hart
presenting. Mr. Sylvester asked if the parking slab would stay the same, and was told it
would, and it would be gated.
Mr. Myers moved to approve. Ms. Farrell seconded. Motion carried 10 -0.
Item 4d, 603 S. Oak Avenue, to install a shed and fence. Darrel Duncan was there to
present. Mr. Singeisen asked if the new shed would be enclosed by the new fence. Mr.
Duncan showed the board pictures of what he proposed to do.
Ms. Farrell motioned to approve. Ms. Gibbs seconded. Motion carried 10 -0.
Item 4e, 806 S. Magnolia Avenue, to install a fence, Mary Larsen presenting. Ms.
Larsen handed out drawings and she had examples of paint colors and a fence post cap
she wanted to use. The fence would be 47" high and painted green. It was suggested that
she use a stain that would help protect the wood instead of paint.
Ms. Kelly motioned to approve. Seconded by Mr. Myers. Motion carried 10 -0.
Item 4f, 610 Magnolia Avenue, to install an aluminum shed. Mr. and Mrs. Newton
were there to present. Mr. Myers asked what the current size limits are, and was told 100
square feet.
Ms. Kelly motioned to approve with the condition that the shed be limited to 100 square
feet. Seconded by Ms. Gibbs. Motion carried 10 -0.
Item 4g, 311 Park Avenue, to remove rear addition of house. Ronald and John
Hernandez were there to present. They stated that they want to remove the entire back
addition. They will replace siding to match what is already there. Ms. Farrell motioned
to approve. Ms. Shreve seconded. Motion carried 10 -0.
Item 4h, 321 S. Magnolia Avenue, to replace porch posts, add brackets and gable wings,
install gutters and downspouts, and add to the rear fence. Ms. Alesandra Saunders was
there to present for Steve and Lee Richarde. Ms. Kelly had seen a picture of what the
original house looked like, and said it did have turned posts. Mr. Singeisen asked Ms.
Stevens to address the issue of the vinyl fence, as she is on the Materials Committee. She
said that anything past the side of the house had to be of wood, or it would have to be
obscured by landscaping.

Mr. Myers made the motion to approve with the conditions that the fence be made of
wood from the house line to the sidewalk, and that it be no taller than 4'. Ms. Stevens
seconded. Motion failed 5 -5.
Ms. Gibbs motioned to approve the application with the exception of the scrolled
brackets and wing ends. Ms. Farrell seconded. Motion carried 10 -0.
Item 4i, 1201 S. Oak Avenue, to move a window and add windows to the back of the
house. Mr. Rey Sylvester of 1815 S. Sanford Avenue presented. He brought hand -outs
of the planned improvements and elevations and gave them to the Board. He plans to
move one window and add a window at the back of the house. Mr. Singeisen pointed out
that this application was for the continuation of the porch to the end of the house;
removal of the door was already approved. Mr. Sylvester explained that he was replacing
the windows because they had rotted. The motion was made by Ms. Valente to approve.
Ms. Stevens seconded. Motion carried 10 -0.
Mr. Singeisen asked if there were any concerns from the Board members.
Ms. Stevens — The Vilhein house still has metal doors, and the gray house on Magnolia
Avenue, 300 block, still has metal doors. Also, the house at 1111 Magnolia Avenue still
has their art glass. Ms. Gerli said she would check on these.
Mr. Sylvester — Would like to see a database established with photos taken once a year.
Ms. Gibbs told him that there is one, and the Trust has it. She also pointed out that Code
Enforcement does a sweep of the area when a complaint is received. Ms. Gerli added
that we now have Saturday Code Enforcement.
Ms. Shreve — Would like to see something in the S Code that puts a time limit on how
long one can leave plywood over their windows. She said it made her very sad to see this
happen in the District. Ms. Gerli said she would talk to Ms. Tebo about this issue.
Mr. Singeisen - He would like to send a letter of appreciation to Bob Kuhn and Melanie
Winternheimer.
There being no further business, the meeting was adjourned at 7:50 PM.
