IN ORDER TO MEET NPDES REQUIREMENTS,THE CONTRACTOR IS RESPONSIBLE FOR PREPARING A STORMWATERPOLLUTION PREVENTION PLAN (SWPPP), IMPLEMENTING, INSPECTING,MAINTAINING, AND REPORTING ON ALL ELEMENTS OF THE SWPPP,COMPLETING AND SUBMITTING THE REQUIRED NOTICE OF INTENT (NOI) ANDNOTICE OF TERMINATION (NOT) FORMS AS THE OPERATOR, AND PAYING ALLASSOCIATED FEES. FOR PROJECTS LESS THAN 1 ACRE IN SIZE THAT ARENOT REQUIRED TO COMPLY WITH THE NPDES GENERAL PERMIT, THECONTRACTOR IS STILL RESPONSIBLE FOR IMPLEMENTING AND MAINTAININGEROSION AND SEDIMENT CONTROL MEASURES PRIOR TO AND DURINGCONSTRUCTION IN ACCORDANCE WITH THE DRAWINGS ANDSPECIFICATIONS.3. UNLESS OTHERWISE NOTED ON THE PLANS, THE CONTRACTOR SHALL USETHE GEOMETRY PROVIDED ON THE CONSTRUCTION PLANS. BENCHMARKINFORMATION SHALL BE PROVIDED TO THE CONTRACTOR BY THE OWNEROR OWNER'S SURVEYOR. ANY DISCREPANCIES BETWEEN FIELDMEASUREMENTS AND CONSTRUCTION PLAN INFORMATION SHALL BEBROUGHT TO THE ATTENTION OF THE ENGINEER IMMEDIATELY.4. THE CONTRACTOR SHALL SUBMIT (6) COPIES OF SHOP DRAWINGS TO THEENGINEER FOR APPROVAL PRIOR TO ORDERING THE MATERIALS REQUIREDFOR CONSTRUCTION. PRIOR TO SUBMISSION, THE CONTRACTOR SHALLTHOROUGHLY CHECK SHOP DRAWINGS, PRODUCT DATA, AND SAMPLESFOR COMPLETENESS AND FOR COMPLIANCE WITH THE CONSTRUCTIONPLANS AND SHALL VERIFY ALL DIMENSIONS AND FIELD CONDITIONS ANDSHALL COORDINATE THE SHOP DRAWINGS WITH THE REQUIREMENTS FOROTHER RELATED WORK. THE CONTRACTOR'S RESPONSIBILITY FORERRORS AND OMISSIONS IN SUBMITTALS IS NOT RELIEVED BY THEENGINEER'S REVIEW OF SUBMITTALS. THE CONTRACTOR SHALL NOTIFYTHE ENGINEER, IN WRITING AT THE TIME OF SUBMISSION, OF DEVIATIONS INSUBMITTALS FROM THE REQUIREMENTS OF THE CONTRACT DOCUMENTS.5. PROTECT BENCHMARKS, PROPERTY CORNERS, AND OTHER SURVEYMONUMENTS FROM DAMAGE OR DISPLACEMENT. IF MARKER NEEDS TO BEREMOVED IT SHALL BE REFERENCED BY LICENSED LAND SURVEYOR ANDREPLACED, AS NECESSARY, BY SAME.6. THE CONTRACTOR IS RESPONSIBLE FOR ALL QUALITY CONTROL TESTING.AS A MINIMUM, TESTING SHALL INCLUDE A) PIPING AND STRUCTURALEXCAVATION, BEDDING AND BACKFILL MATERIALS AND DENSITY TESTS; B)DETERMINATION OF COMPACTIVE EFFORT NEEDED FOR COMPLIANCE WITHTHE DENSITY REQUIREMENTS; C) PORTLAND CEMENT CONCRETE ANDASPHALT PAVING QUALITY CONTROL TESTING INCLUDING DESIGN MIXREVIEW, MATERIALS, FIELD SLUMP AND AIR CONTENT, AND FIELD AND LABCURED STRENGTH SAMPLES AND TESTING.7. IN ADDITION TO QUALITY CONTROL TESTING, THE CONTRACTOR SHALL BERESPONSIBLE FOR REQUIRED TESTING OR APPROVALS FOR ANY WORK (ORANY PART THEREOF) IF LAWS OR REGULATIONS OF ANY PUBLIC BODYHAVING JURISDICTION SPECIFICALLY REQUIRE TESTING, INSPECTIONS ORAPPROVAL. THE CONTRACTOR SHALL PAY ALL COSTS IN CONNECTIONTHEREWITH AND SHALL FURNISH THE OWNER AND ENGINEER THEREQUIRED CERTIFICATES OF INSPECTION, TESTING OR APPROVAL.8. ANY DESIGN OR TESTING LABORATORY UTILIZED BY THE CONTRACTORSHALL BE AN INDEPENDENT LABORATORY ACCEPTABLE TO THE OWNERAND THE ENGINEER, APPROVED IN WRITING, AND COMPLYING WITH THELATEST EDITION OF THE "RECOMMENDED REQUIREMENTS FORINDEPENDENT LABORATORY QUALIFICATION", PUBLISHED BY THEAMERICAN COUNCIL OF INDEPENDENT LABORATORIES.9. TESTING RESULTS SHALL BE PROVIDED TO THE OWNER/OPERATOR ANDTHE ENGINEER. ALL TEST RESULTS SHALL BE PROVIDED (PASSING ANDFAILING) ON A REGULAR AND IMMEDIATE BASIS.10. PRIOR TO CONSTRUCTION, THE CONTRACTOR SHALL MAKE APRE-CONSTRUCTION VIDEO (DVD FORMAT) ALONG THE PROPOSED ROUTEIN ACCORDANCE WITH THE SPECIFICATIONS. IN PARTICULAR, THE VIDEOSHALL DOCUMENT THE CONDITION OF EXISTING DRIVEWAYS, BUILDINGS,STRUCTURES, MAILBOXES, SIGNS, FENCES, AND LANDSCAPING ALONGPROPOSED CONSTRUCTION AREAS.11. THE ENTIRE PROJECT SITE SHALL BE THOROUGHLY CLEANED AT THECOMPLETION OF THE WORK. CLEAN ALL INSTALLED PIPELINES,STRUCTURES, SIDEWALKS, PAVED AREAS, ACCUMULATED SILT IN PONDS,PLUS ALL ADJACENT AREAS AFFECTED BY CONSTRUCTION, AS DIRECTEDBY THE OWNER OR JURISDICTIONAL AGENCY. EQUIPMENT TO CLEAN THESESURFACES SHALL BE SUBJECT TO APPROVAL BY THE OWNER.AS-BUILT DRAWING REQUIREMENTS1. CONTRACTOR IS RESPONSIBLE FOR FDEP DEWATERINGPERMIT FOR ANY WATER DISCHARGES.4. CHEMICALS, PAINTS, SOLVENTS, FERTILIZERS, AND OTHER TOXIC MATERIALMUST BE STORED IN WATERPROOF CONTAINERS. EXCEPT DURINGAPPLICATION, THE CONTENTS MUST BE KEPT IN TRUCKS OR WITHINSTORAGE FACILITIES. RUNOFF CONTAINING SUCH MATERIAL MUST BECOLLECTED, REMOVED FROM THE SITE, TREATED, AND DISPOSED AT ANAPPROVED SOLID WASTE OR CHEMICAL DISPOSAL FACILITY.5. THE DISCHARGE OF HAZARDOUS SUBSTANCES OR OIL IN THESTORMWATER DISCHARGE(S) FROM A FACILITY OR ACTIVITY SHALL BEPREVENTED.
