AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
AMENDING ORDINANCE NO. 3117 OF SAID CITY; SAID
ORDINANCE BEING A ZONING PLAN; SAID AMENDMENT
TO CHANGE THE ZONING OF A PORTION OF THAT
CERTAIN PROPERTY LYING BETWEEN ROSE HILL TRAIL
EXTENDED EASTERLY AND PINE WAY AND BETWEEN
SOUTH MELLONVILLE AVENUE AND SOUTH SAN FORD
AVENUE, FROM AG, AGRICULTURAL TO PD, PLANNED
DEVELOPMENT; PROVIDING FOR SEVERABILITY,
CONFLICTS AND EFFECTIVE DATE.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
SANFORD, FLORIDA:
SECTION 1: That Ordinance No. 3117 of the City of Sanford, Florida passed and
adopted July 27, 1992, said Ordinance being the Comprehensive Zoning Ordinance of the
City of Sanford, Florida, regulating and restricting the location and use of buildings,
structures, land, and water for trade, industry, residence or other purpose, be and the
same is hereby amended as follows:

be and the same is hereby rezoned to PD, Planned Development, zoning district and the
Planned Development Master Plan is attached as Exhibit "B" is included herein by
reference as if fully set forth herein. Additional conditions of development are as follows:
a. That all development be in accordance with the Westlake Plantation
and Rose Hill Phase II Master Plan (Latest Revision Date 11-11-99).
b. That adequate additional right-of-way on Sanford Avenue and Pine
Way be dedicated to Seminole County as part of the platting process.
c. That the Developer shall coordinate Westlake Plantation
development access with Seminole County in relationship to possible
alternative routes to Sanford Avenue/Lake Mary Boulevard
Intersection.
That this approval shall expire and the zoning will revert to AG,
Agricultural, if substantial development in conformity with the
Westlake Plantation and Rose Hill Phase II Master Plan does not
occur within five (5) years from the date of approval.
That the Developer participate in funding a fair and equitable share
of improvements related to the intersection of Sanford Avenue and
East Lake Mary Boulevard.
That the Developer provide a six foot wall faced with real brick
adjacent to Pine Way.
That the Developer provide fencing between the project and Mrs.
Cox's five acre property where horses are kept, generally located on
the east side of the Rose Hill Phase 2 lots.
That the Developer provide a wooden fence to visually separate
Westlake Plantation project from existing residential properties on the
west side of the project, generally in the northwestern and
southwestern boundaries (including the Franks' property).
That all homes must be a minimum of 1,700 square feet of habitable
air conditioned space.
SECTION 2: Severability. If any section or portion of a section of this Ordinance
proves to be invalid, unlawful or unconstitutional it shall not be held to impair the validity,
force or effect of any other section or part of a section of this Ordinance.
SECTION 3: Conflicts. That all ordinances or parts of ordinances in conflict
herewith be and the same are hereby revoked.
SECTION 4: Effective Date. That this Ordinance shall become effective
immediately upon its passage and adoption.
