AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
AMENDING ORDINANCE NO. 3117 OF SAID CITY; SAID
ORDINANCE BEING A ZONING PLAN; SAID AMENDMENT
TO CHANGE THE ZONING OF A PORTION OF THAT
CERTAIN PROPERTY LYING BETWEEN 19t" STREET AND
COUNTRY CLUB ROAD AND BETWEEN COUNTRY CLUB
CIRCLE AND OLD LAKE MARY ROAD, FROM MI-2,
MEDIUM INDUSTRIAL, RI-1, RESTRICTED INDUSTRIAL
AND SR-1, SINGLE FAMILY RESIDENTIAL, TO PD,
PLANNED DEVELOPMENT; PROVIDING FOR
SEVERABILITY, CONFLICTS AND EFFECTIVE DATE.
WHEREAS, the City has received a request to rezone property located at 2150
Country Club Road, to PD, Planned Development, based on consistency with and support
of Comprehensive Plan Policies related to improved water storage to relieve area flooding
and reduce flow rates into the Mill Creek and Cloud Branch drainage basins.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
SANFORD, FLORIDA:
SECTION 1: That Ordinance No. 3117 of the City of Sanford, Florida passed and
adopted July 27, 1992, said Ordinance being the Comprehensive Zoning Ordinance of the
City of Sanford, Florida, regulating and restricting the location and use of buildings,
structures, land, and water for trade, industry, residence or other purpose, be and the
same is hereby amended as follows:

be and the same is hereby rezoned from MI-2, Medium Industrial, RI-1, Restricted.
Industrial and SR-1, Single Family Residential to PD, Planned Development zoning
district, and the Planned Development Master Plan, attached as Exhibit "B," is included
herein by reference as if fully set forth herein. Additional conditions of development are
as follows:

All development shall be consistent with the Planned Development Project
Master Plan entitled "Bishop and Buttrey Excavation No. 103" dated August
9, 1999, and all supplementary information submitted thereof.
Unless otherwise specified on the Bishop and Buttrey Excavation No. 103
Plan, all development and mining operations shall comply with the Sanford
Land Development Regulations, specifically Schedule E, Section 11.0,
Mining and Excavation and Schedule J, Landscape, Buffer and Tree
Requirements.
All mining, related operations and site restoration shall be completed and
ceased within one year after the completion of the "Missing Link"
Expressway. This approval shall expire if this project is not commenced
within one year after construction of the "Missing Link" Expressway segment
is commenced.
A 6' high chain link fence with barbed wire top shall be installed around the
completed project.
A maintenance berm around the pond shall be provided allowing mowing
and maintenance equipment to access the site.
All required federal, state, regional and local permits are required to be
submitted to the City prior to issuing a Site Development Permit, including
but not limited to SJRWMD, Army Corps of Engineers, Florida Department
of Environmental Protection, EPA-NPDES, etc.
Design of earthen weir structures shall be hardened with 5" concrete slab
along pond sides adjacent to the wetlands.
Engineering plans shall depict all water and sewer utilities within 50' of
property and city owned former ACL Railroad right-of-way (known as Big
Inch).
Vehicles used in the operation of the site shall comply with all federal, state
and local laws including the Florida Department of Transportation (FDOT).
No muck shall be placed in the bottom of Pond 1 around ditch or the pond
outfall structure.
A letter to the Sanford Police Department from current owners will be
provided stating that they will press charges against persons caught

trespassing or committing other criminal acts on or to .the property.
The developer shall make certain that access will not be available to
neighborhood children during construction through fencing and other
appropriate means.
The developer agrees to comply with those certain contingencies set forth
in that certain Vacant Land Contract between Bishop & Buttrey, Inc., and the
City of Sanford, dated July 27, 1999.
SECTION 2: Severability. If any section or portion of a section of this Ordinance
proves to be invalid, unlawful or unconstitutional it shall not be held to impair the validity,
force or effect of any other section or part of a section of this Ordinance.
SECTION 3: Conflicts. That all ordinances or pads of ordinances in conflict
herewith be and the same are hereby revoked.
SECTION 4: Effective Date. That this Ordinance shall become effective
immediately upon its passage and adoption.
