AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
AMENDING ARTICLE I OF CHAPTER 11 OF THE CODE
OF THE CITY OF SANFORD,FLORIDA; SAID CHAPTER
BEING ENTITLED "GARBAGE, TRASH AND WEEDS";
SAID AMENDMENT PROVIDING FOR THE USE OF
PLASTIC BAGS AS A CONTAINER FOR THE STORAGE
AND COLLECTION OF GARBAGE AND REFUSE; PROVIDING
FOR USE OF WATERTIGHT RECEPTACLES OF NOT MORE
THAN THIRTY (30) GALLON CAPACITY FOR THE STORAGE
AND COLLECTION OF GARBAGE AND REFUSE; PROVIDING
FOR CURBSIDE.PICKUP¢'DFGARBAGE'~ND REFUSE;
PROVIDING FOR PLACEMENT OF YARD TRIMMINGS, GRASS,
LEAVES AND WEEDS IN CONTAINERS FOR CURBSIDE
PICKUP AND FOR PICKUP OF LIMBS OF NOT MORE THAN
FIVE (5') FEET IN LENGTH; PROHIBITING THE
SCATTERING OF REFUSE UPON ANY STREET, SIDEWALK,
ALLEY, SEWER, PARKWAY OR OTHER PUBLIC PLACE;
REQUIRING PROPERTY OWNER TO BE RESPONSIBLE FOR
THE REMOVAL OF TRASH, BUILDING MATERIAL AND OTHER
RUBBISH INCIDENT TO CONSTRUCTION ON PRIVATE
PROPERTY; PROVISION FOR SPECIAL HANDLING AND
DISPOSITION OF MOTOR VEHICLE TIRES; PROVIDING FOR
SEVERABILITY, CONFLICTS AND EFFECTIVE DATE.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA:
SECTION 1: That Section 11-2 of Chapter 11, entitled
"Receptacles ....
Required; Requirements Generally; Size".of the Sanford
City Code be amended to read as follows:
Sec. 11-2.
RECEPTACLES .... REQUIRED; REQUIREMENTS
GENERALLY; SIZE.
It shall be the duty of every housekeeper, storekeeper,
occupant or owner of any premises within the city limits having, keeping,
or offering for collection any garbage or refuse, to provide for the
storage and collection of such garbage and refuse in either watertight
receptacles consisting of plastic, metal, r~bber or other similar material
provided with proper handles and a tight fitting cover with a capacity
of not more than thirty (30) gallons.
SECTION 2: That Section 11-3 of'Chapter 11, entitled
"Placing Receptacles for and Removal after Collection; Other Trash or
Refuse not Pieced in Receptacles'.' of the Sanford City Code be amended
to read as follows;
Sec. 11.3.
PLACING RECEPTACLES FOR AND REMOVAL AFTER
COLLECTION; OTHER'TRASH OR REFUSE NOT PLACED
iN RECEPTACLES.
It shall be the duty of every housekeeper, storekeeper,
occupant or owner to place the receptacle or plastic bag required/~in
Section 11-2, when offered for collection on the ground at the curbline,
adjacent and directly in front of the premises and said placement shall
be behind the curb, or where the curb would be. Any person having a
corner lot may use the side lot subject to the approval of the refuse
superintendent. Where a public alley exists, the receptacle shall be
placed at the property line on the alley. All receptacles shall be
removed from the curbline or parkway when it shall have been emptied.
SECTION 3: That. Section 11-5 of Chapter 11, entitled
"Wet Garbage" of the Sanford City Code be amended to read as follows:
Sec. 11-5. WET GARBAGE.
All persons who deposit wet garbage for removal by the
city shall deposit such garbage in watertight and airtight plastic begs
or receptacles described in Section 11-2 herein. Any wet garbage.if so
deposited in such plastic bags o.~ containers, ~hatib.e.i~ied ·
securely or have placed there~,n tight fitting covers to prevent the
emission of any odors therefrom~
SECTION 4: That Section 11-6 of Chapter 11, entitled
"Refuse Fruit and VegetablesV of the Sanford City Code be amended to
read as follows:
Sec. 11-6. REFUSE FRUIT AND VEGETABLES.
(a) All persons are hereby required to deposit daily
in either plastic bags or tightly closed receptacles all refuse fruit
and vegetables in and about their homes and places of business, includ-
ing fruit dropped from trees, and to keep such refuse fruit and vegetables
in said plastic bags or tightly closed receptacles until the same are
removed by the Department of Public Works of the city.
(b) All persons are hereby required to allow daily access
to the plastic bags or receptacles. in which refuse fruit and vegetables
are deposited as provided in this section for the purpose of removing
and destroying such refuse fruit and vegetables.
SECTION 5:
That Section 11-10 of Chapter 11, entitled
"Store Sweepings" of the Sanford City Code be amended to read as follows:
Sec. 11-10. SCATTERING OF REFUSE.
No person shall deposit on any of the streets, gutters or
sidewalks within the City any sweepings of any stores, dwelling, offices,
shops or booths, or any paper, hair, chips, bones, peelings, straw or
rubbish of any kind. No person shall cast, place, sweep or deposit
anywhere within the city any refuse in such a manner that it may be
carried or deposited by the elements upon any street, sidewalk, alley,
sewer, parkway or other public place or imt~o any premises within the
city. All commercial establishments must provide a means of securing
trash so as to eliminate wind-driven debris and to eliminate unsightly
litter conditions in and about the establishment.
SECTION 6:. That Chapter 11 entitled "Garbage, Trash and
Weeds'! of the Sanford City Code is hereby amended by adding a section to
be numbered as follows; Seco 11-15, which said section shall read as
follows:

Sec. 11-15. CONSTRUCTION WASTE.
It shall be the duty of every occupant or owner of
property to be responsible for the collection and hauling o~ trash,
discarded building material, dirt, rock, concrete, plaster, l=tumber,
metal or otherT~like material originating from private property
preliminary to, during, or subsequent to the construction of new
buildings, walls, or driveways, alteration or additions to existing
buildings of whatsoever type, walls or driveways.
SECTION 7:
That Chapter 11 entitled "Garbage, Trash and
Weeds'.' of the Sanford City Code is hereby amended by adding a section to
be numbered as follows; Sec. 11-16, which said section shall read as
follows:
Seco 11-16.
YARD REFUSE.
It shall be the duty of every occupant or owner of
property to place all yard trimmings, grass, leaves, weeds and other
yardsrefuse in either plastic bags or other containers, sturdy enough
to retain such refuse at the curb line or at the property line on the
alley if an alley exists. If a container other than .a plastic bag is'
used,said container when filled with refuse, must notT~be too large or
too heavy for handling by one person without possible strain or injury.
In the event the refuse contains tree limbs or branches, said tree limbs
or branches must be cut into sections of not more than five (5') feet in
length, tied securely in a bundle and s,tacked neatly at the curb line
or at the property line on the alley if an alley exists. The bundle
must be light enough to enable one person handling said refuse to lift
same into the collection vehicle without possible strain or injury.
SECTION 8:
That Chapter 11 entitled "Garbage, Trash and
Weeds" of the Sanford City Code is hereby amended by adding a section to
be numbered as follows; Sec. 11-17, which said section shall read as
follows:
Sec. 11-17. MOTOR VEHICLE TIRES.
If any occupant or owner has more'than four (4) motor
vehicle tires for refuse collection in any six (6)month period, the
pickup of any such excess number of tires shall be considered special
handling and shall require a special pickup and charge in accordance with
the existing refuse collection policy and fees in existence at the time
of such special handling.
SECTION 9: If any section or portion of a section of this
ordinance proves to he invalid, unlawful or unconstitutional, it shall
not be held to invalidate or impair the validity, force or effect of
any other section or part of this ordinance.
SECTION 10: All ordinances or ~rts of ordinances in
conflict herewith be and the same are hereby repealed.

SECTION 11: This ordinance shall become effective on
the 1st
1979.
