AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
AMENDING CHAFFER 2, THE CODE OF THE CITY OF
SANFORD, FLORIDA, 1954, AS AMENDED, SAID
AMENDMENT ADDING THERETO ARTICLE VI DEALING
WITH ADMINISTRATION BY ADDING CERTAIN PROVIS-
IONS PERTAINING TO QUALIFICATION OF CONTRACTORS
FOR WORK ON MUNICIPAL IMPROVEMENT PROJECTS.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA:
SECTION 1. That Chapter 2, The Code of the City of Sanford,
Florida, 1954, as amended, dealing with administration, be and the same
is hereby amended by adding thereto Article VI, to read as follows:

Sec. 2-35.
Information as to financial., experience and
equipment capabilities prerequisite to sub-
mission of bid.
No corporation, partnership, association, organization
or individual shall be eligible to submit bids nor receive con-
tract plans, specifications or documents of any type of
municipal improvement project for the city unless and until
such corporation, partnership, association, organization or
individual shall have been qualified by the contractors
qualification committee as hereinafter provided; except that
a contractor holding a valid contractor's license of the city,
to perform the type of work embodied in the proposed type of
improvement, whose existing work for the city plus the amount
of his bid on the proposed improvement does not exceed the
sum of ten thousand dollars, shall be permitted to bid on such
city improvement projects without having been previously so
qualified. Notice of the requirements of this section shall
be included in all 'Notices to Bidders' issued by the city.
Sec. 2-36. Composition of contractors qualification committee.
The contractors qualification committee shall be composed
of the city manager, finance director, city attorney, and a
member of the city commission.
Sec. 2-37. Examination by committee of statements and
questionnaires submitted.
It shah be the duty of the contractors qualification com-
mittee to examine the financial statements, equipment and
experience questionnaires submitted to them by contractors
to determine the financial responsibility, professional capa-
bility, experience, equipment capability, and all other factors
reasonably pertinent to a proper determination of a contractor's
qualifications to perform contracts for municipal improvements
of the city.
Sec. 2-38. Rating of contractors by committee.
Each corporation, partnership, association, organization
or individual submitting the information required by section
2-35 of this Code shall be rated by the contractors qualification
committee as to type of work for which he shall be qualified to
enter into contracts with the city, and, in: addition, the maximum
amount of uncompleted work he will be permitted to have under
contract at any time based upon financial responsibility and
equipment capabilities.
Sec. 2-39. Rules and regulations of committee.
The contractors qualification committee shall make such
rules and regulations as shall be necessary to govern them~
selves and procedures of meetings and to z carry out the purposes
of this article.
Sec. 2-40. Forms of statements and questionnaires.
Forms of financial statements, equipment and experience
questionnaires to be submitted by contractors shall be prepared
by the contractors qualification committee and approved by the
city commission; provided, however, that the forms shall
follow as nearly as practicable the equivalent forms of the
department of transportation.
Sec. 2-41. Frequency of submission of statements and
questio~maires.
The required statements and questionnaires shall be
submitted annually or more frequently if ~city commission
shall so order upon recommendation of the: contractors
qualification committee.
Sec. 2-42.
Contents of statements and questionnaires to
be kept confidential; contractors to be informed
of rating.
The contents of all statements and questionnaires sub-
mitted under the provisions of this article shall be treated
as confidential and solely for the information of authorized
officials of the city in furthering the purposes of this article;
provided, however, that any contractor submitting the re-
quired information shall be informed of his rating upon its
establishment by the contractors qualification committee.

Sec. 2-43. Acceptance or rejection of bids on basis of
qualification rating.
No corporation, partnership, association, organization,
or individual shall be eligible to enter into a contract for con-
struction work on a municipal improvement of the city except
within the amount and capability qualifications established by
the contractors qualification committee except where total
work of a contractor with the city does not exceed the sum of
ten thousand dollars and adequate performance bond is
provided.
Sec. 2-44. Change in financial or capability qualification status.
Any contractor seeking a change in financial or capability
qualifications shall submit to the contractors qualification com-
mittee a new financial statement, equipment and experience
questionnaire showing a change in status sufficient to justify
any desired changes.
Sec. 2-45. Appeals from decisions or ratings of committee.
Decisions and ratings of the contractors qualification com-
mittee shall be subject to appeal to the city commission, within
thirty days of such decision or rating, provided at least two
weeks' notice is given such committee. All appeals shah be
heard by city commission within thirty days of the institution
of such appeal at a regular meeting of the city commission.
Sec. 2-46. Performance bond of successful bidder.
The city commission may require, as a condition for
acceptance of any bid, a performance bond from any success-
ful bidder on contracts for construction work on municipal
improvements of the city, indemnifying the city for delays
in completion or failure to complete any project to be per-
formed by the contractor. Such bond shali be payable to the
city and shall be in such amount as the city commission shall
determine to be necessary."
SECTION 2. That all ordinances or parts %of ordinances in
conflict herewith be and the same are hereby repealed.
SECTION 3. If any section, sub-section, sentence, clause,
phrase or portion of this ordinance is for any reason held invalid by a
court of competent jurisdiction such portion shall be :deemed a separate,
distinct and independent provision and shall not affect the validity of the
remaining portion hereof.

SECTION zL That this ordinance shall become effective
immediately upon its passage and adoption.
