AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING
ORDINANCE NO. 3079 OF SAID CITY; SAID ORDINANCE BEING THE
COMPREHENSIVE PLAN; AMENDING THE FUTURE LAND USE MAP
DESIGNATION OF APPROXIMATELY 1.815 ACRES OF PROPERTY
LYING BETW'EEN E. 14TM STREETAND E. 15TM STREETAND BETWEEN
MAGNOLIA AVENUE AND SANFORD AVENUE, FROM PSP,
PUBLIC/SEMIPUBLIC TO MDR-15, MEDIUM DENSITY RESIDENTIAL - 15;
PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE.
WHEREAS, the City of Sanford's Planning and Zoning Commission, as the City's
local planning agency, held a public hearing on December 21,2000, to consider amending
the Future Land Use Map designation from PSP, Public/Semipublic, to MDR-15, Medium
Density Residential- 15; and
WHEREAS, the City Commission as the City's governing body, held a public
hearing on January 22, 2001, to consider amending the Future Land Use Map designation
from PSP, Public/Semi-Public, to MDR-15, Medium Density Residential- 15; and
WHEREAS, the City of Sanford has complied with requirements and procedures to
amend adopted comprehensive plans as set forth in Florida Statutes.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
SANFORD, FLORIDA:
SECTION 1: That portion of the Future Land Use Plan Element referenced as the
Future Land Use Map is hereby amended by changing the designation of approximately
1.815 acres of property lying between E. 14th Street and E. 15th Street and between
Magnolia Avenue and Sanford Avenue, from PSP, Public/Semipublic, to MDR-15, Medium
Density Residential -15. Said property being more specifically described as follows:
Lots I through 10, Block 16, Tier 2, E.R. Trafford's Map of
Sanford, as per plat thereof as recorded in Plat Book 1, Pages
55-64, Public Records of Seminole County, Florida.
A copy of the amendment to the Future Land Use Map is attached hereto and by this
reference incorporated herein as Exhibit "A" and hereby adopted pursuant to Florida
Statutes.
SECTION 2: SEVEFIABILITY. If any section, sentence, phrase, word, or portion
of this Ordinance is determined to be invalid, unlawful, or unconstitutional, said
determination shall not be held to invalidate or impair the validity, force, or effect of any
other section, sentence, phrase, word, or portion of this Ordinance not otherwise
determined to be invalid, unlawful, or unconstitutional.
SECTION 3: CONFLICTS. All ordinances or resolutions or parts of ordinances or
resolutions in conflict herewith are hereby repealed to the extent of any conflict.
SECTION 4: EFFECTIVE DATE. The effective date of this Ordinance shall be
thirty-one (31) days after its date of adoption. If challenged within thirty (30) days after
adoption, this Ordinance shall not become effective until the state land planning agency
or the Administration Commission, respectively, issues a final order determining this
Ordinance in compliance with Chapter 163, Part II, Florida Statutes.
