AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
AMENDING ORDINANCE NO. 3117 OF SAID CITY; SAID
ORDINANCE BEING A ZONING PLAN; SAID AMENDMENT
TO CHANGE THE ZONING OF 53.36+ ACRES OF
PROPERTY LYING BETWEEN RAND YARD ROAD AND
S.R. 46/W. Is~ STREET AND BETWEEN N. KENNEL ROAD
AND RAND YARD ROAD; FROM GC-2, GENERAL
COMMERCIAL, RI-1, RESTRICTED INDUSTRIAL, MI-2,
MEDIUM INDUSTRIAL AND AG, AGRICULTURAL, TO PD,
PLANNED DEVELOPMENT; PROVIDING FOR
SEVERABILITY, CONFLICTS AND EFFECTIVE DATE.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
SANFORD, FLORIDA:
SECTION 1: That Ordinance No. 3117 of the City of Sanford, Florida passed and
adopted July 27, 1992, said Ordinance being the Comprehensive Zoning Ordinance of the
City of Sanford, Florida, regulating and restricting the location and use of buildings,
structures, land, and water for trade, industry, residence or other purpose, be and the
same is hereby amended as follows:

be and the same is hereby rezoned to PD, Planned Development zoning district and the
Planned Development Master Plan is attached as Exhibit "B" is included herein by
reference as if fully set forth herein.
SECTION 2: The rezoning action herein is subject to the conditions provided for
and agreed to in the DeVelopment Order #00-0048.
SECTION 3: Severability, If any section or portion of a section of this Ordinance
proves to be invalid, unlawful or unconstitutional it shall not be held to impair the validity,
force or effect of any other section or part of a section of this Ordinance.
SECTION 4: Conflicts. That all ordinances or parts of ordinances in conflict
herewith be and the same are hereby revoked.
SECTION 5: Effective Date, That this Ordinance shall become effective
immediately upon the execution and recording of the Development Order referenced
above, provided that said Development Order is fully executed and delivered to the City
Clerk for recording within ninety (90) days of the date of adoption of this ordinance,
otherwise this ordinance shall be null and void and of no force and effect.

Requested Development Approval: Planned Development Rezone for above referenced property
The development approval sought is consistent with the City of S~ford Comprehensive
PI~ ~d will be developed consistent with and in compliance to applicable land development
regulations ~d all other applicable regulations and ordinances.
The owner of the prope~y has expressly agreed to be bound by and subject to the
development conditions ~d commitments stated below ~d has covenanted ~d agreed to have
such conditions affd commitments mn with, follow and pe~etually burden the afore described
prope~y.

NOW, THE~FO~, it is O~E~D ~ AG~ED THAT:
(1) The aforementioned application for development approval is G~ED.
(2) All development shall ~lly comply with all of the codes ~d ordinances in effect
in the City of S~ford, Florida at the time of issuance of pe~its including all

impact fee ordinances.
(3) The conditions upon this development approval and the commitment made as to

this development approval, all of which have been accepted by and agreed to by
the owner of the property are as follows:
(a) All development must be consistent with the All Souls Catholic
Church/Catholic High School Master Plan dated November 21, 2000,
and revised December 19, 2000.
(b) A forty (40) foot wide right-of-way is dedicated to the City along that
portion of Rand Yard Road located north of existing Narcissus
Avenue. The property to be dedicated to the City may be included in
open space calculations for site plan purposes. In addition, a ten (10)
foot construction easement is dedicated to the City along said portion
of Rand Yard Road. In the event that the City does not commence
construction of the road within the above right-ol~way within ten (10)
years, the owner shall have the right, upon written request to the City,
and any time thereafter, to request that the above right-of-way
dedication and construction easement be vacated and returned to the
owner or the owner's successor.
(c) Right of Way dedication of thirty five (35) feet is required along that
portion of Rand Yard Road located between existing Narcissus
Avenue and State Road 46.
(d) Nareissus Avenue shall be vacated pursuant City Commission action.
Narcissus Avenue shall be an ingress and egress easement open to the
public unless and until a cul-de~sac is constructed per City standards
on the dead end portion of Narcissus Avenue (west side) as part of the
Diocese of Orlando development improvements. Right of way for said
cul-de-sac shall be dedicated to the City by the Diocese of Orlando. In
addition, said ingress/egress easement on Narcissus Avenue shall
remain open to the public until any one of the following occur:
~ 1) Kennel Road is improved/constructed to City standards
between SR 46 and Narcissus Avenue in a manner that permits
truck traffic and truck turning movements; or,
2) White Cedar Road is improved to City standards between SR
46 and Narcissus Avenue in a manner that permits truck
traffic and truck turning movements; or,
3) Airport Boulevard Extension (Rand Yard Road) is improved
and extended to City standards from SR 46, northerly, to
provide a connection to CR 15.

(4) This Development Order touches and conce~isqh~ ~ore descriBbed property and
the conditions, commitments and provisions of this Developmerl~ti~[sl~l~ll rl~rpetually burden,
mn with and follow the said propeay and be a se~itude upon and binding upon said prope~y
unless released in whole or p~ by action of the City of S~Brd by vi~ue of a document of equal
dignity herewith. The owner of the said prope~y has expressly covenanted and agreed to this
provision and all other terns and provisions of this Development Order.
(5) The te~s ~d provisions of this Order are not severable and in the event any
potion of this Order Gall be Bund to be invalid or illegal then the entire order shall be null ~d
void.
