AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
AMENDING ORDINANCE NO. 3117 OF SAID CITY; SAID
ORDINANCE BEING A ZONING PLAN; SAID AMENDMENTS
CHANGING THE ZONING OF A PORTION OF THAT
PROPERTY LYING BETWEEN EAST 3RD STREET AND
EAST 5TM STREET AND BET~/EEN PINE AVENUE AND
HICKORY AVENUE, FROM MR-3, MULTIPLE FAMILY
DWELLING RESIDENTIAL, TO PD, PLANNED
DEVELOPMENT; PROVIDING FOR SEVERABILITY,
CONFLICTS AND EFFECTIVE DATE.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
SANFORD, FLORIDA:
SECTION 1: That Ordinance No. 3117 of the City of Sanford, Florida passed and
adopted July 27, 1992, said Ordinance being the Comprehensive Zoning Ordinance of the
City of Sanford, Florida, regulating and restricting the location and use of buildings,
structures, land, and water for trade, industry, residence or other purpose, be and the
same is hereby amended as follows:
All that part of Block 19, Chapman and Tuckers Addition
to Sanford, according to the plat thereof as recorded in
Plat Book 1, Page 24, of the Public Records of Seminole
County, Florida lying Wly of Pump Branch, Less the E
65.00' of the W 176.00' of the N 120.00' thereof, AND ALSO
LESS the S 68.8' thereof, AND ALSO LESS the following
described parcel: Beginning at the NW Cor of said Block
19, thence run due South, along the W line of said Block
19, a distance of 103.07'; thence run due E 111.00'; thence
run due N 93.55' to a point on the N line of said Block 19:
thence run N89°06'05"W 111.41' to the Point of Beginning,
be and the same is hereby rezoned from MR-3, Multiple Family Dwelling Residential to PD,
Planned Development, and The Aagaard-Harbin Warehouse Master Plan Project Plan
attached as Exhibit "A" is incorporated herein by reference as if fully set forth herein.
Additional conditions of development are as follows:
A. The project shall be developed substantially in accordance with the
information, data, plans and commitments contained in the Master Plan
entitled "Aagaard-Harbin Warehouse Master Plan" and supplemental
information unless otherwise directed by the recommendations enumerated
below and as may be amended from time to time as provided by procedures
set forth in the City's Land Development Regulations.
B. The proposed Aagaard-Harbin Warehouse Master Plan shall be utilized to
identify general uses and existing buildings on the site. The Master Plan
shall not be construed as a Development Plan and shall not be utilized for
permitting purposes.
C. All activities shall be conducted indoors or within areas that are wholly
enclosed within walled areas. Outdoor storage of vehicles and related
contractor's equipment shall not be visible from adjacent property. Further,
outdoor storage of any and all building materials, contractor's supplies
and/or miscellaneous objects of any kind shall not be visible from adjacent
property.
D. Manufacturing, fabrication, assembly or other similar activities shall be
specifically prohibited.
E. Parking shall be on site. Customer vehicles of the proposed auction, service
vehicles and equipment are specifically prohibited from parking in public
right-of-way adjacent to the site.
F. Specimen type live oaks shall be preserved.
G. Improvements adjacent to and in close proximity to Pump Branch shall be
coordinated with the City's storm water management program. In this regard,
the owner shall cooperate with and provide reasonable drainage easements
to the City.
H. Semi-tractor trailer storage is allowed on site subject to the above
stipulations.
SECTION 2: Severability. If any section or portion of a section of this Ordinance
proves to be invalid, unlawful or unconstitutional it shall not be held to impair the validity,
force or effect of any other section or part of a section of this Ordinance.
SECTION 3: Conflicts. That all ordinances or parts of ordinances in conflict
herewith be and the same are hereby revoked.
SECTION 4: Effective Date. That this Ordinance shall become effective
immediately upon its passage and adoption.
