AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
AMENDING ARTICLE III, WATER, SEWER AND DRAINAGE
CONNECTION AND CONTROL CHARGE OF THE
SANFORD CITY CODE, TO DELETE SECTION 28-4.3(d)
AND TO PROVIDE A NEW SECTION 28-4.3(d)
INCREASING RESIDENTIAL UTILITY DEPOSITS;
PROVIDING FOR SEVERABILITY, CONFLICTS AND
EFFECTIVE DATE.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
SANFORD, FLORIDA:
SECTION 1: Artjcle III, WATER, SEWER AND DRAINAGE CONNECTION AND
CONTROL CHARGE, Section 28-4.3(d) of the Sanford City Code is hereby deleted.
SECTION 2: Article III, Section 28-4.3(d) of the Sanford City Code is amended co
read as follows:
(d) The minium utility deposit shall be seventy-five dollars ($75.00) per
single family residential account. For new multiresidential services and
nonresidential services, the amount of the deposit for each account shall
be the monthly average of three (3) consecutive monthly city service
bills or as designated by the city manager based on specific billing and
collection procedures required by any specific account. Any special
deposit is subject to review by the city commission.
( 1 ) Interest payment. Interest shall be paid on all accounts with
utility deposits. Interest shall be calculated starting the firs[
month after adoption of this ordinance. [Ord. No. 3294.,

(2) Basis for interest rate. The interest rate paid on utility
deposits shall be set at the pass book savings rate of the city's
banking service prorider as of ]une 30 of each year.
(3) Interest payment procedures. Interest payment on utility
deposits shall be by a credit applied to each account on the first
billing period after August 31 of each year or as soon as
practical after that date. Annual interest shall be pro-rated
monthly. Accounts terminated after August 31 of any year
shall receive pro-rated interest credit to the month preceding
termination of service. This credit shall apply to the final bill.
Deposits posted after August 31 of any year shall have pro-rated
interest credited to their account on August 31 of the following
year. Deposits shall not earn interest on a partial month.
SECTION 3: SEVERABILITY. If any section or portion of a section of this ordinance
proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity,
force or effect of any other section or part of this ordinance.
SECTION 4: CONFLICTS. That all ordinances or parts of ordinances in conflict
herewith be and the same are hereby revoked.
SECTION 5: EFFECTIVE DATE. That this ordinance shall become effective
immediately upon its passage and adoption.
