AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, '
CREATING CHAPTER 2, ARTICLE XXIII OF THE CITY OF
SANFORD CODE OF ORDINANCES, ENTITLED "CITIZEN'S
ADVISORY BOARD"; PROVIDING FOR THE CREATION OF
AN ADVISORY BOARD TO PRESENT SUGGESTIONS AND
RECOMMENDATIONS TO THE CHIEF OF POLICE AND
CITY COMMISSION REGARDING LAW ENFORCEMENT
NEEDS AND RESOURCES; PROVIDING MEMBERSHIP;
PROVIDING POWERS; PROVIDING FOR MEETINGS;
PROVIDING FOR CODIFICATION, SEVERABILITY,
CONFLICTS AND EFFECTIVE DATE.
WHEREAS, the Florida Legislature has in Chapter 166 of the Florida Statutes,
recognized the Constitutional Home Rule powers of a municipal government; and
WHEREAS, the City Commission of the City of Sanford, Florida, finds it in the best
interest of the City to create a Citizen's Advisory Board to provide suggestions and
recommendations to the Chief of Police and City Commission regarding law enforcement
needs and resources.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
SANFORD, FLORIDA:
SECTION 1: That Chapter 2, Article XXIII of the City of Sanford Code of Ordinances
is hereby created to read as follows:
Sec. XXIII. Citizen's Advisory Board.
(a) Creation. There is hereby created a Citizen's Advisory Board, hereinafter
called "the Board", pursuant to F.S. §166.042.
(b) Membership.
(1) The City Commission shall appoint a ten (10) member board to serve
without pay, with each Commissioner appointing two (2) members.
(2) The terms of the initial members of the Board shall be staggered, with
five (5) members appointed for a term of two (2) years and five (5)
members appointed for a term of one (1) year; thereafter, all terms will
be for two (2) years.
(3) The Board shall elect a chairman, vice-chairman, and a secretary and
may conduct business with a quorum of six (6) members.
(c) Powers. The Board shall have only the power to:
(1) Adopt rules for the conduct of its hearings and establish procedures;
(2) Hear comments from the general public;
(3) Present the Chief of Police and the City Commission with suggestions
and recommendations regarding City law enforcement needs and
resources.
(d) Meetings.
(1) The Board meetings shall be open to the general public;
(2) The date, time and place of the meetings shall be made available to
the general public in advance of meetings.
(3) The Board shall meet at least once per year as it deems appropriate.
It is the legislative intent of this Article is to create an advisory board to the Chief of
Police and City Commission regarding law enforcement needs and resources only.
Nothing contained in this Article shall be interpreted to interfere with or overlap the powers
and authority of any other City administrative, advisory or review board.
SECTION 2: Codification. That Section 1 of this Ordinance shall be codified and
made a part of the City Code of Ordinances.
SECTION 3: Severability. If any section or portion of a section of this Ordinance
proves to be invalid, unlawful, or unconstitutional, it shall not be held to impair the validity,
force or effect of any other section or part of a section of the Ordinance.
SECTION 4: Conflicts, That all Ordinances or parts of Ordinances in conflict
herewith be and the same are hereby revoked.
SECTION 5: Effective Date. This Ordinance shall become effective immediately
upon its passage and adoption.
