HomeMy WebLinkAbout02022017 pp min DHSANFORD POLICE OFFICERS' RETIREMENT SYSTEM PENSION BOARD DISABILITY HEARING - LEHMAN THURSDAY FEBRUARY 2 2017 - 1:00 P.M. 1. Call to Order and Roll Call The meeting was called to order at 1;00 p.m. by the Chairman, Darrel Presley. The following members were present: Bill Erwin, Chris Henry, Nigel Price, and Michael Taylor. Also in attendance was Scott Christiansen, the Plan Attorney, Susy Pita, Plan Administrator, the claimant, Ms. Tina Lehman, her attorney Michael Brehne, and a court reporter (provided by the Claimant). A few friends and family members were also in the audience. 2. Review Medical Information and Disability Application Scott Christiansen began by reviewing the disability processes and procedures with everyone. He went on to review the disability criteria detailed in the Pension Plan Ordinance explaining that the Trustees were also going to have to determine whether or not the disability occurred in the line of duty. The medical records that were collected were reviewed and discussed. It was noted for the record that Ms. Lehman had a physical when she began employment with the Police Department and there were no physical or psychiatric issues at that time. Attorney Michael Brehne then presented their case to the Board of Trustees and asked that an in-line of duty be awarded to his client. The Trustees asked questions of Ms. Lehman and her attorney and a lengthy discussion ensued. Following the discussion, a motion was made by Bill Erwin to authorize an Independent Medical (Psychiatric) Evaluation to better evaluate the disability claim. Seconded by Michael Taylor for discussion. Scott Christiansen then addressed the processing time that may ensue with another requested IME and stated that Ms. Lehman would have to agree to an extension of the Initial Hearing as such. Her attorney requested a private consultation and the meeting recessed at 1:50 p.m. The meeting reconvened at 2:10 p.m. Attorney Michael Brehne stated that, based on the medical records already obtained, his client feels that no other evidence would be forthcoming as a result of another IME and that they respectfully deny the request for an extension of the Initial Hearing phase and additional IME. At that time Bill Erwin withdrew his motion and additional discussion took place. Following that discussion, a motion was made by Nigel Price to grant Ms. Lehman with her request for an in-line of duty disability. Seconded by Chris Henry for discussion. Following a brief discussion the roll was called and the following vote was recorded: Bill Erwin No Chris Henry Yes Nigel Price Yes Michael Taylor No Chairman Presley No The in-line of duty disability was denied 3 (no) -2 (yes). At that time Chairman Presley passed the gavel to Bill Erwin and made a motion to deny Ms. Lehman her application for a disability.
