HomeMy WebLinkAbout07192016 PP mins DHSANFORD POLICE OFFICERS' RETIREMENT SYSTEM PENSION BOARD CONTINUATION OF DISABILITY HEARING -DEN DEKKER Tuesday, July 19, 2016 — 10:00 A.M. 1. Call to Order and ko-111 Call The meeting was called to order at 10:05 a.m. by the Chairman, Darrel Presley. The following members were present: Bill Erwin, John Dovydaitis, Nigel Price, and Michael Taylor. Also in attendance was Scott Christiansen, the Plan Attorney, the applicant, Ms. Carlena Dendekker, and her attorney, Ms. Kelli Hastings. Nigel Price disclosed that Mr. Dendekker's Workers Compensation Attorney is the same attorney that his wife is currently using for her medical condition. Scott Christiansen asked him if this would impair his ability to make an informed decision and he stated that it would not. 2. Review Medical Information and Disability Application Scott Christiansen began by reviewing the additional supplemental documents (from Drs. Badman and Hostetter) that were provided to the Trustees in their meeting packets. Ms. Kelli Hastings then handed out two additional documents from Dr. Agamasu and Dr. Kakkar that she had just received as well. Scott took a few minutes to summarize the disability processes and procedures with everyone. He went on to review the disability criteria detailed in the Pension Plan Ordinance explaining that the Trustees were also going to have to determine whether or not the disability occurred in the line of duty. Because Ms. Dendekker has less than 5 years of credited service with the Sanford PD, she is only eligible to receive an in-line of duty disability. Bill Erwin asked if the four items detailed on page four of Dr. Nicoloffs letter, dated January 28, 2016, were ever addressed. Kelli and Scott both stated that, with the exception of item number four, the medical records are very old and no longer available. Dr. Badman, Ms. Dendekker's primary care doctor, did provide additional review of item number four and that information was provided to the Trustees in advance of today's meeting. Following some discussion, a motion was made by John Dovydaitis to deny the disability claim due to the lack of clear evidence that her condition is a result of cardiac issues. Nigel Price seconded the motion for discussion and a lengthy discussion ensued which included questions of Ms. Dendekker and her attorney. John Dovydaitis then withdrew his motion. The Trustees agreed to recess today's meeting after requesting the following documents: - Copies of all prescription drugs taken by the claimant prior to 2011 - Copies of the results of Ms. Dendekker's nuclear stress test - The name of Ms. Dendekker's primary care physician prior to Dr. Badman - A deposition from Dr. Nicoloff Once these documents have been obtained, the continuation of the Disability Hearing will be scheduled. 3.
