CONTINUATION OF DISABILITY H EARING- DEN DEKKER
Thursday, November 2. 2017 —11:30 A.M.
1. Call to and Roll Call
The meeting was called to order at 11:50 a.m. by the Chairman, Darrel Presley. The following
members were present: Bill Erwin, Chris Henry and Michael Taylor. Also in attendance was Scott
Christiansen, the Plan Attorney, the applicant, Ms. Carlena Dendekker, and her attorney, Ms.
Kelli Hastings.
2. Review Additional Medical Information and Disability Application
Scott took a few minutes to summarize the disability processes and procedures with everyone.
He went on to review the disability criteria detailed in the Pension Plan Ordinance explaining
that the Trustees were also going to have to determine whether or not the disability occurred in
the line of duty. Because Ms. Dendekker has less than 5 years of credited service with the
Sanford PD, she is only eligible to receive an in-line of duty disability.
Keli Hastings then reviewed some of the data in the depositions and presented her claim that
there was evidence that this disease meets the heart-lung presumption.
3. Course of Action
Following a very lengthy discussion, a motion was made by Bill Erwin to grant the in-line of duty
disability to Carlena Dendekker based on the evidence presented. Seconded by Chris Henry,
the following vote was recorded: Bill Erwin -Yes, Chris Henry -Yes, Darrel Presley -No and Michael
Taylor -No. The motion died due to the tied vote. Additional discussion ensued and another
motion was made by Bill Erwin to grant the in-line of duty disability based on the
preponderance of evidence related to her pre-employment physical and the heart-lung
presumption. Seconded by Chris Henry, the motion carried unanimously.
Scott will prepare the Order and send it to the Administrator for execution and the
Administrator will proceed with the calculation request.
4. Adjournment
The meeting ended at 12:45 p.m.
