AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
AMENDING ORDINANCE NO. 3117 OF SAID CITY; SAID
ORDINANCE BEING A ZONING PLAN; SAID AMENDMENT
TO REZONE THAT CERTAIN PROPERTY LYING BETWEEN
RINEHART ROAD and COUNTY ROAD 46A AND BETWEEN
RINEHART ROAD AND OREGON AVENUE SOUTH FROM
AG (AGRICULTURAL) TO PD (PLANNED DEVELOPMENT)
PROVIDING FOR SEVERABILITY, CONFLICTS AND
EFFECTIVE DATE.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
SANFORD, FLORIDA:
SECTION 1: That Ordinance No. 3117 of the City of Sanford, Florida passed and
adopted July 27, 1992, said Ordinance being the Comprehensive Zoning Ordinance of the
City of Sanford, Florida, regulating and restricting the location and use of buildings,
structures, land, and water for trade, industry, residence or other purpose, be and the
same is hereby amended as follows:
The West 1/2 of SE 1/4 (LESS the E 333' of the S 1016' and
begin at the NE corner run W 654'; thence S 949.9'; thence S
11 deg, 28 min, E 440'; thence E 566.4'; thence N to Beg), of
Sec 32, Twp 19S, Range 30E, as recorded in the Public
Records of Seminole County, Florida in Plat Book 96, Page
297.
The property being more generally described as south of
Rinehart Road, north of Paola Road, between the Twin Lakes.
be and the same is hereby rezoned to PD (Planned Development) zoning district and the
Planned Development Master Plan attached as Exhibit "A" is included herein by reference
as if fully set forth herein and the following conditions are included:
a. A limit of 574 dwelling units on the property with the southernmost
twenty acres being further limited to 225 dwelling units resulting in a maximum gross
density of 11.25 dwelling units per acre within that 20-acre southerly portion of the
property.
b. Dedication to the City of riparian rights to boating access to the lakes
bounded in part by the property and inclusion of lake restrictions in all residential leases.
A gazebo structure may be constructed at the edge of the shorelines.
c. No dwelling units shall be built within the southernmost 100 feet of the
property after widening of CR 46A.
d. The first row of buildings north of CR 46A will be no greater than two
stories in height.
e. No dwelling units shall be built within the western most fifty (50) feet
of the property contiguous to the Kastner parcel.
SECTION 2: Severability. If any section or portion of a section of this Ordinance
proves to be invalid, unlawful or unconstitutional it shall not be held to impair the validity,
force or effect of any other section or part of a section of this Ordinance.
SECTION 3: Conflicts. That all ordinances or parts of ordinances in conflict
herewith be and the same are hereby revoked.
SECTION 4: Effective Date. That this Ordinance shall become effective after the
Department of Community Affairs issues an intent to find the associated comprehensive
plan amendment to be in compliance with state law.
