Additional points of interest
A down payment of 33% of the total precast wall amount is due prior to the beginning of construction.
This proposal is based on soil conditions being suitable for construction. Seminole Masonry is not
responsible for any soil testing prior to construction.
Seminole Masonry will not be held responsible for damages to: landscaping, irrigation, curbing, concrete
sidewalks/ driveways, or asphalt roadways incurred during the scope of our normal construction process.
The demolition process will not include any trees, as they were not marked for removal during original bid
procedure. All tree removals will consist of a change order once they are identified as necessary to remove.
If a temporary fence or barricades is required for construction this will be charges as needed. All
exclusions can be provided by Seminole Masonry for charges as needed.
This proposal amount is based on estimated quantities of each line item. These quantities shall be
field verified upon job completion, and will be equitably adjusted as needed.
Wall will be placed on existing grade contour to the earth. Raising the wall by raising the footer or
lowering the wall by excavating the grade below the footer will result in an additional charge of $150 per
panel.
Seminole Masonry must be provided stable access along the entire wall line in the amount of 25' prior to
mobilization.

adjusted to reflect the changes.
Please include NOC and/or copy of permit with signed proposal. Also please include full set of site plans
if not provided to Seminole Masonry, LLC at time of proposal.
Retainage, if any, will be due net 30 days from completion of Seminole Masonry, LLC scope of work.
This proposal does not include a payment and performance bond.
Wall panels are manufactured and billed in 15' denominations. In the event that less than 15' is required,
customer will be billed for entire 15' panel due to it having to be manufactured. If cut section can be used
to fit another area, it will at Seminole Masonry discretion.
This proposal is based on the following design criteria:

The base price does not include the extra cost of drilling of rock, hidden debris, concrete, conflicts with
utilities, or poor soil conditions. The wall line must have no conflicts with trees, overhead lines, or
underground utilities. (Seminole Masonry, LLC, will call in "locates") If the scaling or colorings of any
part of the wall, columns, or caps are performed by anyone other than Seminole Masonry, LLC, will
assume no responsibility nor any warranty that would otherwise be provided by Seminole Masonry, LLC.
Noticc to owner: Florida law contains important requirements you must follow before you may file a lawsuit for
defective construction against a contractor, subcontractor, supplier, or dcsign professional for an alleged construction
defect in your home. Sixty (60) days before you file your lawsuit, you must deliver to the contractor, subcontractor,
supplier, or dcsign professional a written notice of any construction conditions you allege are defective and provide
your contractor and any subcontractors, suppliers, or design professionals the opportunity to inspect the alleged
construction defects and make an offer to repair or pay for the alleged construction defects. You arc not obligated to
accept any offer made by the contractor or any subcontractors, suppliers, or design professionals. There arc strict
deadlines and procedures under Florida law.
According to Florida's construction lien law (Sections 713.001-713.37, Florida Statutes), those who work on your
property or provide materials and arc not paid in full have a right to enforce their claim for payment against your
property. This claim is known as a construction lien. If your contractor or subcontractor fail to pay subcontractors, or
material suppliers, or neglects to make other legally required payments, the people who are owed money may look to
your property for payment, even if you have paid your contractor in full. If you fail to pay your contractor, your
contractor may also have a lien on your property. This means if a lien is tiled, your property could be sold against your
will to pay for labor, materials or other services that your contractor or subcontractor may have failed to pay. Florida's
construction lien law is complex and it is recommended that whenever a specific problem arises, you consult an
attorney.

SANFORD FL 32773 (hercinallcr referred to as the
Conlraclor"1 for the projLcl known as BRISSON MIENT
WALLS & FFNCE in CITY OF SANFORD, SEMINOLE*
COUNTY, Florida Ithe "Projccl"). Owner hereby gives the
Contactor an order ror and the Comractor agrees to provide and
perfonn at the Project listed above, the arterials and work
described which are more lolly sel fiorth below.
SECTION 1. WORK IN ACCORDANCE, WITH
CONTRACT DOCUME'N 'S
Contmclur agrees at furnish oil labor, material, equipment.
tools, temporary facilities and :any incidental services required
Ihc "Work") to successfully complete all orthc work at and till

all plans, spccifcations. drawings, addenda, schedules. Initially
related documents setting fourth the scope of work for the Projccl
which are hereby incorpomled into this Agreement by reference

SECTION 2. SCOPE OF WORK
The Work to be performed by Contractor is hostiles,
delineated in Ihc atlached Schedule A. which is incolioraled by
reference and is part ohlhe Contract Documents.
The items listed ill Schedule A arc liar lite purpose of
clarifying their inclusion in this Agreement as such items may
not have been included in the plants or lechnical specifications
relating directly to the Work. Likewise, they may have been
included in Ihc specifications hill excluded by the Contractor in
its bid. In no tray is Schalnle A u) he representative ofall Work
to be done by Contractor but is provided rather for the purposes
of illustration and of clarifying certain Icons only.
Cnntmclor agrees that the plans and specifications arc
intended at supplement one another. and tiny work or materials
it• equipment shown or mentioned in one and not in the other
shall be furnished by Contractor without extra charge. 1)e
enumcrrtion of said items in this Agreement or in any oh the
Contract Documents shall still be construed to exclude other
items. Contractor agrees that Owner shall have lite right to

Contract Documents.

SECTION 3. MANNI,R OF PROSECUTION
OF WORK

3.1 Familiarity with Contract Discontents. This
Agreement contemplates a complete installation or lbe Work
and shall be all inclusive under conunon usage in the industry
and as may be inferred reasonably from this Agreement orally
of the Contract Documents. Contractor's failure us, check
Thoroughly and In verify lite infiormation contained in Illis
Agreement or any other Conrad Document shall not act to
modify or mitigate Contractors responsibility hcrcin
contemplated as to Ihc Work.
3.2 Shop Drawings - Approval Not it Waiver of Defects

shop drawings as may be necessary to describe completely Ihc
details and consu•ucliun of the Work. Approval of' such shop
drawings by Owner shall not relieve Contractor of its obligalion

4.1 (1) Progress Payments. Contractor will deliver its

in an amount equal to ninety percent (90%) or the estimated

4.3 Final Payment. Owner shall keep a I0% acloinage

the Owner, upon the release of the above bonds, and upon
Contractor providing file release set forth in paragraph 4.6. The

release or discharge to any extent whatsoever the surety or
sureties upon any bond given by Comraclur hereunder.
4.6 Release Rcgnired for Final Payment. Contractor
shall not be entitled to receive it final payntcnt mail the Work
has been accepted by Owner ant a completed release orany and
all claims or any nature whatsoever against Owner has been
delivered by the Contractor to Owner. The acceptance orsuch
release shall not relieve the Contractor of liability firr defects in
file Work which may thereafter be discovered.
4.7 Non -Waiver of Rights Against Contractor. No
payment mate under this Agree rem shall be evidence of
Icrlormance by Contractor ill* its obligations under this
Agreement either wholly or in pall. No payments (including

1. Furnish all supervision, labor, materials, equipment, tools, temporary facilities, sales tax and everything
necessary to completely perform all work for the Brisson West walls and fence worlc in full compliance with the
terms of the Owner/Contractor Agreement (this "Agreement") and all plans, specifications, drawings, addenda,
schedules, and any related documents; all hereby are made a part of this Agreement and are collectively

2. More specifically, the work to be accomplished under the Contract Documents includes, but is not limited to,
the Final Engineering Plans for Brisson West Phase i — 3 (49 pages) stamped approved on 10/25/2016 as
prepared by Central Florida Engineering Consultants, LLC Engineerof Record and the specifications as req uired
by the General Conditions of the Contract for Construction; Division 1, "General Requirements"; all applicable
and/or related civil plans and specifications.
3. The Contractor shall check all materials, equipment and labor entering into the work and shall keep such full and
detailed accounts as may be necessary for proper financial management under this Agreement, and the system
shall be satisfactory to the Owner. The Owner or its representative shall be afforded access to all of Contractor's
records, books, correspondence, instructions, drawings, receipts, vouchers, memoranda and similar data
relating to this contract, and the contractor shall preserve all such records for a period of three years, or for
such longer period as may be required by law, after the final payment.
Contractor agrees to assign and transfer to the Owner all its rights to sales and use tax which may be refunded
as a result of a claim for refund for materials purchased in connection with this Agreement. Contractor further
agrees that it will not file a claim for refund for any sales or use tax, which is the subject of this assignment.

This shall be considered a "lump sum" contract to be performed in accordance with the Contract
