The line post will be a 2" round schedule 40 full weight anchored 3' deep with 60 lbs of concrete. It will be set every 10'. There are 2" terminal post that will be set every 100' for tightening of the wires and for strength of the fence. The top rail will be 15/8" secured with loop caps. Byers Fence will include all new hardware, tension bands and brace bands. All chain link materials are manufactured by Master Halco, Inc and has a limited lifetime warranty. Byers Fence LLC has a 1 year warranty on all installs beginning the day after installation. Upon completion of job we will clean up all debris and will also spread the dirt to filter in the ground. Price includes labor, materials, removal, taxes and permit. TOTAL PRICE: $10,890.00 This Is the price for all materials, tax & normal installation. Any changes or additions beyond the original estimate may incur additional charges. TERMS & CONDITIONS (This is designated as Back of contract) Buyer must be owner of property where work is to be performed or have written, notarized permission from owner. Every effort will be made to maintain installation schedules. However, Byers Fence LLC shall not be held liable for delays due to causes beyond our control. These shall include but are not limited to weather, equipment failure or unforeseen delays due to previous commitments or contracts. Materials used in installation are purchased from accepted wholesalers and sellers of fence materials. Buyer accepts all materials as approved for residential installation with the final discretion of use of any and all materials left to Byers Fence LLC. Changes or modifications to this agreement can be made only with the consent of both parties and shall be in written form. Any changes or modifications made after installation has begun may include charges for additional trips or installation time made necessary due to changes or modifications. These charges shall be determined by Byers Fence LLC at a reasonable rate. Buyer shall establish property lines prior to start of any installation and shall remove all obstructions that may interfere with installation (unless otherwise stated in contract). It is understood that NORMAL INSTALLATION applies to installer being able to make any and all installations without delays caused by needed trenching, removal of vegetation or debris, drilling or breaking of rock, or any other unusual conditions which may interfere with any part of the installation. Fence installations will follow the flow of the ground within reason unless stated otherwise. Depths of posts in -ground and distances between posts shall be reasonable to insure proper installation and may be determined by ground conditions but shall be at the discretion of Byers Fence LLC (unless otherwise stated in writing). It is the policy of Byers Fence LLC to perform proper installation of all projects so to withstand normal abuse. Any abnormal abuse of installed product(s) is not warrantied under this contract. Any bowing or warpage of any materials is not warrantied unless specified in writing. This includes all wood materials including but not limited to pickets, 2"x4" railings, boards, posts or other materials used to construct project or used in repairs of any project. Any and all local codes, restrictions and permits, to include minimum setback boundaries, permits, and community requirements, are the responsibility of the buyer. Byers Fence LLC assists in making sure all boundaries are adhered to by obtaining permits for the Buyer and installing the fence per the approved site plan. All precautions will be made to avoid underground utilities or installations. Byers Fence LLC and it's employees or contractors shall not be held liable for any damages to underground utilities or installations within or adjacent to installation boundaries of buyers property unless made known prior to installation and clearly marked by buyer. Marking of utilities or installations shall be the buyer's responsibility unless otherwise stated. Materials become the property of the buyer upon delivery to buyer's property or place of installation. Costs of all materials are payable and due to Byers Fence LLC upon acceptance of this contract unless otherwise stated. If any disputes arise due to materials or installations or other conditions of this contract, before, during or after completion of installation, buyer agrees to pay all costs for materials, delivery and administration costs of those materials upon delivery of materials to property or place of installation. Payment of installation and other costs shall be made upon settlement of said disputes. If buyer breaches this contract, buyer herein authorizes Byers Fence LLC or its authorized agent(s) to enter upon premises and remove all materials, installed or otherwise, used in installation or belonging to Byers Fence LLC. Buyer hereby waives all demands, notice and protest to repossessions caused by breach of this contract by buyer. Buyer waives all claims to said materials and it's disposition. Buyer agrees to pay all expenses and/or damages to include but not limited to litigation or preparation thereof, resulting from any default or breach of this contract. Byers Fence LLC.retains the right to place a lien upon the buyer's property to cover all expenses incurred due to the breach of this contract by buyer, including but not limited to non-payment of any monies as stated in this contract. --- Byers Fence LLC reserves the right to charge a $40.00 returned check fee for any returned instrument or payment.
