AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AUTHORIZING
THE CITY COMMISSION OF THE CITY OF SANFORD TO DEVELOP
THE PROPERTY GENERALLY DESCRIBED AS FORT MELLON PARK
AND MORE PARTICULARLY DESCRIBED IN THIS ORDINANCE;
PERMITTING THE CITY TO LEASE SAID PROPERTY IN ORDER TO
ALLOW FOR THE DEVELOPMENT OF A HOTEL/CONFERENCE
CENTER COMPLEX ON THE PROPERTY; PROVIDING FOR
SEVERABILITY, CONFLICTS AND AN EFFECTIVE DATE.
WItEREAS, there is a great need for economic development within the City of Sanford and
more particularly along the waterfront of the City of Sanford; and
WltEREAS, economic development in the City of Sanford would be greatly improved
through the development of the Sanford lakefront as a hotel/conference center complex; and
WHEREAS, OrdinanceNo. 238 ofthe City ofSanford provides that the City of Sanford
retains the use of the public park known as Fort Mellon Park for such municipal or other public
purpose as its governing authority may deem necessary; and
WHEREAS, the City Commission deems it necessary to enact an ordinance authorizing the
City Commission to enter into the necessary contracts to lease City property so that a
hotel/conference center complex can be developed on waterfront property currently utilized as a park,
known as Fort Mellon Park; and
WHEREAS, the construction of a hotel/conference center on said property is for a public
purpose.
NOW THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
SANFORD, FLORIDA:
SECTION 1: DESCRIPTION OF PROPERTY. The property in question in this
Ordinance is generally described as Fort Mellon Park but more particularly described as provided in
Exhibit "A" to this Ordinance.
SECTION 2: DEVELOPMENT ALLOWED. The City Commission of the City of
Sanford is hereby authorized to enter into all necessary agreements and contracts to effectuate
development of the property described in Exhibit "A", through the lease of that property to a private
developer for purposes of building a hotel/conference center complex. Said development shall be
constructed in such a way to allow a joint use of the property by the public and private interests to
the fullest extent economically feasible.
SECTION 3: SEVERABII,ITY If any section or portion of a section of this Ordinance
proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or
effect of any other action or part of this Ordinance.
SECTION 4: CONFLICTS That all Ordinances or parts ofOrd'mances in con~ict herewith
be and the same are hereby revoked.
SECTION 5: EFFECTIVE DATE That this Ordinance shall become effective immediately
upon passage and adoption.
