AN ORDINANCE OF THE CITY Of SANFORD, FLORIDA, AMENDING ORDINANCE
NO. 3324 AND ITS AMENDMENTS BY ADDING SECTIONS 22.0 ENTITLED
STAND-BY TIME POLICY AND SECTION 23.0 ENTITLED PAY FOR WORK
DURING EMERGENCIES OR DISASTERS POLICY, TO THE CITY'S PERSONNEL
RULES AND REGULATIONS; PROVIDING FOR SEVERABILITY, CONFLICTS AND
EFFECTIVE DATE.
WHEREAS, it is the desire of the City Commission of the City of Sanford, Florida, to add
Section 22.0 and Section 23.0 to the existing Personnel Rules and Regulations.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD,
FLORIDA:
SECTION 1: The City Commission adopts statements above as if fully set forth herein.
SECTION 2: That Sections 22.0 and Section 23.0 of the Personnel Rules and
Regulations which is attached hereto as Exhibit "A" is incorporated herein by reference are hereby
adopted.
SECTION 3: If any section or portion of a section of this Ordinance proves to be invalid,
unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other
section or part of this Ordinance.
SECTION 4: That all ordinances or parts of ordinances in conflict herewith be and the
same are hereby revoked.
SECTION 5: That this ordinance shall become effective immediately upon its passage
and adoption.

SECTION 3-1.0
STAND-BY TIME POLICY
21.1 GENERAL
It is the policy to compensate all non-exempt employees who are required to perform
stand joy duties as assigned by a supervisor and to be immediately available for work
situations arising on the employees off-duty time. This generally includes nights,
weekends, and holidays. Stand-by time is defined as the time period when an
employee is required to remain available for duty during non-routine hours resulting
in restriction of normal activities and movement.
PROCEDURES
All non-exempt employees may be required to perform stand-by duties as assigned by
the immediate supervisor and appreved by the Division Supervisor and/or Department
Director. Department Directors shall have the authority to establish the need for stand-
by services and enforce Department policies and procedures governing it's use.
COMPENSATION
All non-exempt employees who are designated to perform stand-by duties shall be
compensated at a rate of one (1) hour at streicjht time for each day of the week,
including weekends and holidays regardless of actual hours worked. This
compensation is not considered as "hours worked" for the purpose of overtime
eligibility. When responding to the call out during non-business hours, employees
shall be paid for the actual time spent on the cell. These hours are considered "hours
worked" for the purpose of calculating overtime.
PERFORMANCE REQUIREMENTS
When employees perform work as a result of the stand-by procedures or other similar
emergencies during the non-business hours preceding or following their regular shift,
a rest period may be required by the immediate supervisor. If necessary, the
employees regular work schedule may be changed by the immediate supervisor to
allow a period of rest.
Employees designated for stand-by duty may be authorized to take home a City vehicle
and the necessary service equipment while on stand-by in accordance with the
Department policies and procedures. The Department Director shall have the authority
to implement addItional requirements governing these procedures for stand-by duty,
as deemed appropriate.

PAY FOR WORK DURING EMERGENCIES OR DISASTERS
22.1 GENERAL
It is the policy to fairy compensate employees when any natural, technological or
human-caused emergency or disaster requires an emergency declaration by the City.
PROCEDURES
City personnel in non-exempt pay plans who are designated by their Department
Director and who are assigned to work during emergencies, will be compensated for
time worked. These employees will receive full pay for hours worked during the
emergency in addition to their normal pay for the work day or workweek only in the
event that City operations have been closed down due to the disaster and State or
Local Emergency has been declared by the City Commissionera. Overtime rules apply
according to the Fair Labor Standards Act (F.LS.A.)
It is the department's responsibility to verify any emergency hours worked and approve
all payment.
When City operations are closed down before start of a scheduled workday, employees
normally scheduled to work who are instructed not to report to work (as described in
(1) above) will receive full pay for the workday.
When City operations are closed down during a scheduled workday, employees who
report to work and are subsequently released by the City Manager will receive full pay
for the workday.
Employees already on otficlal leave will not receive any additional paid time off and will
be paid according to their Original leave request.
Employees scheduled to be on leave during their standard work week (vacation,
holidays, personnel, comp. time or sick) who are called in to work due to an emergency
situation will be paid at an overtime rate.
