The Construction Industries Recovery Fund was created to reimburse consumers who have suffered monetary loss due to violation of building codes, mismanagement, misconduct, abandonment or signing certain false statements concerning bonding, payment of sub -contractors or insurance coverage, by any contractor, financially responsible officer or business organization licensed under Chapter 489, FL Statutes. This Fund is only available in cases where the contract was signed AND the violation occurred on or after July 1, 1993. Filing a complaint against a contractor is not the same as filing a claim against the Fund. Even if you file a complaint against a contractor with the Department of Business & Professional Regulation (DBPR), you still have to give the Construction Industry Licensing Board (CILB) notice of your claim and file a separate claim against the Fund to recover any money from the Fund. In order to seek compensation from the Construction Industries Recovery Fund, you must notify the CILB of your claim by certified mail at the time you commence legal action if: 1. You have entered into written contract with a licensed contractor for repair, restoration, improvement or construction of residential real property; and 2. You have commenced legal action against a contractor, financially responsible officer or business organization for violations of the applicable portions of S.489.129, FL Stat. You will also be required to file a Construction Industries Recovery Fund Claim Form with the CILB. TYPES OF VIOLATIONS The Recovery Fund is only available if the contractor, financially responsible officer or business organization committed one of the following violations: 1. Knowingly violating applicable city, county, or state building codes or laws. 2. Committing mismanagement of funds or misconduct in the practice of contracting that causes financial harm to a customer. 3. Abandoning a construction project for more than 90 days. 4. Signing a false statement claiming work is bonded, that all payments to subcontractors have been made. 5. Claiming to have provided certain worker's compensation and insurance protection. Florida laws provide specific definitions for determining whether a contractor's actions may constitute one of these violations. Contractor Initials:_ — Owner Initials: CONDITIONS FOR RECOVERY In order to recover from the Fund, you must be an individual - not a company. The Recovery Fund is intended only as a last resort. Before you can get any money from the Fund, you must have obtained a final judgment from a Florida Court or a restitution order from the CILB based on the types of violations of law already mentioned. The violation of law and the signing of the construction contract must have BOTH happened on or after July 1, 1993. Before the Fund will pay any money, you must show that you have made exhaustive efforts to determine if there are any assets of the contractor, financially responsible officer or business organization, or any other people or companies that you may have a judgment against, from which you can recover all or part of the money you are owed. If so, you must try to recover before you can collect from the Fund. You have to file a claim for recovery with the Fund within 2 years of the time you find out or should have found out about the violation of law. No claim can be made more than 4 years after the time the violation of law happened. PERSONS NOT QUALIFIED You cannot recover from the Fund if: 1. You are married to the person your judgment or restitution order is against or you are the personal representative of such married person. 2. You were the contractor on the job that caused the claim. 3. Your construction contract was signed before July 1, 1993. 4. The violation of law happened before July 1, 1993. 5. The contractor did not have a valid and current license at time the construction was done. 6. You were associated in a business relationship with the contractor other than the construction contract related to the claim. 7. You lost money because you made improper payments to the contractor in violation of Chapter 713, Part I, FL Statutes. PAYMENTS FROM THE FUND The Fund does not pay post -judgment interest, punitive damages, or attorney fees. The Fund only pays what you have not yet collected for actual or compensatory damages. The Fund pays the lesser of up to $25,000 per claim, 25,000 per transaction, or $50,000 per contractor. THE CONTRACTOR WHO AGREED TO WORK ON YOUR RESIDENTIAL PROPERTY IS REQUIRED BY STATE LAW TO GIVE YOU THIS NOTICE TWICE DURING THE CONTRACT. Regulation Florida's Construction Lien Law Protect Yourself and Your Investment According to Florida law, those who work on your property or provide materials, and are not paid -in -full, have a right to enforce their claim for payment against your property. This claim is known as a construction lien. If your contractor fails to pay subcontractors or material suppliers, the people who are owed money may look to your property for payment, even if you have paid your contractor in full. This means that if a lien is filed against your property, your property could be sold against your will to pay for labor, materials, or other services which your contractor may have failed to pay. This document provides information regarding Florida Statute 713, Part 1, as it pertains to home construction and remodeling, and provides tips on how you can avoid construction liens on your property. Protecting Yourself If you hire a contractor and the improvements cost more than $2,500, you should know the following: You may liable if you pay your contractor and he then fails to pay his suppliers or contractors. There is a way to protect yourself. A Release of Lien is a written statement that removes your property from the threat of lien. Before you make any payment, be sure you receive this waiver from suppliers and subcontractors covering the materials used and work performed on your property. Request from the contractor, via certified or registered mail, a list of all subcontractors and suppliers who have a contract with the contractor to provide services or materials to your property. If your contract calls for partial payments before the work is completed, get a Partial Release of Lien covering all workers and materials used to that point. Before you make the last payment to your contractor, obtain an affidavit from your contractor that specifies all unpaid parties who performed labor, services or provided services or materials to your property. Make sure that your contractor provides you with final releases from these parties before you make the final payment. Always file a Notice of Commencement before beginning a home construction or remodeling project. The local authority that issues building permits is required to provide this form. You must record the form with the Clerk of the Circuit Court in the county where the property being improved is located. Also post a certified copy at the job site. (In lieu of a certified copy, you may post an affidavit stating that a Notice of Commencement has been recorded. Attach a copy of the Notice of Commencement to the affidavit.) In addition, the building department is prohibited from performing the first inspection if the Notice of Commencement is not also filed with the building department. You can also supply a notarized statement that the Notice has been filed, with a copy attached. The Notice of Commencement notes the intent to begin improvements, the location of the property, description of the work and the amount of bond (if any). It also identifies the property owner, contractor, surety, lender and other pertinent information. Failure to record a Notice of Commencement or incorrect information on the Notice could contribute to your having to pay twice for the same work or materials. 1 of 2 Upd t 11 2/10/2008 Notice To Owner Prior to filing a lien, a lienor who does not have a direct contract with the owner, must serve the owner with a Notice to Owner. The Notice to Owner must state the lienor's name and address, and a description of the real property and the nature of the services or materials being furnished. The Notice to Owner must be served before commencing, or within 45 days of commencing, to furnish the services or materials (but before owner's final payment to the contractor). A lien cannot be enforced unless the lienor has served the Notice to Owner as described above. Whose Responsibility is it To Get These Releases? You can stipulate in the agreement with your contractor that he must provide all releases of lien. If it is not a part of the contract, however, or you act as your own contractor, YOU must get the releases. If you borrow money to pay for the improvements and the lender pays the contractor(s) directly without obtaining releases, the lending institution may be responsible to you for any loss. What Can Happen If I Don't Get Releases Of Lien? You will not be able to sell your property unless all outstanding liens are paid. Sometimes a landowner can even be forced to sell his property to satisfy a lien. Who Can Claim A Lien On My Property? Contractors, laborers, materials suppliers, subcontractors and professionals such as architects, landscape architects, interior designers, engineers or land surveyors all have the right to file a claim of lien for work or materials. Always require a release of lien from anyone who does work on your home. Contesting A Lien A lien is valid for one year, unless a lienor files a lawsuit to enforce the lien prior to the expiration of the year. An owner has a right to file a Notice of Contest of Lien during the one-year period. Upon the filing of a Notice of Contest of Lien, a lienor must file a lawsuit to enforce the lien within 60 days. These conditions can lead to: 1. Vapor Condensation 2. Buckling of shingles due to deck movement. 3. Rotting of wood members. 4. Premature failure of roof. To insure adequate ventilation and circulation of air, the ventilation system must include inlets and outlets. This may be accomplished with a combination of ridge and soffit vents or by using gable end vents. FHA minimum property standards require one square foot of net free ventilation area to each 150 square feet of space to be vented. This may be reduced to one square foot of ventilation area per 300 square feet if at least 40% and not more than 50% of venting is provided not more than 3 feet below the ridge or if a Class I or II vapor barrier is installed on the warm in winter side of the ceiling in climate zones 6, 7, and 8 as recommended by the 2012 International Residential Code. IT IS PARTICULARLY IMPORTANT TO PROVIDE ADEQUATE VENTILATION, WIND CAUTION: Extreme wind velocities can damage these shingles after application when proper sealing of the shingles does not occur. I6OW SLOPE APPI61CATION On pitches 2 in. per foot to 4 in. per foot cover the deck with two layers of underlayment. Begin by applying the underlayment in a 1/2 -sheet width along the eaves and overhanging the drip edge by 1/4 to 3/4 in. Place a full -sheet width over the 1/2 -sheet width starter piece, completely overlapping it. All succeeding courses will be positioned to overlap the preceding course by 1/2 -sheet width. If winter temperatures average 25nF or less, thoroughly cement the laps of the entire underlayment to each other with TAM -PRO or TAMKO Plastic Roof Cement from eaves and rakes to a point of a least 24 in. inside the interior wall line of the building. As an alternative, TAMKO's Moisture Guard Plus®, TW Metal and Tile Underlayment, or TW Underlayment self -adhering underlayment may be used in lieu of the cemented felts. 7. MANSARD ROOF OR STEEP SLOPS ROOF If the slope exceeds 21 in. per foot (60', each shingle must be sealed with TAM -PRO SBS Adhesive or TAMKO Tam -Seal Adhesive immediately upon installation. Quarter -sized dabs of cement must be applied to shingles with a 5-5/8 in. exposure, use 6 fasteners per shingle. See Section 3 for the Mansard Fastening Pattern. S. R&ROOFINO Before re -roofing, be certain to inspect the roof decks. All plywood shall meet the requirements listed in Section 1. It is not recommended to install laminated asphalt shingles directly over existing laminated shingles due to the unevenness of the existing FORMERLY HERITAGE® 30 mufti -layered shingles. The performance of the sealant feature may be compromised, preventing the shingles from sealing property. It is acceptable to install laminated shingles over existing three -tab strip shingles which are flat and essentially intact. Nail down or remove curled or broken shingles from the existing roof. Replace all missing shingles with new ones to provide a smooth base. Shingles that are buckled usually indicate warped decking or protruding nails. Hammer down all protruding nails or remove them and refasten in a new location. Remove all drip edge metal and replace with new. If re -roofing over an existing roof where new flashing is required to protect against ice dams (freeze/thaw cycle of water and/or the backup of water in frozen or clogged gutters), remove the old roofing to a point at least 24 in. beyond the interior wall line and apply TAMKO's Moisture Guard Plus®, TW Metal and Tile Underlayment, or TW Underlayment. Contact TAMKO's Technical Services Department for more information. Measurements will vary when nesting over an existing 5 in. exposure single roof: Call TAMKO Technical Services for further information. The nesting procedure described below is the preferred method for reroofing over existing metric size shingles with a 5-5/8 in, exposure. See description below: Starter Course: Remove the tabs and an additional portion from the head of a full size shingle so that its height is equal to the exposure of the existing shingles. Position the resulting strip over the existing roof edge (with the factory -applied adhesive strip along the eaves). Cut approximately 6 in. from the rake end and apply the remaining portion at the eaves. Continue the starter strip by applying full length shingle strips cut to height as above, evenly along the existing roof at the eaves. The existing roof should overhang the eaves far enough to carry water off into the gutter. If this is not the case, cut and appy the starter strip so that it will provide sufficient overhang for proper drainage. First Course: Remove an amount from the butt edge of a full-size shingle so that the remaining portion of the shingle fits between the butts of the existing third course. This course must also be applied evenly along the eaves edge of the new starter strip. Drip Ne Second and Succeeding Courses: Remove 10-3/8 in. from the rake end of the first shingle in the second course, and continue with full width shingles for the remainder of the course, placing the top edge of each new shingle against the butt edge of the old shingle in the course above. This method should create an exposure of 5-5/8 in. afterthe first course. When beginning the succeeding courses continue to follow the Heritage application instructions. (See section 5). Press the shingles tightly into the valley. Use normal shingle fastening methods. Note: No fastener should be within 6 in. of the valley centerline, and two fasteners should be placed at the end of each shingle crossing the valley. To the adjoining roof plane, apply one row of shingles vertically facing the valley and 2 in. back from the valley centerline. Note: For a neater installation, snap a. chalkline over the shingles for guidance. To complete the valley, apply shingles on the adjoining roof plane by positioning the tip of the first shingle of each row at the 2 in. point from the centerline where the edge of the vertical shingle has been applied, covering the vertical shingle.
