AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
AMENDING ORDINANCE NO. 3117 OF SAID CITY; SAID
ORDINANCE BEING A ZONING PLAN; SAID AMENDMENT
TO AMEND AND REPLACE THE EXISTING UPSALA ROAD
PD MASTER PLAN ON PROPERTY LYING BETWEEN
STATE ROAD 46 AND SMITH CANAL ROAD AND
BETWEEN ELDER ROAD AND UPSALA ROAD TO
WESTLAKE APARTMENTS REVISED PD MASTER PLAN
SUBJECT TO CERTAIN CONDITIONS AND STIPULATIONS;
PROVIDING FOR SEVERABILITY, CONFLICTS AND
EFFECTIVE DATE.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
SANFORD, FLORIDA:
SECTION 1: That Ordinance No. 3117 of the City of Sanford, Florida passed and
adopted July 27, 1992, said Ordinance being the Comprehensive Zoning Ordinance of the
City of Sanford, Florida, regulating and restricting the location and use of buildings,
structures, land, and water for trade, industry, residence or other purpose, be and the
same is hereby amended as follows:
Lots 21 and 22 of M.M. Smith's Subdivision, according to the Plat thereof as
recorded in Plat Book 1, Page 86, of the Public Records of Seminole County,
Florida.
be and the same is hereby rezoned to Westlake Apartments Revised PD Master Plan
attached as Exhibit "A" with the following stipulations and conditions:
a. Provide a primary access to site at Upsala Road, provide a
secondary "Emergency Access Only" at EIder Road and remove the
stipulation requiring paving of EIder Road from site entrance to S.R. 46.
b. Increase building height from 35' to 45'.
c. Allow 9'x20' parking spaces.
d. Remove the existing stipulation that a traffic study be done
prior to permitting the second 50% of the project to proceed.
e. All perimeters of the site be fenced or blocked off, including
along the south property line abutting Smith Canal, and the secondary
access be permanently secured with access limited to emergency vehicles
only.
f. Stormwater and traffic studies to be approved by Seminole
County.
SECTION 2: Severability, If any section or portion of a section of this Ordinance
proves to be invalid, unlawful or unconstitutional it shall not be held to impair the validity,
force or effect of any other section or part of a section of this Ordinance.
SECTION 3: Conflicts. That all ordinances or parts of ordinances in conflict
herewith be and the same are hereby revoked.
SECTION 4: Effective Date. That this Ordinance shall become effective
immediately upon its passage and adoption.
