TERMS AND CONDITIONS 1. It shall be the responsibility of Owner to secure all valuables located at the property. Contractor is not responsible for the theft, disappearance of, or damage to, jewelry, art objects, silver, gold, cash, antiques, documents, guns, liquor, and other p nal and/or valuable items. Owner agrees to remove, store or protect such items prior to commencement of work. IC> Initials 2. If it is necessary to box items and/or move furniture to complete repairs, it is the responsibility of Contractor to return furniture and/or boxes to original location. However, Contractor is not responsible for UNPACKING boxes, unless approved and paid for by your insurance company. 3. The repairs, replacement, or additions authorized herein relate to the specifications on the front page of this contract or those attached hereto and do not cover pre-existing deficiencies unless specifically stated. 4. All materials used will be standard stock materials unless otherwise specified, and will match existing materials within reasonable tolerance as to color, texture, design, etc. 5. All painting of existing surfaces is estimated to return existing paint surfaces to the same color. Any changes in color or type of material will be done at extra cost to the owner. 6. The contract price is based on completion during normal working hours and owners agree to provide access to the job site as required for completion of the work. The owner's electricity, water, and toilet are to be made available to the contractor's personnel during the course of the work. Cost of utilities during job is the responsibility of Owner. Potential reimbursement for significant increase in cost of utilities should be addressed to insurance company. 7. Contractor will do its best to keep pets from escaping from premises, however; Contractor cannot be responsible for them. Contractor's presence may make pets nervous and unpredictable. Pets can dart through open doorways while tools and materials are being moved around, or when work areas are being ventilated, etc. It is the Owner's responsibility to keep pets under control and in a safe area. 8. Contractor agrees to do its best to keep work areas clean and free of debris. Owner is responsible for routine maintenance of premises including, but not limited to pool and or spa, irrigation system, water -conditioning system, plumbing, electric and HVAC systems not affected by repairs, insect and rodent control. 9. Owner agrees to allow Contractor to place a sign, dumpster and trailer on the property. 10. Owner grants permission to Contractor to use before and after pictures of the project in advertisement and promotional materials. 11. The Owner agrees that, during the course of this Contract, no other Contractors shall be allowed access to the premises, unless otherwise specifically agreed in writing between the Contractor and the Owner. 12. Work deleted from this work authorization must be agreed to by both the owner and contractor, in writing, and the owner, will be credited for such work in an amount equal to the amount of the line item(s), less 20% overhead and profit. 13. All material allowances in these contract documents include sales tax and delivery charge. The cost of all final selections by the "Owner" shall also include sales tax and delivery charges. The cost of all selections in excess of the allowance shall be reflected in a Change Order. The additional cost for each item shall be increased by 25% for overhead and profit, and payment in full shall be due when the Change Order is executed. Change Orders may also be executed for all selections which decrease the costs and these credits shall be applied to the final payment. Page 2 of 3 14. The contractor guarantees all workmanship covered by this contract for a period of one year from the earlier date of final inspection, signed punchlist, or occupancy/use by owner. All materials and equipment furnished hereunder will be new, unless otherwise specified, and that all work will be of workman -like quality, and in conformance with accepted, construction practices by NAHB. THIS WARRANTY IS IN LIEU OF AND EXCLUDES ALL OTHER EXPRESS OR IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE OR OTHERWISE, ARISING BY OPERATION OF LAW OR OTHERWISE, AND IN NO EVENT WILL CONTRACTOR BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, WHETHER BASED ON CONTRACT OR TORT. Products, equipment, systems or materials incorporated in the work shall be covered exclusively by the warranty of the manufacturer. There are no warranties which extend beyond the description on the face thereof. All other warranties expressed or implied including the warranty of merchantability and the warranty of fitness for a particular purpose are expressly disclaimed. This warranty does not apply to any work, which has not been performed in accordance with a written agreement signed by Owner and Contractor, including any work done by the homeowner. 15. Paul Davis Restoration is not responsible for any failed inspections and/or any damages that may result from work performed by anyone not authorized by Paul Davis Restoration, including the homeowner. 16. In the event it becomes necessary for the contractor to turn this matter over to an attorney or collection agent for collection, owners agree to pay all collection fees, attorney fees, and court costs incurred for such collection. 17. Payments not made in accordance with this schedule shall be considered delinquent after ten days, and owner agrees to pay interest thereon at one and one-half percent (1 %%) per month until paid. Warranty void if payment is not made as to terms of contract. 18. The owner may cancel this transaction at any time prior to midnight of the third business day after the date of this transaction, without penalty. If this transaction is canceled after midnight of the third business day, owner shall reimburse contractor for any work completed or portion thereof prior to cancellation, plus ten (10) percent of the total approved estimate(s). 19. Upon request Contractor shall provide owner with written release of lien from any person or company that has provided owner with a "Notice to Owner". DUE TO THE NATURE OF THE WORK NO COMPLETION DATE IS SPECIFIED. THIS CONTRACT REPRESENTS THE FULL AGREEMENT BETWEEN THE PARTIES AND NO PROMISES WILL BE BINDING ON THE CONTRACTOR.
