We submitted drawings for the work to be done. There are a few minor things that need to be done for the work to pass inspection by the County. Observations and Comments: 1. The 3 joists and beam the run perpendicular to the I-beam must be shimmed using metal shim and bar stock so that the joists and beam at resting on the steel I-beam. Presently, there are gaps between each member. 2. There is slight motion in the column. The reason is that the column next to the sliding door is secured at the bottom (floor end) but not at the top.. Use two "L" brackets bolted to the web of the steel I-beam and set to be against the concrete block wall. The "L" brackets can be 4" X 2" X 3/8" thick. Bolt them using 2- 3/16" dia. steel bolts only enough to pass through the web and hold the 2 "L" brackets in place. At the concrete block end use 2-Tapcon 3/16" dia. Screws to secure the column at the top. 3. There was no footing set at the screen door end. Therefore, build a footing, as called out in the drawing at that end. Since there is a footing at the inner end, there will be no need to build another footing at that end. Conclusion: We certify that the above will be sufficient for the finalizing of the work in this home. This letter must be presented to the County for their final approval before making changes. If a subcontractor is selected he must carry all appropriate licenses and insurances required by local, city and state licensing boards. The Contractor will verify once all documents are received. At that time a subcontract must be written, reviewed and approved by Contractor and Subcontractor. Once approved and signed work will commence. The contractor will not allow any Subcontractor or Subcontractor employees on premises unless first getting their workers comp certificate naming Owner as a named insured. Article 16: Warranty Contractor provides a warranty on all Contractor and Subcontractor supplied labor and materials supplied on this project for a period of one year following substantial completion of all work. No warranty is provided by Contractor on any materials furnished by the Owner for installation. No warranty is provided on any existing materials that are moved and / or reinstalled by the Contractor within the dwelling (including any warranty that existing/used materials will not be damaged during the removal and reinstallation process). One year after substantial completion of the project, the Owner's sole remedy (for materials and labor) on all materials that are covered by the manufacturer's warranty is strictly with the manufacturer, not with the Contractor. ARTICLE 10: WORK STOPPAGE AND TERMINATION OF AGREEMENT FOR DEFAULT Contractor shall have the right to stop ail work on the project if payments are not made to Contractor in accordance with the Payment Schedule in this Agreement, or if Owner repeatedly fails or refuses to furnish Contractor with access to the job site and 1 or product selections or information necessary for the advancement of Contractor's work. Simultaneous with stopping work on the project, the Contractor must give Owner written notice of the nature of Owner's default and must also give Owner 14-day period in which to cure this default. If work is stopped due to any of the above reasons (or for any other material breach of agreement by Owner) for a period of 14 days, and the Owner has failed to take significant steps to cure his default, then Contractor may, without prejudicing any other remedies Contractor may have, give written notice of termination of the Agreement to Owner and demand payment for all completed work and materials ordered through the date of work stoppage, and any other toss sustained by Contractor, including Contractor's Profit and Overhead at the rate of 17% on the balance of the incomplete work under this Agreement. Thereafter, Contractor is relieved from all other contractual duties. including all Punch List and Warranty Work. However, the market for the building materials that are hereafter specified is considered to be volatile, and sudden price increases or decreases could occur. The Contractor agrees to use his best efforts to obtain the lowest prices from available suppliers but should there be an increase or decrease in prices of these specified materials that are purchased after execution of contract for use on this constriction project, the Owner agrees to pay that cost increase to the Contractor, or any decrease will be credited to the Owner. B. INSTALLATION OF OWNER -SUPPLIED FIXTURES AND MATERIALS: Contractor cannot warranty any Owner -Supplied materials or fixtures (whether new or used). If Owner -supplied materials and fixtures fail due to defect in the materials or fixtures themselves, Contractor will charge for all labor and materials required to repair or replace both the defective materials or fixtures, and any surrounding work that is damaged by these effective materials. C. Control and Direction of Employees and Subcontractors: Contractor or his appointed Supervisor shall be the sole supervisor of Contractor's Employees and Subcontractors. Owner must not order or request Contractor Employees and Subcontractors to make changes in the work. ARTICLE 15: SUBCONTRACTORS The Contractor may use subcontractors to perform specific portions of this contract that the Contractor cannot perform with his personnel. The Owner may specify a subcontractor they wish to receive a proposal from for this contract; however, the Contractor shall not be required to subcontract with anyone he has reasonable objection to. If a subcontractor is selected he must carry all appropriate licenses and insurances required by local, city and state licensing boards. The Contractor will verify once all documents are received. At that time a subcontract must be written, reviewed and approved by Contractor and Subcontractor. Once approved and signed work will commence. The contractor will not allow any Subcontractor or Subcontractor employees on premises unless first getting their workers comp certificate naming Owner as a named insured. Article 16: Warranty Contractor provides a warranty on all Contractor and Subcontractor supplied labor and materials supplied on this project for a period of one year following substantial completion of all work. No warranty is provided by Contractor on any materials furnished by the Owner for installation. No warranty is provided on any existing materials that are moved and / or reinstalled by the Contractor within the dwelling (including any warranty that existing/used materials will not be damaged during the removal and reinstallation process). One year after substantial completion of the project, the Owner's sole remedy (for materials and labor) on all materials that are covered by the manufacturer's warranty is strictly with the manufacturer, not with the Contractor.
