Progress payments are payments for a completed pool phase. Progress payments are due upon receipt, and the next phase of the pool will not proceed until the progress payment is paid. Payments will be declared late after 10 days from the invoiced date and they shall bear interest at the rate of 18 per annum until paid. Any additional work or extras will be through a change order or addendum and will be due at time of signing change order or addendum. The contractor shall not be obligated to commence construction of this pool until three days after the signing of this contract by the Owner. The.contract price is for all materials, equipment, and labor required for the construction of the swimming pool graphically described in the plot plan signed by the owner and generally described in the specifications below. CONSTRUCTION SPECIFICATIONS: Contractor will install a swimming pool and appurtenant structures and equipment in accordance with the plot plan and these construction specifications. Contractor reserves the right to substitute like or similar material, equipment or fixtures. The plot plan is intended to be a representation of the pool to be built and not intended to represent an "as built" drawing because pool location, elevation of pool, location of decking and enclosures are subject to change due to set back requirements, location of existing improvements, soil conditions and other conditions beyond the control of the contractor. All measurements in this contract and on the plot plan are approximate and the pool dimensions contained in the contract may vary from the "as built" measurements. Deviations up to three (3) inches are acceptable. Therefore, the parties agree that it is impossible to ascertain actual damages in the event of deviation from specified pool dimensions. The parties agree to adjust the contract price of an mount calculated by multiplying the percentage reduction of surface area times one-half (1/2) of the total contract price for diminished water surface area, and $5.00 for each vertical inch of depth deficiency measured only at the main drain and the shallowest portion of the pool as liquidated damages to owner resulting from said variations, if any. Depth is measured from the floor of the pool to the top of the waterline tile. The YARDGUARD can be used to monitor potential dangerous areas, and provides a high volume alarm/alert when children enter these areas. It can be used indoors or outdoors, mounted on a wooden fence or metal gates. It can be mounted on any doorways or openings that lead to potentially dangerous areas. Caution The alarm siren is very loud. Never place the unit close to your ear. Prolonged exposure to the loud siren can affect your hearing. Install the unit at minimum height 54", high enough to be out of reach of children. This YARDGUARD is an entry monitor device. Whether expressed or implied, it cannot replace any safety device. All safety precautions should be maintained, including parental supervision. Neither SrnartPool Inc. nor anyone else who has been involved in the creation, reproduction or delivery shall be liable for any direct, indirect, consequential or incidental damages arising out of the use or liability to use the YARDGUARD. ♦- Install Battery Before installing the battery, use a rubber band to hold the n�agnet sensors together temporarily, with dot matched to dot, thereby preventing the alarm from sounding after the battery is installed when mounting the unit_ To install battery, remove the four screws at the back, then open the battery door. install a fresh 9V battery (not included) into the battery compartment. Check the polarity. Close the battery door and tighten up the four screws. Now the unit is ON and in working mode. To check if battery is installed properly, press the battery check button located at the lower right corner. The unit will beep when you press this button. if no beep sound is heard, check the battery installation again, or replace with a ne«x battery. Auto Battery Check The unit will keep monitoring the battery level. When it detects that the battery is low, you will hear a loud and short beep every minute. Change battery when you hear this beep. Mount On Wooden Fence Install the mounting bracket onto fence post using the two bigger screws. Slide the alarm unit onto this mounting bracket You will feel a click when the unit is properly installed. Mount the two inagnet sensors onto fence post, one on each side, using the four smaller screws. Mount On Metal Gate Install the mounting bracket onto gate post using two nylon straps. Slide the alarm unit onto this mounting bracket. You will feel a click when the unit is properly installed. Mount the two magnet sensors onto the t w o spacer stands using the f o u r smaller screws and then mount this sensor assembly onto gate post usinz the nylon straps. s 6 Mount an Wall And Glass Doors Install the mounting bracket using two pieces of double sided foam tape. Slide the alarm unit onto this mounting bracket. You will feel a click when the unit is properly installed. Apply the double sided foam tape onto the bottom recessed area of magnet sensor pair. Mount the mad sensors, one on the door a the other on the door frann( Mount the magnet sensor w the wire onto the statione surface such as door frame Additional PASS/RESET Switch This unit provides an additional PASS/ USET switch, which can be mounted on the other side of the door for convenient access from both sides. This additional switch can be mounted by the 2 smaller screws or Al 1161C;Ai A iinam 7 8 ii. Operation This YARDGU.A.RD is designed to monitor the opening of gate or door, to alert an adult if a child has opened a gate or door to a potential dangerous area. Check the battery. Press the CHECK button should give a loud beep, otherwise replace with a new battery. The twit will give a loud siren if gate or door is opened by more than one inch. For adult entry, press the PASS button. The unit will allow the door be opened up to 7 seconds without triggering alarm. However, if the gate or door is opened for over 7 seconds, the alarm will trigger. 4 To reset the alarm, first close the door and then press the PASS/RESET button. The alarm is now back to stand by mode. To exit the protected area, press the PASS/RESET button and exit the area within 30 seconds. Automatic Reset Under All Conditions The unit will be reset automatically in 30 seconds after the last key activation. If the PASS/RESET button is pressed but the adult entry 7 seconds allowance is not utilized, this adult entry allowance will be canceled in 30 seconds, and reset to stand by mode automatically. ip r. Auto Siren OFF Siren can be turned OFF manually as describe on previous section. or the 111111 u%ill reset in 4 minutes automatically if the clat.e is closed. Automatic Continous Monitoring If alarm is triggered and reset by itself in 4 minutes, the unit will check the condition of magnet contact sensor to decide if the door remains open or not. If the door is left open. the alarm sounds again for 4 minutes_ check the door condition agaitl and continue the cycle until the door is closed IMPORTANT Deep the distance between the two pieces magnet sensor contacts to a maximum of 3/4" Test the unit by opening the door. The alarm should go off immediately. Otherwise contact SmartPool Inc. at 877-799-7665.
