1. PARTIES: Agreement between ALL SEASONS POOLS, hereinafter called the contractor, and
LINDAYANKOVIC
hereinafter called the owner.
2. AGREEMENT: The contractor agrees to build one residential swimming pool for the owner on the premises described as follows:

3. PRICE AND TERMS:
The contract price is: _ THIRTY FIVE THOUSAND DOLLARS
Payable as follows: Deposit to secure agreement:
1) Q" - - _ _ 10% Payable upon signing of this instrument as a deposit.
2) _ 30% Upon completion of dig and steel.
3) 30% Upon completion of concrete shell.
Due Upon tile and perimeter plumbing installation; plus extras if any, after footers and or rough deck is

Customer will be billed in writing for progress payments as each phase is completed. Progress payments and payments for extras are payments for
completed work, and if not paid within 10 days from their due date they shall bear interest at the rate of 18% per annum until paid.
The contractor shall not be obligated to commence construction of this pool until three days after the signing of this contract by the Owner. Since this
contract may be construed as a Home Solicitation Sale. Purchaser Is hereby notified of this right to cancel under the Home Solicitation Sales Act.
The contract price is for all materials, equipment, and labor required for the construction of the swimming pool graphically described in the plot plan
signed by the owner and generally described in the specifications below. Furthermore, if owner finances pool with Contractor, this agreement is subject to
the Home Improvement Installment Contract and Mortgage executed by owner(s).
4. CONSTRUCTION SPECIFICATIONS: Contractor will install a swimming pool and appurtenant structures and equipment in accordance with the plot
plan and these construction specifications. Contractor reserves the right to substitute like or similar material, equipment or fixtures. The plot plan is
intended to be a representation of the pool to be built and not intended to represent an "as built" drawing because pool location, elevation of pool, location
of decking and enclosures are subject to change due to set back requirements, location of existing improvements, soil conditions and other conditions
beyond the control of the contractor. All measurements in this contract and on the plot plan are approximate and the pool dimensions contained in the
contract may vary from the "as built" measurements. Deviations up to three (3) inches are acceptable. Therefore, the parties agree that it is impossible to
ascertain actual damages in the event of deviation from specified pool dimensions. The parties agree to adjust the contract price of an amount calculated
by multiplying the percentage reduction of surface area times one-half (1/2) of the total contract price for diminished water surface area, and $5.00 for each
vertical inch of depth deficiency measured only at the main drain and the shallowest portion of the pool as liquidated damages to owner resulting from said
variations, if any. Depth is measured from the floor of the pool to the top of the waterline tile. Any additional soil needed for decking or normal grading in
excess of what is dug from the pool, is at home owner's expense.
If a diving board or slide is installed, there is no liability assumed for injuries as a consequence of use or misuse of the diving board or slide.
If a diving board or slide is installed later, there is no liability to the pool contractor and it shall cancel all warranties.

Elevation of pool, deck slab and slope of deck slab are to be determined by the contractor unless otherwise specified in additional provisions below.

5. BUYERS RIGHT TO CANCEL: This is a Home Solicitation Sale. If you do not want the goods or service contracted for, you may cancel this agreement
by mailing a notice to seller. This notice must indicate that you do not want the goods and services and must be postmarked by midnight the third day after
you signed this agreement. If you cancel this agreement, the seller may keep all or part of the cash down payment not to exceed the lesser of ten percent
of the cash price or $50.00.
6. OFFER AND AGREEMENT: This contract shall be deemed an offer to ALL SEASONS POOLS and shall be null and void unless accepted by a duly
authorized officer of the Contractor within ten days of the date and year noted above the Owner's signatures. The salesman has no authority to bind the
Contractor. All agreements and understandings are contained in this contract, and the Owner warrants that there are no agreements or understandings
other than are set forth in this document. Acceptance of the terms of this contract by Contractor is to be communicated to the Owner by transmitting a copy
of this contract to them showing acceptance by the sellers by the execution of a duly authorized office of the Contractor or by commencing construction.

will be used to meet the requirements of Florida Building Code, Section 424.2. The
pool will be equipped with an approved safety pool cover that complies with ASTM
F 1346-91. Standard Performance Specifications for Safety Covers for Swimming
Pools Spas and Hot Tubs. A
continuous; one-piece barrier (child fence) meeting. the requirements of Florida Building
Code 424.2.17.1 will protect the pool perimeter (pool deck). Submit Plans
must show the fences location and method of attachment, including one end that
shall not be removable with the use of tools. A
combination. of non -dwelling walls, (screen enclosures, child fences, etc.) will protect
the pool perimeter. Submit plans specifying the type and location of all non -
dwelling walls: Any
combination of protection which incorporates dwelling walls with doors and/
or windows opening directly into the pool perimeter which, includes self closing,
self latching devices and/or exit alarms complying with UL.2017 and Florida
Building Code 424.2.17.1.9. Submit plans showing all types and location of
all perimeter protection. The plans must also show the location and types of all openings
as well as the hardware and/or exit alarm for each location. I
understand that not having one of the above (or an approved alternate) installed will constitute
a violation of Chapter 515 F.S.-and will be considered as committing a misdemeanor
of the second degree, punishable as provided in section 775.082 or section 775.
