By signing this agreement, the property owner authorizes Archway International, Inc to pursue the property owner's best interest for property replacement or repair at a "PRICE AGREEABLE"to the property owner;s insurance company and Archway International, Inc with no additional costs to the property owner other than the insurance deductible. This claim Is known as a construction lien. if your contractor or subcontractor fails to pay subcontractors, or material suppliers or neglects to make other legally required payments, the people who are owed money may look to your property for payment. Even if you have paid your contractor in full. If you fail to pay your contractor, your contractor may also have a lien on your property. This means if a Lien is filed your property could be sold against your will to pay for labor, materials, or other services that your contractor or subcontractor or may have failed to pay. Florida Construction Lien Law is complex and it is recommended that whenever a specific problem arises, you consult anattorney. 4- The company shall not be liable for failure of performances due to labor controversies, strikes, fires, weather and inability to obtain materials from usual sources, or any other circumstances beyond the control of the company whether of similar or dissimilar nature. 5- The company is not responsible for any damage below the roof, due to ice dams hail or pre-existing construction defects during the period of the warranty, this includes but is not limited to faulty AC lines supply lines, supply lines and water lines, installed along the rafters or attached to the underside of the roof decking. These lines are to be installed a minimum of 6 inches below roof lines to prevent roof nails from penetrating the lines, therefore Archway International Inc cannot be responsible if damage occurs to the AC lines any Other water lines, during the roof construction, or any other damaoPs caused by penetration to one of these lines. 6- If roofing and sheet metalwork is involved, it is understood and agreed to that our standard roof guarantee shall be acceptable and that all terms and provisions therein shall prevail, unless otherwise specifically agreed to in writing prior to the commencement of the work. 7- This agreementicontract constitutes the entire agreement between the parties. It maybe changed only by written instrument by both parties. 8- If any provision in this agreement/contact should be held to be invalid or unenforceable, the validity and enforceability of the remaining provisions of this agreement shall not be affected thereby. 9- Any representations, statements or other communications, not written in this agreement are agreed to be immaterial, and not relied on by either party, and do not survive the execution of this agreement. 10- During the duration of the work the customer's homeowners insurance will be responsible for any interior damage as long at the Company has taken appropriate action to protect the roof during the repair of the roof. 11 The company will provide the customer with a five (5) year limited warranty, which warranty shall be limited to repair or replacement of defective material or defective workmanship, company shall not be liable for any consequential damages and any damages shall be limited to the return of the contract price. The contract and warranty shall not be assigned and is non- transferable. For the warranty to be valid the contract must be paid in full. 12- Lien Laws: Any person or company supplying labor or materials for this improvement to your property may file alien against your property if that person or company is not paid for the contributions. In the event of default by the property owner, the Property owner agrees to pay all expenses incurred in collection including reducing to judgment this obligation including a 33% attorneys fee. The proper venue for all legal proceedings arising from the contract shall be in Florida. 13- The company has the right to order excess. This material will not be charged above the agreed upon price. All excess materials belong to the company. The company is not responsible for evaluating your home venting and circulation system status. We will install roof vent in accordance with local building codes. 14-. Mold is a common occurrence in Florida homes and any question about the dangers from mold can be determined by contacting the Center for Disease Control and Florida Department of Health. Customer agrees the contractor will not be responsible for any damage caused by mold or any other fungus or biological material, regardless of whether it may be associated with defects in Contractor's construction or services, including but not limited to property damage, personal injury, loss of income, emotional distress, death, loss of use, loss of value, adverse health effects or any special consequential, punitive or other damages. 15- These conditions shall be considered a part of any contract entered into or authorized to precede, the same as if they were included herein. 16- "Default"- if customer defaults in any of the terms and conditions contained herein, Contractor may terminate the contract and payments made may be retained by Contractor as liquidated damages. If the customer owes payments to the company, customer agrees to pay attorney's fees, cost, disbursements, and interest (at maximum rate allowed by law) for the cost incurred by the company to enforce its rights under this agreement to collect such payments from customer. 17- "Permits and licenses"- Customer hereby appoints Contractor as agent to procure all necessary or appropriate permits and license to complete the project. 18- "Change Orders and Allowances"- Any changes in the contact, including all changes that affect the price, must be approved in writing by both parties, indicating the change and any increase or decrease in the price. Unless otherwise agreed to in writing, all adjustments to the contract price shall be payable upon completion of the work. However, the company reserves the right to require additional monies for any increases in the contract price prior to completion of the work without written approval if deemed necessary to complete the work contracted
