AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
CLOSING, VACATING, ANDABANDONING APORTION OF THAT
CERTAIN 20 FOOT WIDE NORTH-SOUTH DRAINAGE EAS~ENT
AND BETWEEN UPSALA ROAD AND CENTRAL PARK DRIVE;
PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE
DATE.
WHEREAS, an appH~tion has been filed ~th the City of S~d to close,
vaate and abandon a portion of that certain 20 foot ~de North-South d~inage
easement l~ng between Northstar Court and Coastline Road and between Upsala
Road and Central Park Drive; and
WHEREAS, a public hearing was held on December 12, 1994, for consideration
and determinations to whether or not the closing, va~ng and abando~ng of a
portion of that certain 20 foot ~de North-South dr~nage easement l~ng between
Northstar Court and Coastline Road and between Upsala Road and Central Park Drive
should be allowed; and
WHEREAS, the City Commission has determined that the olos~g, vacating and
abandoning of that Certain property does not co~ict with the Comprehensive
of the City of Sa~ord, Florida, and that the public health, economy, cohort,
order, convenience, and weftare will be promoted by such closing, vacating and
abandoning.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
SANFORD, FLORIDA:
SECTION 1: That cert~n portion of that cert~n 20 foot ~de North-South
drMnage easement l~ng between Northstar Court and Coastline Road and between
Upsala Road and Central Park Drive, more particularly deseMbed as follows:
That certain 20' drYage easement l~ng ~tMn 10 feet on
either side of the common lot Hne between Lots 6 and 7,
Northstar Business Park Phase Three, according to the
Plat thereof as recorded in Plat Book 44, Pages 44 and 45,
of the Public Records of Se~nole County, FloMda,
be and the same is hereby closed, vacated and abandoned.
SECTION 2: If any section or portion of a section of tMs ordinance proves to
be invalid, unlawful or unconstitu~onal, it shall not be held to impair the validity,
force or effect of any other section or part of t~s ordinance.
SECTION 3: That all ordinances or parts of ordinances in co~ct he~th
be and the same are hereby revoked.
SECTION 4: That t~s ordinance shall become effective immediately upon its
passage and adoption.
